This chapter shall be known and may be cited
as the "East Whiteland Park Ordinance."

Wherever in this chapter the term "park" is
used, it shall be deemed to mean and include all parks, playgrounds
and recreational areas owned by East Whiteland Township.
A.
The following rules and regulations shall pertain
to all parks belonging to the Township of East Whiteland.
(1)
No person shall enter or leave a park except by the
entrances provided for that purpose.
(2)
No person shall enter a toilet set apart for the use
of the opposite sex.
(3)
No intoxicating beverages shall be allowed within
a park.
(4)
No intoxicated person shall be permitted in a park.
(5)
No gambling or any obscene or indecent act shall be
allowed in a park.
(6)
No abusive, indecent or threatening language or any
conduct that may annoy others shall be allowed in a park.
(7)
No person shall solicit alms or subscriptions in a
park except by special permit.

(8)
No animals shall be allowed in a park except by special permit. If it determines that it is appropriate to do so, the Board of Supervisors may designate certain sections of park property as exercise and walking areas for dogs, subject to the condition that the owner or person then in charge of the dog must comply with the provisions of Chapter 54, Animals, Article I, Dog Control, of the Code of the Township of East Whiteland.

No person shall sell or expose for sale any tickets
of any kind in a park.
(10)
No person shall sell or expose for sale any articles
in a park except by special permit.

(11)
No person shall discharge any fireworks in a park or upon other Township-owned
property unless expressly authorized by the Board of Supervisors.

(12)
No person shall park an automobile or other vehicle
in a roadway or section of ground except in spaces specifically allocated
for parking purposes.
(13)
No person shall in any way damage or foul any building,
equipment or water in a park.
(14)
No unauthorized person shall carry firearms in a park.
(15)
No person shall throw stones or other missiles in
a park.
(16)
No person shall throw any dead animals or offensive
matter or substance of any kind within the boundaries of a park.
(17)
No person shall scatter, drop or leave in any portion
of a park, except in a receptacle provided for that purpose, any piece
of paper, rag, garbage, dead flowers, glass, tin containers or other
rubbish.
(18)
No person shall injure, deface or destroy any notices,
rules or regulations for the government of a park posted within the
limits of the same.
(19)
No placard, advertisement, public notice or personal
card except park notices, rules and regulations shall be distributed,
posted or affixed in any manner in a park unless authorized by the
Township Park and Recreation Board.
(20)
No person shall annoy, strike, injure or kill any
animals or birds in a park.
(21)
No person shall swim or bathe in any feature of a
park that holds water, including but not limited to a stream, pond,
or detention basin.

(22)
No person shall remove, disturb, interfere with or
take any of the blossoms or fruit growing upon any tree, shrub or
bush in a park.
(23)
No person shall climb any tree or break, cut down,
remove, injure or deface an ornament, tree, plant, shrub, fern, flower,
flower bed, turf, buildings, fences, bridges, equipment or other construction
in a park; nor shall any person write on any building, structure,
fence rock or stone in a park or pick or carry away any fern or flower.

No person shall light or permit a fire to burn in
a park except in a fireplace or other equipment provided for such
purpose. Any such fire must be completely extinguished before leaving.
Anyone who discovers a fire is requested to report it promptly.
(25)
Speed in a park is restricted to 10 miles per hour.
(26)
No person, without a special permit, shall be allowed
in a park except between the hours of 7:00 a.m. and 10:00 p.m.
(27)
Overnight camping may be permitted in a park, provided
that a permit is secured. Campers under 21 years of age must be accompanied
by a chaperon.
(28)
No groups or parties in excess of 25 persons shall
occupy a park unless a permit has been secured for such occupancy.
(29)
Any person or group who does not live or work in the
Township must apply for a permit and pay a fee to use a park. Said
fee shall be fixed by resolution of the Board of Supervisors.
(30)
Nonprofit organizations exempt from federal taxation
under Section 501(c)3 of the Internal Revenue Code or comparable section
may conduct fund-raising activities in Township parks with a special
permit.

(31)
All league or organized play on Township athletic
fields or utilizing Township athletic facilities shall require a special
permit, and the fee to be paid shall be fixed by resolution of the
Board of Supervisors.

(32)
No loud noise from radios, boom boxes, sound equipment
or similar devices shall be permitted in a park. Sound amplification
equipment shall be permitted in a park only by special permit.

(33)
No driving, hitting or putting of golf balls shall
be permitted in a park unless a specified area is approved by the
Board of Supervisors. Such area must be so located that there will
be no danger of injury to a person or damage to property by the golf
activity.

A.
Permits required for the use of a park shall be issued
by the Township Park and Recreation Board or its authorized agent.
However, no permit shall be issued unless an application therefor
is made in writing at least 24 hours before the time the applicant
desires to occupy the park.

B.
Special permits.

(1)
Special permits provided for in this chapter may be
issued by the Township Manager or the Township Secretary, upon application
being made, subject to:
(a)
Completion of the application form prescribed
by the Township;
(b)
Demonstration that the permit will benefit a
charity, fraternal organization, or similar organized group; and
(c)
Compliance with such regulations as the Supervisors
shall, from time to time establish, upon recommendation of the Park
and Recreation Board.
(2)
Special permits shall be acted upon within three business
days after the date of submission of a completed application.
The Police Department shall enforce the rules
and regulations hereinabove set forth and shall exercise general supervision
over persons and property in all parks.

A.
The Township Park and Recreation Board shall have
general custody of all parks and all maintenance, repairs and replacement
of property and equipment therein, and shall be chargeable with the
duty of keeping the parks in a clean and sanitary condition at all
times.
B.
The Township's Park and Recreation Board shall have
the authority to establish such additional rules and regulations,
from time to time, as approved by the Supervisors, necessary in its
opinion for the proper governance of the parks. Such regulations shall
become effective when approved by resolution duly adopted by the Supervisors,
without the necessity of inclusion in this chapter.

Any person who violates any provision of this
chapter shall, upon conviction thereof in a summary proceeding brought
before a District Justice under the Pennsylvania Rules of Criminal
Procedure, be guilty of a summary offense, and shall be subject to
the payment of a fine of not less than $100 and not more than $1,000,
plus the costs of prosecution. In default of payment thereof, the
defendant may be sentenced to imprisonment in the county prison for
a term of not more than 30 days. Each provision of this chapter that
is violated shall constitute a separate offense, each of which violations
shall be punishable by a separate fine imposed by the District Justice
of not less than $100 and not more than $1,000, plus the costs of
prosecution, or upon default of payment thereof, the defendant may
be sentenced to imprisonment in the county prison for a term of not
more than 30 days. All fines and penalties collected for the violation
of this chapter shall be paid to the Township Treasurer.
