A system of collection of dry garbage and refuse be and is hereby established within the corporate limits of the Borough of Alpha.
The collection of said garbage and refuse aforesaid may be done by the Borough or by a collector or contractor duly authorized by the Council of said Borough.

The time of collection of dry garbage and refuse is to be fixed by the Director of Health and Welfare or the Borough Council.

It shall be the duty of the collector herein provided for or as contracted pursuant to the applicable statute(s) to collect and gather from each dwelling and premises, including stores, factories, places of business and farms if so included in the contract between the collector or contractor and the Borough of Alpha, all garbage and refuse included in the terms of this article, when properly set forth in approved receptacles as provided for by the contract between the collector or contractor and the Borough of Alpha, and to transport the same to a proper place designated by the Borough Council of said Borough subject to the approval of the local Board of Health.

Each householder, tenant, owner, occupier, etc., of any land within the Borough is hereby required to provide a proper and fitting and sightly receptacle, approved by the Board of Health of said Borough, provided with a cover, in which to place said garbage and refuse; said container(s) and contents shall conform to the requirements, including number, capacity, and weight, as set forth in the contract between the collector or contractor and the Borough of Alpha.

The term "dry garbage" shall be construed to mean nonrecyclable material, contrary to references in §§ 334-17 and 334-18, and include tin cans, broken bottles, bones, bits of paper, refuse and the like, but not animal or vegetable matter or any material capable of decaying or having a tendency to putrefy or become rancid. Table cleanings, offal, manure or refuse from stables, barns or coops of any sort or description, floor sweepings, burlap, ashes, coal dirt, rakings from yards, gardens or fields and such shall not be accepted by the collector aforesaid.

It shall be the duty of each owner, householder, tenant, etc., to place his receptacle(s) properly collected, in the alley at the rear of his premises, or if there is none, then in any place accessible from the street, provided that the same is not a nuisance.

It shall be the duty of the Sanitary Inspector of said Borough to see that this article is enforced, to issue notices to persons violating any of its sections and to make a report in writing to the Board of Health or the Mayor of said Borough, with a view toward the prosecution of said violators.

The expense of the collection of said garbage shall be borne by the Council of the Borough of Alpha, who shall from year to year provide in its annual budget an appropriation sufficient to meet the expense of such collection.

The Council shall issue notice(s) soliciting bids for the collection of such garbage as mentioned in the preceding sections of this article, pursuant to the applicable state law. The successful bidder for such collections shall be compelled to furnish a lawful bond in an amount conforming to law for the faithful performance of such collections, and in case no bids are received, Council shall proceed to have such collections made by some suitable party to be paid from the appropriation as provided for in § 334-9 of this article, pursuant to the applicable laws of the State of New Jersey.

The Director of Health and Welfare shall supervise the collection of all garbage within the limits of the Borough of Alpha.

Any person violating or failing to comply with any of the provisions of this article shall, upon conviction thereof, be punishable by a fine not exceeding $1,250, a term of imprisonment not exceeding 90 days or a period of community service not exceeding 90 days, or any combination thereof, in the discretion of the Judge. The continuation of such violation for each successive day shall constitute a separate offense, and the person or persons allowing or permitting the continuation of the violation may be punished as provided above for each separate offense.
