This article shall be known as "Fees for Certain Permits and Licenses, Board of Health."
It is not intended by this article to repeal, abrogate, annul or in any way impair or interfere with existing provisions of other laws or ordinances, except those specifically repealed by this article. Where this article sets a fee different from existing provisions of law or ordinances or establishes a new fee, the provisions of this article shall apply.
Every person required to procure a license under the provisions of any ordinance or law of the Board of Health of the Borough of Chatham shall submit an application for such license to the Secretary of the Board of Health of the Borough of Chatham. The form of this application shall comply with the applicable laws and ordinances of the Board of Health. The application shall be accompanied by the full amount chargeable for such license. License fees shall be in amounts established under this article and may be revised and amended by resolution adopted by the Board of Health.
The Secretary of the Board of Health or the Borough Clerk of the Borough of Chatham shall collect all license fees, as set forth in this article, and shall issue licenses in the name of the Board of Health of the Borough of Chatham or the Borough of Chatham.
A. 
Clinic and program fees.
(1) 
Fees and charges for various programs and clinics shall be paid by participants at the time of registration.
(2) 
Fees for programs and clinics may be established by resolution, from time to time, by the Board of Health.
(3) 
The fees charged are nonrefundable, unless the clinic or program is cancelled by the Board of Health.
B. 
Certified copies. Fees for copies of documents shall be as follows:

For certified copies: $10.
Any person violating or failing to comply with any of the provisions of this article shall, upon conviction thereof, be punishable as provided in Chapter 274, § 274-12.

(1) 
Fees in accordance with the following schedule shall be paid before any license required in this article shall be issued, except that payment of a fee may be waived by the Board of Health at its discretion for any municipal facility, church, school or building which does not receive any remuneration for the dispensing of food or drink upon receipt of a written application for fee waiver from the person conducting, maintaining or operating such an establishment. The fees set forth below may be revised by resolution adopted by the Board of Health.

(2) 
Nonprofit organizations must obtain a license annually. The fee may be waived on application to the Board for a waiver of the licensing fee based on nonprofit status.
(3) 
The fees for reinspection of any retail food establishment set forth above are in recognition of the fact that repeated conditionally satisfactory, and unsatisfactory ratings represent a hazard to the public health and repeat inspections are costly. The repeat inspections and cost reimbursement fees shall not in any way preclude, preempt, interfere with or be a substitute for legal action in the courts or before the Board of Health to assure correction of the violations. Such fees are in addition to the annual license fee and shall not be considered penalties, but such fees shall be charged and shall be paid to offset the costs and expenses of such reinspection by the Board of Health. As set forth in § 278-13, Licensing; fees, the Board of Health or its designated agent shall retain the right to close, in its discretion, any establishment that has maintained a conditionally satisfactory posting for 30 or more consecutive days.
(4) 
The cost of laboratory tests required because of a complaint or suspected food illness or a retest required because of unsatisfactory results on the prior test shall be assessed to the retail food establishment or added onto the annual license fee. This is in recognition that the food establishment license fees established by this code are not adequate to cover additional costs incurred by the regulatory agency as a result of such tests.
(5) 
Licenses issued under the provisions of this article, unless sooner forfeited or revoked by this Board, shall expire annually on the 31st day of December of each year. A late fee of $50 per month shall be assessed for each month or portion thereof a license is renewed after January 31.
(6) 
New food establishments licensed on or after July 1 through December 31 shall pay 1/2 of the annual fee for a license to operate.
