As used in this Part 1, the following terms shall
have the meanings indicated:
Any vehicle partially dismantled or not readily capable of
operation under its own power or not currently licensed or wrecked
or junked. It shall also mean any vehicle whose owner has terminated
the use and care of the vehicle and has either indicated by his words
or actions an intent to leave it and no longer claims ownership of
it or left it for a period of at least 10 days.
The Borough of Rockaway.
An area, not part of a driveway, between two rows of parking
spaces.
Any strip of area between parking spaces or between parking
spaces and the boundaries of a parking area not part of a driveway
or center island.
A space within a parking area maintained for the travel,
movement and distribution of vehicles to and from parking spaces.
The area between the curbline of a street and the property
line across which a vehicle may be operated in order to gain access
to a parking area.
The area between the curbline of a street and the property
line across which a vehicle may be operated in order to depart from
a parking area into a street.
For purpose of definition, "overnight" is considered the
time between 2:00 a.m. and 6:00 a.m.

Any area described in this Part 1 which is owned or leased
by the Borough of Rockaway or otherwise exclusively under its control
whereupon parking of vehicles is permitted.
Any space within a parking area marked or otherwise designated
for parking a motor vehicle.[1]
Any portion of a parking area restricted to the exclusive
use of pedestrian travel.

Interpretation. Whenever a time is stated in this
Part 1, the same shall mean prevailing time.

A.Â
For the purpose of identification in this Part 1:
(1)Â
"Municipal
Lot No. 1" shall mean and include the area owned by the Borough of
Rockaway situated on the westerly side of Wall Street in said Borough,
being behind Lot 26 in Block 46 and also being behind Lots 28 through
32 in Block 46, which lots front on West Main Street, and extending
northerly behind said lots and westerly behind Lot 26. Said lot is
more specifically identified on a certain plan entitled "Municipal
Lot No. 1," made by Spillane Engineering Associates, dated May 12,
2009, and on file with the Clerk of the Borough of Rockaway.[1]

"Municipal
Lot No. 2" shall mean and include the area owned by the Borough of
Rockaway situated between the easterly side line of Wall Street and
the side line of Dock Street, being behind Lots 21 and 22 in Block
45 and Lots 13, 14 and 20 in Block 45. Said lot is more specifically
identified on a certain plan entitled "Municipal Lot No. 2," made
by Spillane Engineering Associates, dated May 12, 2009, and on file
with the Clerk of the Borough of Rockaway.[2]

"Municipal
Lot No. 3" shall mean and include the area owned by the Borough of
Rockaway situated on the northerly side line of Maple Avenue in front
of Lots 13 and 14 in Block 45. Said lot is more specifically identified
on a certain plan entitled "Municipal Lot No. 3," made by Spillane
Engineering Associates, dated May 12, 2009, and on file with the Clerk
of the Borough of Rockaway.[3]

"Municipal
Lot No. 4" shall mean and include the area owned by the Borough of
Rockaway situated on the northerly side of West Main Street, also
known as "Block 46, Lot 33." Said lot is more specifically identified
on a certain plan entitled "Municipal Lot No. 4," made by Spillane
Engineering Associates, dated May 12, 2009, and on file with the Clerk
of the Borough of Rockaway.[4]

Lot and block designations referred to above are those
indicated on the Borough Tax Map.

