A person is guilty of loitering when he:
A. 
Loiters, remains or wanders about in a public place for the purpose of tumultuous, violent or threatening conduct or when, being present at an assembly which either has become or becomes tumultuous, violent or threatening to members of the assembly or the public, he remains there with intent to advance that purpose; or
B. 
Loiters, remains or wanders about in a public place for the purpose of any activity which is intended to intimidate the public; or interferes with the free passage of another; or attempts to stop or interfere with motor vehicles on the public street, road or highway; or
C. 
Loiters, remains or wanders about in a public place for the purpose of the consumption of alcohol in a public place in violation of any local, state or federal law; or
D. 
Loiters, remains or wanders about in a public place for the purpose of begging; or
E. 
Loiters or remains in a public place for the purpose of gambling with cards, dice or other gambling paraphernalia; or
F. 
Loiters or remains in a public place with one or more persons for the purpose of unlawfully using or possessing a controlled substance, as defined in Penal Law § 220.00; or
G. 
Loiters or remains in any transportation facility, unless specifically authorized to do so, for the purpose of soliciting or engaging in any business, trade or commercial transactions involving the sale of merchandise or services or for the purpose of entertaining persons by singing, dancing or playing any musical instruments; or
H. 
Loiters or remains in a public place while consuming any alcoholic beverage; or
I. 
Loiters or remains in a public place while having in his possession an open or unsealed container of an alcoholic beverage for the purpose of consuming such alcohol by himself or by another in any public place.
