The regulation of tanning booth establishments, also known as tanning facilities, as defined by N.J.S.A. 26:2D-82, is governed by N.J.A.C. 8:28-1 et seq. and the New Jersey Department of Health, incorporated herein by reference.
A. 
The Board of Health of the Borough of Chatham shall inspect all tanning facilities located in the Borough of Chatham at least annually to ensure compliance with the safety standards at N.J.S.A. 26:2D-83 and N.J.A.C. 8:28-1 et seq., utilizing the Tanning Facility Inspection Checklist form set forth at Appendix B of N.J.A.C. 8:28-1 et seq.
B. 
The Board of Health of the Borough of Chatham shall certify that the facility is in substantial compliance with the safety standards of N.J.S.A. 26:2D-83 and N.J.A.C. 8:28-1 et seq. and shall certify substantial compliance through the issuance of a satisfactory inspection report.
C. 
The Board of Health of the Borough of Chatham shall embargo any device, pursuant to N.J.S.A. 24:4-12, whenever there is probable cause to believe that a device is dangerous, adulterated or misbranded.
