Recent advances in communications technology have enabled the County
of Westchester to implement an emergency service response system capable of
supplying emergency service dispatchers with the address of the person calling
for services, even if he or she is unable to talk or otherwise provide directions
to his or her location. The advantages of this new system would, however,
be nullified if the emergency service provider is unable to locate the caller
when responding to a distress call. It is, therefore, necessary for all property
owners to display their residence or business location by prominently posting
assigned numbers on all buildings or property within the Town, thereby enabling
emergency service providers to expedite locating those persons requesting
emergency services.
As used in this chapter, the following terms shall have the meanings
indicated:
Includes any structure used or inhabited by persons during the day
or night, regardless of whether occupancy is continuous or intermittent.
That side of the building which faces the street or primary route
of access.
It shall be the duty of every building owner in the Town to display
and maintain the assigned street number of his/her building or buildings in
accordance with the provisions of this chapter.
A.
The numeral or numerals comprising the number displayed
pursuant to this chapter shall be not less than five inches in height. All
numbers shall be placed on the front of every building in a prominent and
conspicuous place and in such a manner as to be plainly visible at all times
between sunrise and sunset from the street, roadway or primary route of access
to the premises. All numbers displayed pursuant to this chapter shall be in
marked contrast to the color of their background and shall be readily distinctive
and legible.
B.
Additional requirements for obscured premises.
(1)
Owners of building(s) more than 50 feet from the edge
of the road, street or right-of-way providing primary access to the lot shall,
in addition to posting and displaying the assigned numbers on the building,
post and display the assigned number on a post, pole, mailbox, lamppost, sign
or other similar structure readily visible from the road or street not less
than 15 feet from the curbline or access boundary.
(2)
Owners of building(s) obscured by trees, shrubbery or
any other impediment to the clear and unobstructed view from the road, street
or right-of-way providing primary access to the lot shall, in addition to
posting and displaying the assigned numbers on the building, post and display
the assigned number on a post, pole, mailbox, lamppost, sign or other similar
structure readily visible from the road or street not less than 15 feet from
the curbline or access boundary.
C.
Numbers displayed pursuant to this chapter shall be placed
so that they will not be obscured by trees, shrubbery or any other obstructions.
D.
Where practicable, numbers displayed shall be placed
near a light source so that the designated number may be readily seen at night.
Each separate building shall be assigned a unique number by the Town.
A list of all assigned numbers shall be kept for informational purposes by
the Town Engineer. The display of any number other than that assigned by the
Town is prohibited.
A.
The Building Inspector is hereby authorized to determine
which building or buildings on a particular lot must be numbered, the adequacy
of the display and compliance with the provisions of this chapter.
B.
Any person, corporation, partnership or other entity
owning a building within the Town of Greenburgh which has failed or refused
to display the designated number in the manner required by this chapter shall
be deemed to be in violation of this chapter.
C.
Failure of any owner to comply with a notice of violation
issued by the Building Inspector for violation of this chapter within 30 days
after receipt of such notice from the Building Inspector shall be deemed to
be a violation punishable, upon conviction, by a fine of not less than $25
and not more than $250 or by imprisonment for a term not to exceed 15 days,
or both. Notice of violation may be given by either personal service on the
owner or by mailing a copy thereof to the owner's last known address. Every
day the violation continues shall be considered a separate violation.
