Each and every individual, establishment, partnership, corporation, entity or concern owning, utilizing or having available any burglar, fire or other alarm system connected directly, indirectly or which communicates to the Police or Fire Departments of the Borough of Churchill, or each individual, establishment, partnership, corporation, entity or concern owning, utilizing or having an alarm system which rings or sounds on the outside of the premises to which it is attached (or any combination of any system or systems) causing more than three false alarms to occur during any 12 month period, as calculated from the date of the first such false alarm, shall be levied a penalty charge or charges as follows:

Each alarm system with an outside alarm shall have an automatic shut-off device to limit each alarm signal to no more than 15 minutes in duration. Failure to install or maintain a shut-off device shall be considered to be a violation of this chapter and subject to the penalties under § 128-4 of this chapter. Further, excessive false alarms by such an outside signaling device also shall be subject to the penalties described in § 128-1 of this chapter.
Anyone who intentionally causes a false alarm shall be subject to a penalty as provided for in § 128-4 of this chapter.
Any individual, establishment, partnership, corporation, entity or concern violating § 128-2 or § 128-3 of this chapter shall result in prosecution of the violation by the borough and a fine imposed of not more than $1,000, plus costs, and in default of payment of such fine and costs, to imprisonment not to exceed 30 days.