No operator of a vehicle shall, at any time, within the areas designated
as Municipal Parking Lot Nos. 1, 2, 3 and 4, stand or park a vehicle:
(1)Â
In any driveway.
(2)Â
On a crosswalk or walkway.
(3)Â
On a center island or dividing strip.
(4)Â
On any grass area or planted space.
(5)Â
In any entrance to or exit from any parking area.
(6)Â
In any space other than within a single space designated for parking
by pavement marking or otherwise.
(7)Â
In any manner so as to block or impede the progress of any other
vehicle or so as to prevent access by another vehicle to a vacant
parking space or exit from a parking space occupied by another vehicle.
(8)Â
In any space or driveway where parking is prohibited as indicated
by a "no parking" sign.
(9)Â
Which is abandoned.
B.Â
All vehicles must park only in designated areas and between the lines
provided.
C.Â
All vehicles which shall be parked in any municipal parking lot within
the Borough of Rockaway shall be parked within the painted or designated
lines of parking space as provided by the Borough of Rockaway. Any
vehicles which park over or upon such lines shall be deemed to be
in violation of this Part 1 and shall be subject to the penalties
provided herein.
D.Â
Tow-away. Any vehicle parked or standing so as to obstruct or impede
a normal flow of traffic, to block entrances or exitways, loading
zones, oil fills, any grass area or pedestrian walkway or to present
in any way a safety or traffic hazard may be removed by towing the
vehicle at the owner's or operator's expense.
E.Â
Handicapped parking. All stalls shall be marked and signed in accordance
with N.J.A.C. 5:23.
F.Â
The Borough reserves the right to close individual municipal parking
lots and/or parking spaces therein as it may deem appropriate or necessary.
G.Â
Unlawful extension of authorized parking time. It shall be unlawful
and a violation of the provisions of this article for any person to
cause, allow or permit a vehicle registered in the name of or operated
by such person to remain parked within a municipal parking lot beyond
the total lawful parking time limit established for that particular
parking lot. This subsection is specifically intended to apply to
and prohibit the moving of a vehicle or vehicles from one parking
space to another parking space within the same municipal parking lot
to extend the parking time of a vehicle beyond the established lawful
parking time limit. Any such overparked vehicle shall be subject to
an additional violation for each additional time period for which
the lawful parking time limit is overextended beyond the total authorized
limit and may be towed at the violator's expense. This provision
is directed at preventing what is commonly termed as "meter feeding"
and is enacted to promote the convenience of "turnover" parking and
the availability of parking within the intended limits.
Every operator of a vehicle shall, when entering
or leaving any parking area subject to this Part 1 or any parking
space therein or while operating, standing or parking such vehicle
within any such parking area, at all times obey any direction or signal
given by a police officer of the Borough.

Regulations for Municipal Parking Lot No. 1:[1]
(1)Â
No operator of a vehicle shall stand or park a vehicle in Municipal
Parking Lot No. 1:
(a)Â
In any parking space within Municipal Parking Lot No. 1 designated
by white lines as shown on a certain site plan or diagram of the municipal
parking lots on file with the Clerk of the Borough of Rockaway for
more than four hours on any day.
(b)Â
In any parking space within Municipal Lot No. 1 designated by
yellow lines, unless:

The owner shall have first made application in the form as hereinafter
set forth to the Borough for permission to park within said lot and
shall have paid the fee as hereinafter set forth.
[2]Â
Permission has been granted by the Borough and a permit indicating
the granting of such permission has been issued, in either the form
of a bumper sticker, which shall be affixed to the rear of the vehicle,
or a hang tag, which shall be displayed on the rearview mirror.
[3]Â
The aforementioned spaces shall be commonly referred to as "all-day
parking" or "permit-parking area" and shall connote parking in said
spaces without time restriction, provided that the owner of said vehicle
has made application as aforesaid.

Regulations for Municipal Parking Lot No. 2:[2]
(1)Â
No operator of a vehicle shall stand or park a vehicle in Municipal
Parking Lot No. 2:
(a)Â
In any parking space within Municipal Parking Lot No. 2 designated
by slash marks as shown on a certain site plan or diagram of the municipal
parking lots on file with the Clerk of the Borough of Rockaway. These
spaces are reserved for Police Department vehicles.
(b)Â
In any parking space within Municipal Parking Lot No. 2 designated
by cross marks as shown on a certain site plan or diagram of the municipal
parking lots on file with the Clerk of the Borough of Rockaway for
more than four hours on any day.
(c)Â
Notwithstanding the restrictions of parking above provided,
any person who has received a parking permit shall be entitled to
park in the four-hour parking spaces without reference to any time
restrictions, provided that:

The owner shall have first made application in the form as hereinafter
set forth to the Borough for permission to park within said lot and
shall have paid the fee as hereinafter set forth.
[2]Â
Permission has been granted by the Borough and a permit indicating
the granting of such permission has been issued, in either the form
of a bumper sticker, which shall be affixed to the rear of the vehicle,
or a hang tag, which shall be displayed on the rearview mirror.
[3]Â
The aforementioned spaces shall be commonly referred to as "permit-parking
area" and shall connote parking in said spaces without time restriction,
provided that the owner of said vehicle has made application as aforesaid.

