[HISTORY: Adopted by the Board of Trustees of the Village of Penn Yan 5-4-1987 as L.L. No. 4-1987 (Ch. 45 of the 1969 Code). Amendments noted where applicable.]
A. 
Pursuant to the authority of § 3-308 of the Village Law, there is hereby established a Penn Yan Municipal Utilities Board ("the Board"), which shall have the responsibilities of a board of light, sewer and water commissioners under the Village Law.
B. 
The Board shall be composed of not fewer than three nor more than five members, who shall perform their duties subject to the approval of the Board of Trustees of the Village.

C. 
The members of the Board shall be appointed in the manner provided in the Village Law. After the first appointments thereto, a full term of a member of the Board shall be three years.
D. 
The Board of Trustees of the Village shall designate a member of the Board to act as Chairman thereof; on its failure to do so, the Board shall elect a Chairman from among its own members.
The Baord of Trustees of the Village shall, by resolution, establish the Board's powers, duties and responsibilities. Except to the extent that the Board of Trustees of the Village shall, by resolution, determine otherwise, the power and authority to adopt rules and regulations with respect to procedure before the Board and with respect to any matter within the Board's jurisdiction; to employ experts, clerks, a secretary and such other employees as may be necessary and proper to carry out the responsibilities of the Board; to set the salaries of the Board and its employees and to approve payment of such of its expenses as may be necessary and proper; and to audit and pay claims asserted against the Board in its capacity as a board of light, sewer and water commissioners shall lie with the Board of Trustees of the Village.
