It shall not be lawful for any person, either directly or indirectly, to conduct any business or sale, as defined in this chapter; or to operate or conduct a business as a transient merchant, itinerant vendor, peddler, canvasser, solicitor or handbill distributor, as defined in this chapter; or to operate or put to use any jukebox, vending machines or mechanical amusement device; or to use in connection with the foregoing any vehicle, premises, machine or device, in whole or in part, unless a license or a permit therefor is first procured and kept in effect at all such times as required by this chapter or any other law or ordinance of the Borough of Alpha.

A. 
Any person or persons desiring to canvass, solicit or call from house to house in the Borough of Alpha on behalf of any federal, state, county or municipal political campaign or on behalf of any nonprofit charitable, religious, educational, patriotic or philanthropic cause or organization created, incorporated or organized for such nonprofit charitable, religious, educational, patriotic or philanthropic purposes, as indicated by its certificate of incorporation, bylaws, charter or other document evidencing the creation and stated purpose of said cause or organization, shall not be required to obtain a permit pursuant to § 248-4 but rather shall be required to register with the Police Department, for informational purposes only, prior to said door-to-door canvassing or soliciting, by furnishing the following information in writing:
(1) 
Name(s) and address(es) of the person(s) or organization(s) sponsoring said canvassing or solicitation, together with a statement of the purpose thereof.
(2) 
Names and addresses of all persons who are to engage in said solicitation or canvassing within the Borough.
B. 
Said registration shall be valid for the duration of said solicitation or canvassing.
C. 
No such canvassing, solicitation or calling from house to house within the Borough by any cause or organization defined in Subsection A of this section shall be permitted unless the registration required by Subsection A shall be made to the Police Department at least 24 hours in advance of the proposed canvassing, solicitation or calling.

For the purposes of this chapter, any person shall be deemed to be engaging in business and subject to the provisions of this chapter when he does one act of:
A. 
Selling any goods or service;
B. 
Soliciting business or offering goods or services for sale or hire; or
C. 
Acquiring or using any vehicle, machine or device or any premises in the Borough of Alpha for business purposes.
The agents, servants, employees or other representatives of corporations, partnerships, resident or nonresident individual natural persons, joint adventures, societies, associations, clubs, trustees, trusts or unincorporated groups shall be personally responsible for the compliance with this chapter by their principals and by the businesses they represent.
For a going-out-of-business sale or a removal of business sale or a fire or other altered goods sale, no person shall be granted a license unless:
A. 
He has been the owner of a business as described in the application for a license hereunder for a period of at least six months prior to the date of the proposed sale.
B. 
He has not held a similar sale at the location stated in the application within one year last past from the date of such application.
C. 
It applies to only one business and is not conducted or advertised in cooperation or by participation with any other business.
D. 
He shall file with the Licensing Officer a complete inventory of goods that are to be offered for sale.
In cases covered by § 248-8 preceding, the license shall:
A. 
Authorize only one type of sale described in the application at the location named therein.
B. 
Authorize only the sale of goods described in the inventory filed with the Licensing Officer and shall forbid additions or replacements.
C. 
Continue for a period not exceeding three months from the date of granting of the license and shall not be renewable, assignable or transferable.
The provisions of §§ 248-8 and 248-9 preceding shall not apply to or affect:
A. 
Any person acting pursuant to an order or process of a court of competent jurisdiction; or
B. 
Persons acting in accordance with their powers and duties as public officials.

A. 
The practice of going in and upon private residences in the Borough of Alpha, in the County of Warren and State of New Jersey, by transient merchants, itinerant merchants, itinerant vendors, peddlers, canvassers, solicitors, salesmen or others of like occupation, not having been requested or invited to do so by the owner or owners, occupant or occupants of said private residences, for the purpose of soliciting orders for the sale of goods, wares and merchandise, magazines, services or the like or for the purpose of disposing of or peddling or hawking the same, is hereby declared to be a nuisance and is hereby specifically prohibited and punishable as hereinafter provided.
B. 
No solicitation, peddling or canvassing of any nature as considered in Chapter 248, Article III of the Code of the Borough of Alpha shall be permitted within 500 feet of any public school within the Borough between the hours of 8:00 a.m. and 4:00 p.m.
