No water shall be provided for internal or external use to any residential, commercial, industrial, recreational, governmental, public or building or structure of any kind which is constructed, altered, extended or remodeled and in which plumbing, water piping or water fixtures are to be installed, extended, remodeled or altered in any way, and for which construction a permit is required to be obtained from East Whiteland Township (or would be required but for an exemption from a permit requirement for public or governmental agencies) unless the new, remodeled, extended or altered plumbing, water piping and other water-using fixtures therein conform to the requirements and standards of § 198-2 of this article. The provisions of this article shall apply to any such building or structure for which a building permit is required to be issued, or is issued, or would otherwise be required to be issued but for such an exemption from a permit requirement for public or governmental agencies, on and after the date on which this article shall effect.
A.
Water closets and associated flushing mechanisms. The
water consumption of water closets shall not exceed an average of 1.6 gallons
per flush cycle over a range of test pressures from 20 to 80 psi. The fixture
shall perform in accordance with the test requirements of the American National
Standards Institute (ANSI), standard reference numbers A112.18.1M and ANSI
A112.19.6M.

Urinals and associated flushing mechanisms. Urinal water
consumption shall not exceed an average of 1.5 gallons per flush cycle over
a range of test pressures from 20 to 80 psi. The fixtures shall perform in
accordance with the test requirements of the American National Standards Institute
(ANSI), standard reference numbers A112.19.2M and ANSI A112.19.6M.

Showerheads. Showerhead discharge rates shall not exceed
3.0 gallons of water per minute over a range of test pressures from 20 to
80 psi. The fixture shall perform in accordance with the test requirements
of the American National Standards Institute (ANSI), standard reference number
A112.18.1M.

Faucets. Sinks and lavatory faucet discharge rates shall
not exceed 3.0 gallons of water per minute over a range of test pressures
from 20 to 80 psi. The fixture shall perform in accordance with the test requirements
of the American National Standards Institute (ANSI), standard reference number
A112.18.1M.
A.
Special purpose equipment. The performance standards of § 198-2 shall not apply to fixtures and fittings such as emergency showers, aspirator faucets and blowout fixtures that, in order to perform a specialized function, cannot meet the specified standards.

Exemptions. Any person(s) may apply to East Whiteland
Township for an exemption to the terms of this article, which may be granted
by the Board of Supervisors upon clear and convincing proof by such person
that some other device, system or procedure of similar design is available
for installation and is capable of conserving as much or more water as those
devices mandated herein, or that the requirements mandated herein cannot be
met without unnecessary hardship other than financial hardship.
C.
Modification. The Board of Supervisors may by ordinance
modify the standards and restrictions herein required as they shall be necessary
to further the purposes of this article.
There are hereby adopted by reference the following codes as promulgated
and published by the American National Standards Institute: ANSI, standard
reference numbers A112.2M, A112.18.1M, A112.19.2M and A112.19.6M, latest edition,
as the same may be from time to time revised and amended, not less than three
copies of which are filed with the Secretary of this Township and are available
for public use, inspection and examination.
Any person who shall violate the provisions of this article and of the
ANSI standards herewith adopted, or who shall fail to comply with any of the
requirements thereof, or who shall install any plumbing work in violation
of these requirements or in violation of an approved plan or directive of
the East Whiteland Codes Enforcement Officer, or of a permit of certificate
issued under the provisions of this article shall be guilty of a summary offense,
and shall be liable, on conviction thereof, to a fine not exceeding $1,000,
together with the costs of prosecution, for each and every offense, or on
default of payment of the fine or penalty imposed and the costs, to imprisonment
in the county prison for a term not exceeding 30 days.
