There is hereby adopted by Latrobe for the purpose
of establishing minimum standards for the construction, installation,
alteration, removing, equipment, material and use of buildings, structures
and premises that certain electrical code known as the "National Electrical
Code," 1993 Edition, its amendments and supplements thereto, recommended
by the National Fire Protection Association, and the same is hereby
adopted and incorporated herein by reference as fully as if set out
in length herein, and the provisions thereof shall be controlling
in all of the buildings, structures and premises within Latrobe from
the date on which this chapter shall take effect.
There is hereby adopted within this chapter all of the provisions and sections of Chapter 98, Administration and Enforcement, regulating the administration and enforcement of the Housing (Chapter 132), Building (Chapter 108), Plumbing (Chapter 147), Electrical (this Chapter) and Fire Prevention (Chapter 279) Codes for Latrobe.
Where used in the National Electrical Code,
1993 Edition, the following terms shall have the following meanings:
The Solicitor for Latrobe.
Latrobe.
The Council of Latrobe shall enter into an agreement
with the Electrical Inspection Bureau licensed to perform such services
in the Commonwealth of Pennsylvania. This agreement shall be established
by resolution of the Council and shall provide for a system of fees
to cover the costs of all inspections, which inspections are to be
paid by the owner or operator of the building, structure or premises.
The agreement shall also provide for the keeping of accurate records
of all inspections by the appointed Inspection Bureau and shall provide
that all inspection reports shall be submitted to the Office of Code
Enforcement.
All persons required to obtain a permit under
the BOCA National Building Code shall also be required to obtain an
electrical certificate of approval. All applicants for such certificate
shall be so registered with the Office of Code Enforcement. The certificate
shall be completed only by certification by an authorized representative
of the appointed Inspection Bureau, which certification shall state
that inspection has been made of the applicant's building, structure
or premises and that the electrical wiring conforms to the applicable
provisions of the National Electrical Code. The completed certificate
shall be returned to the Office of Code Enforcement by the applicant
within 30 days from the date of completion of the building, structure
or premises.
Whenever the authorized Inspection Bureau shall disapprove an application for a certificate of approval or refuses to certify that the provisions of the National Electrical Code have been complied with, it shall inform the Office of Code Enforcement, and the Code Enforcement Officer shall notify the owner or operator as defined by Chapter 98, Administration and Enforcement, by the notice required thereunder. In addition to the requirements of the provisions of said notice, such notice may also contain the statement that unless the violation is corrected and evidence presented by a completed certificate of approval within 60 days from service, the Code Enforcement Officer shall notify the electrical utility company to disconnect the electrical power from the building, structure or premises until a proper certificate of approval is submitted to the Office of Code Enforcement.
In any case where any provision of this chapter is found to be in conflict with any provision of Chapter 166, Zoning, the Plumbing (Chapter 147), Building (Chapter 108), Housing (Chapter 132) or Fire Prevention (Chapter 279) Codes of Latrobe in force on the date of this chapter, the provision which establishes the highest standard for the promotion and protection of the health and safety of the people shall prevail.
This chapter shall be known hereafter as the
"Latrobe Electrical Code."
