As used in this chapter, the following terms shall have the meanings indicated:
BICYCLE
Includes every device propelled by human power upon which any person might ride, having two tandem wheels, either one or both of which is of a diameter of 20 inches or more.
ELECTRIC PERSONAL ASSISTIVE MOBILITY DEVICES (EPAMDs)
Self-balancing, two-nontandem-wheeled device designed to transport only on person with an electric propulsion system.

ELECTRIC VEHICLE
A motor vehicle which operates solely by use of a battery or battery pack and which meets the applicable federal motor vehicle safety standards. The term includes a motor vehicle which is powered mainly through the use of an electric battery or battery pack but which uses a flywheel that stores energy produced by the electric motor or through regenerative braking to assist in operation of the motor vehicle.

LICENSE
A metallic plate having numbers stamped thereon in numerical order and indicating the year for which the same are issued.
MOTOR-DRIVEN CYCLE
A motorcycle, including a motor scooter, with a motor which produces not to exceed five break horsepower.

MOTORIZED PEDALCYCLE
A motor-driven cycle equipped with operable pedals, a motor rated no more than 1.5 brake horsepower, a cylinder capacity not exceeding 50 cubic centimeters, an automatic transmission, and a maximum design speed of no more than 25 miles per hour or an electric motor-driven cycle equipped with operable pedals and an automatic transmission powered by an electric battery or battery pack-powered electric motor with a maximum design speed of no more than 25 miles per hour.

PERSON
Includes any individual person, firm, association or corporation.
SKATEBOARD
A single platform which is mounted on wheels, having no mechanism or other device with which to steer or control the direction of movement thereof while being used, operated or ridden.

WHEELED DEVICE
Any device not listed previously, propelled by human power and having wheels upon which any person may ride. Wheelchairs and baby strollers are excepted from the provisions of this chapter.

All persons operating bicycles, skateboards and other wheeled devices upon any public street, alley or highway within Latrobe shall be subject to the provisions of the traffic regulations of Latrobe as the same are applicable to the operator of any motor vehicle, except as otherwise herein provided, and all such persons operating bicycles, skateboards and other wheeled devices within Latrobe shall obey instructions of official traffic signals, signs and other traffic control devices, unless otherwise provided herein, and shall be subject to the following regulations:
A. 
It shall be unlawful for any person to ride a skateboard, in-line skates, electric scooter, EPAMD, scooter, hoverboard upon any street, alley or public roadway within Latrobe (wheeled device shall not include bicycles) or upon any sidewalk in Latrobe inside the area bounded by the westerly curbline of Alexandria Street on the east, Jefferson Street on the west, the railroad tracks on the north and the northerly curbline of Walnut Street on the south. It shall also be unlawful for any person to ride a skateboard, in-line skates, electric scooter, EPAMD, scooter, hoverboard, or bicycles in, through, over or upon any parking garage operated by the City of Latrobe and/or the Latrobe Area Hospital. Further, it shall be unlawful for any person to ride a skateboard, in-line skates, electric scooter, EPAMD, scooter, hoverboard in, over, through or upon any other parking lot included in the off-street parking system operated by the City of Latrobe and/or operated by the Latrobe Area Hospital; provided, however, that this prohibition shall not apply to sidewalk and street crossings on the easterly side of Jefferson Street, from the railroad tracks to and including Walnut Street, where the use of skateboards or other wheeled devices shall be permitted.

B. 
All persons operating a bicycle shall ride only upon the regular seat provided thereon and shall not permit any other person to ride said bicycle at the same time, except upon a regular seat provided in tandem.
C. 
No bicycle shall be used to carry more persons at one time than the number for which it is designed and equipped.
D. 
No person shall operate a bicycle at any time unless both hands are upon the handlebars.
E. 
No person operating a bicycle shall carry any package, bundle or other article which in any way prevents the operator from keeping both hands upon the handlebars.
F. 
All persons operating bicycles, skateboards or other wheeled devices upon any public street, alley or highway within Latrobe shall operate said bicycle as close to the right-hand side of said street, alley or highway as practicable under the circumstances, exercising due care when passing standing vehicles or passing one proceeding in the same direction.
G. 
All operators of bicycles, skateboards or other wheeled devices, when emerging from an alley, driveway or hidden entrance, shall, upon approaching a sidewalk or crosswalk, yield the right-of-way to all pedestrian traffic and, upon entering the traveled portion of the street, alley or highway, shall yield the right-of-way to all vehicles approaching thereon.
H. 
All persons operating bicycles upon any public street, alley or highway within Latrobe shall not ride with more than two bicycles abreast at any one time, except in such areas or upon such portions of said highways, streets or alleys as may be set aside for the exclusive use and operation of bicycles.
I. 
Notwithstanding that which is set forth in Subsection A above, electric scooters, EPAMDs, skateboards and hoverboards shall be permitted on the sidewalks within the City of Latrobe.

Any person violating any of the provisions of this ordinance (Part 1) shall, upon conviction thereof, before the District Justice, be sentenced to pay a fine of not more than $600 and costs of prosecution, or, in default of payment of fine and costs, be subject to imprisonment for not more than 30 days. Further, the bicycle, skateboard or wheeled device of any violator may be impounded by the Latrobe Police Department, to be returned to the owner thereof upon payment of the penalty as set forth herein, or upon a finding of innocence by the District Justice. If the violator is a minor, the parent or guardian of said minor shall be notified that he or she is to pick up the bicycle, skateboard or other wheeled device so held by the Latrobe Police Department.

The provisions of Chapter 183, Bicycles and Skateboards, §§ 183-1 through 183-15, shall not apply to any bicycle or other wheeled device operated by a member of the Latrobe Police Department, or its designee, when said bicycle or other wheeled vehicle is being operated by said individual within his scope of authority while functioning as a police officer, or a designee of a police officer, during his or her course of employment with the City of Latrobe.
