The owner or owners, occupant or agent of every lot of land fronting on any street, highway or public place within the Borough of Alpha shall, within the first five hours of daylight after every fall of snow, remove or cause the same to be removed entirely from off that portion of the sidewalk which has been paved in front of such lot of land. Where no pavement has been laid, a pathway at least three feet wide shall be made by such owner or owners, occupant or agent in front of said lot of land for the convenience of pedestrians.

Whenever any sidewalk or any part thereof in front of any lot of land on any street or highway or public place within the Borough shall become covered or partly covered with ice, the owner, occupant or agent of the said premises shall cause such sidewalk to be made safe and convenient for pedestrians by removing the ice therefrom or by covering the same with sand or ashes within the first five hours of daylight after the formation of such ice.

In case such owner or owners, occupant or agent of any land fronting on any street, highway or public place within said Borough shall fail to remove such snow, or from the pathway as the case may be, and remove the ice or cover it with sand or ashes within the time hereinbefore required, it shall be lawful for the Director of the Department of Public Works or other officer having charge of the streets of the Borough to remove entirely such snow or ice from off the paved portion of the sidewalk in front of said lot or lots of land or, where a paved walk has not been laid, from a pathway in front thereof.

The cost and expense paid and incurred by the Department of Public Works or other officer for removing such snow or ice from any sidewalk and for forming a pathway where required shall be ascertained by the Borough Council and certified to the Assessor of the Borough, and such expenses shall be added to and form a part of the tax or taxes next to be levied and assessed upon the lot or lots of land in front of which such sidewalk is located, from which snow or ice has been removed or the pathway formed, to be collected according to law and shall be a lien upon said lands until paid; and this liability of the owner or owners of the said land shall be in addition to his or her liability to the fine imposed by § 327-6 of this chapter.

No person, firm or corporation shall throw, place or deposit any snow or ice onto or upon any street within the Borough. It is the intent of this provision to prohibit all persons from throwing, casting, placing or depositing snow and ice, which accumulates on private property, upon streets of the Borough of Alpha.

Any person, firm or corporation violating this chapter or any of its provisions shall, upon conviction thereof, be subject to a fine not exceeding $1,250, a term of imprisonment not exceeding 90 days or a period of community service not exceeding 90 days, or any combination thereof, for each violation; and for a continuing violation, each shall constitute a separate offense.
