This chapter has been adopted to permit and foster the orderly operation and use of the parks and recreation facilities of the Town and to clarify the functions and responsibilities of all departments and officials dealing therewith.
As used in this chapter, the following terms shall have the meanings indicated:
PARK
All parks, playgrounds, athletic fields, court areas, swimming pools, nature preserves and other recreational facilities, lands under water, roads and entrances and approaches to parks or parts thereof.
A. 
There is hereby created a Department of Parks and Recreation.
(1) 
The principal executive officer and administrative head of the Department shall be the Commissioner, who shall be appointed by the Town Board pursuant to and in accordance with § 53-c of the Town Law. The Commissioner shall be appointed on the basis of his administrative experience and qualifications for the duties of such office and such additional standards as may be required by the Town Board. The Commissioner shall have the power and authority to appoint and remove employees under his jurisdiction in accordance with the civil service laws and such other powers as shall be necessary for the proper administration of the Department.
(2) 
There shall be a Deputy Commissioner, who shall have such powers and duties as are prescribed by the Commissioner and who shall generally act for and in place of the Commissioner.
B. 
The Department shall be divided into the following divisions under the control and direction of the Commissioner:
(1) 
The Division of Parks and Facilities, which shall maintain the parks and other facilities in the Town.
(2) 
The Division of Recreation/Coordination Services, which shall develop and implement Town-wide programs in specialized interest areas, such as cultural, therapeutic, senior citizens, youth and athletics, shall schedule, organize and promote programs and shall include the seeking of appropriate funding, all pursuant to any applicable laws and ordinances.
(3) 
The Division of Nutrition, which shall provide for senior citizens home-delivered meals and hot lunches at designated nutrition sites throughout the Town.
C. 
Nothing herein contained shall be construed to delegate or transfer any power of the Town Supervisor contained in §§ 29, 52 and 125 of the Town Law or any other powers which may be lawfully exercised by the Supervisor.
D. 
The Commissioner is hereby authorized to promulgate such rules and regulations relative to the use of any or all parks and recreational facilities as he may deem necessary and proper, subject to the approval of the Town Board.
E. 
Users of the Town parks and recreational facilities shall abide by the provisions of this and all rules and regulations duly promulgated by the Commissioner and shall obey all orders and directions of the park officials in charge.
A. 
Any violation of the rules and regulations promulgated pursuant to this chapter shall, upon conviction, be punished by a fine of not more than $250 and/or imprisonment not to exceed 30 days. Each day the violation continues shall constitute a separate offense.
B. 
A second and subsequent violation of or the same offense shall be a misdemeanor and punishable by a fine of not more than $500 and/or imprisonment not to exceed three months. Each day the violation continues shall constitute a separate offense.
