A. 
As used in this chapter, the following terms shall have the meanings indicated:
ASHES
Residue from fires used for cooking and for heating buildings.
GARBAGE
Wastes resulting from the handling, preparation, cooking and consumption of food; all animal waste and litter; all vegetable waste; and all putrescible matter and wastes from the handling, storage and sale of products.
PERSON
Includes an individual, a corporation, a joint-stock corporation, or other legal entity, a partnership, and any unincorporated association, and shall include both singular and plural but shall not include the Village of Skaneateles or any agent or servant thereof, or independent contractor therewith, while engaged in or performing any work for said Village and while acting within the scope of his authority.
REFUSE
Combustible trash, including but not limited to paper, cartons, boxes, barrels, wood, excelsior, tree branches, yard trimmings, wood furniture, bedding, rags, and wearing apparel; noncombustible trash, including but not limited to metals, tin cans, metal furniture, dirt, small quantities of rock and pieces of concrete, glass, crockery, and other mineral waste; and rubbish and waste including but not limited to street sweepings, dirt, leaves, catch basin dirt, and contents of litter receptacles, provided that "refuse" shall not include earth and wastes from building construction operations, nor shall it include solid wastes resulting from industrial processing and manufacturing operations such as food processing wastes, boiler house cinders, lumber, scraps and shavings.

B. 
All other words used in this chapter shall connote their ordinary or generally accepted meaning.

It shall be unlawful to place, dispose, discard or permit to remain anywhere in the Village any garbage, excepting in a tightly covered and wholly enclosed metal container.
It shall be unlawful to cause or permit to accumulate any dust, ashes or trash of such a nature that it can be blown away by the wind anywhere in the Village excepting in a covered, wholly enclosed container.
A. 
It shall be unlawful to place, dispose, deposit or discard, collect or dump any garbage, refuse or ashes anywhere in the Village excepting in a container for the collection and removal thereof from the Village within a reasonable time. Containers must be placed in the immediate vicinity of the residence. Containers may not be placed at the curbside, at the end of a residence driveway closest to the street, or other similar area. These restrictions shall not apply to leaves or brush to be picked up by the Village on scheduled occasions.

B. 
It shall be unlawful to collect, dump, deposit, dispose of, throw into or abandon any garbage, refuse, ashes or any solid material whatsoever, not to be used or used for the lawful construction, improvement or repair of docks, piers, seawalls, boat slips or other construction, within the Village, upon the shores or below the high-water mark or within or upon the waters of Skaneateles Lake, its outlet, or Skaneateles Creek, or any tributaries thereof.
C. 
It shall be unlawful to deposit or dispose of any liquids or waste matter intermixed, contained or dissolved in any liquids, in the Village, within the waters of Skaneateles Lake, its outlet, Skaneateles Creek or any tributaries thereof, or the areas adjoining any of them as defined in Subsection B of this section, tending to contaminate or pollute or increase the contamination or pollution of the waters thereof, including but not limited to sewage, industrial, chemical or petroleum wastes.
It shall be unlawful to place, discard, deposit or permit to remain any garbage in any containers maintained or placed upon the streets, sidewalks, parking areas or parks within the Village for the deposit or disposal of rubbish or litter.

A. 
From conveyances. It shall be unlawful to deposit or to abandon any garbage, refuse or ashes from any vehicle, or any other conveyance, onto any sidewalks or streets or other public places in the Village.
B. 
Duty of operator of vehicle. It shall be the lawful duty of the operator of any vehicle from which any garbage, refuse or ashes have been deposited, fallen, or escaped to immediately remove from the Village any such matter, and any omission in the performance of this duty shall constitute a violation of this chapter.
C. 
By pedestrians. It shall be unlawful for any pedestrian to deposit or abandon any garbage, refuse or ashes onto the sidewalks, streets, parks or other public places in the Village.
Refuse which is flammable shall not be mixed or mingled with refuse which is nonflammable.
It shall be unlawful to dump or place any garbage, refuse or ashes on any premises in the Village without the consent of the owner of such premises. However, any such owner who shall consent to the disposal thereof upon his premises in any manner prohibited by this chapter shall be deemed to have participated in the violation of this chapter and will be immediately subject to the penalties as hereinafter set forth.
A. 
The commission of or omission to perform any act, or any condition prohibited or declared to be unlawful in this chapter, shall constitute a violation thereof and a separate offense, and any person participating in or committing such offense shall be fined not less than $100 nor more than $250 for each offense committed.[1]

B. 
Obedience to this chapter may be enforced by the Village of Skaneateles by injunction.
C. 
A separate offense shall be deemed committed on each day during or on which a violation of this chapter occurs and continues.
D. 
The fact that garbage, refuse or ashes remain on any occupant's premises in the Village in violation of this chapter shall be prima facie evidence that the occupant of such premises is responsible for the violation of the chapter occurring.