Regulations for Municipal Parking Lot No. 3:[3]
(1)Â
No operator of a vehicle shall stand or park a vehicle in Municipal
Parking Lot No. 3:
(a)Â
In any parking space within Municipal Parking Lot No. 3 designated
by slash marks as shown on a certain site plan or diagram of the municipal
parking lots on file with the Clerk of the Borough of Rockaway. These
spaces are reserved for employees of the Borough of Rockaway.
(b)Â
In any other parking space within Municipal Parking Lot No.
3 for more than four hours on any day.
(2)Â
Notwithstanding the restrictions of parking above provided, any person
who has received a parking permit shall be entitled to park in any
parking space within Municipal Lot No. 3, other than those designated
by slash marks as shown on a certain site plan or diagram of the municipal
parking lots on file with the Clerk of the Borough of Rockaway, without
reference to any time restrictions, provided that:
(a)Â
The owner shall have first made application in the form as hereinafter
set forth to the Borough for permission to park within said lot and
shall have paid the fee as hereinafter set forth.
(b)Â
Permission has been granted by the Borough and a permit indicating
the granting of such permission has been issued, in either the form
of a bumper sticker, which shall be affixed to the rear of the vehicle,
or a hang tag, which shall be displayed on the rearview mirror.
(c)Â
The aforementioned spaces shall be commonly referred to as "permit-parking
area" and shall connote parking in said spaces without time restriction,
provided that the owner of said vehicle has made application as aforesaid.

Regulations for Municipal Parking Lot No. 4:[4]

No operator of a vehicle shall stand or park a vehicle in Municipal
Parking Lot No. 4:

In any parking space within Municipal Parking Lot No. 4 as shown
on a certain site plan or diagram of the municipal parking lots on
file with the Clerk of the Borough of Rockaway for more than four
hours on any day.

A.Â
Applications for parking permits shall be made to
the Clerk of the Borough of Rockaway on forms supplied by the Borough.
B.Â
Fees.
(1)Â
When making applications for such parking permission, the vehicle owner requesting the same shall pay to the Borough the fees as provided in Chapter A263, Fees, for each passenger vehicle.

(2)Â
All fees shall be paid to the Clerk of the Borough.
(3)Â
Said permits, except one-day permits, shall be issued
on a yearly basis, and there shall be no proration if less than the
full relevant period remains at the time an application for a permit
is issued. There shall be no refunds for unexpired permits which are
returned to the Borough Clerk.

C.Â
Parking permission is subject to the following conditions:
(1)Â
Permits, except one-day permits, shall be and remain
in effect until the end of the year unless surrendered or revoked
prior thereto.

(2)Â
No amount paid on account of any permit fee shall
be refunded.
(3)Â
The issuance of a permit shall not obligate the Borough
to furnish parking facilities to the holder of said permit.
D.Â
Permission to park may be revoked for any of the following
reasons:
(1)Â
Falsely representing the ownership of a vehicle or
the residence of the owner.
(2)Â
Using a parking permit insignia on a vehicle other
than that for which such permit was granted.
(3)Â
The commission by the holder of a parking permit of
any unlawful act prohibited by the laws of the State of New Jersey
or for any act in violation of the provisions of this Part 1 or contrary
to any regulation of the Borough pertaining to the use and occupation
of any parking area while entering, parking or or leaving such parking
area.

Unless a penalty is otherwise expressly provided by New Jersey statute or under any provision of this chapter, any other chapter of this Code or any other ordinance of the Borough of Rockaway, any person convicted of a violation of any provision of Part 1 shall be subject to a maximum fine of $700. Nothing herein shall be construed to preclude the court from exercising any authority under New Jersey statute or the Rules of Court to waive and/or impose community service in lieu of payment of a fine.
