A.
Fire lanes shall be established and devoted to public
use where the parking and standing of motor vehicles or other obstructions
may interfere with the ingress of fire department or other emergency
vehicles for the protection of life and property, such as shopping
centers, bowling lanes, theaters, hospitals, churches, nursing homes,
schools and other places of public assembly.
B.
Fire lanes shall be 15 feet wide. Fire lanes shall
be marked with standard signs and/or such other markings and signs
which conform to accepted sign standards as set forth in the New York
State Manual of Uniform Traffic Control Devices and which are deemed
necessary by the Fire Prevention Bureau of the Town of Yorktown. Such
signs and markings shall be installed by and at the expense of the
owner of the property within 120 calendar days after receipt of official
notice by the Fire Prevention Bureau designating and depicting areas
and locations of such signs and markings. In the event that any owner
refuses or fails to install any and all required signs and markings
within 120 calendar days of receiving said official notice, the Town
of Yorktown may perform the required work, and the Town Board of the
Town of Yorktown may provide for the assessment of all costs and expenses
so incurred by the Town, in connection with any such action, to become
a lien against the land on which such signs and markings are located.

C.
Subsequent to the installation of such signs and markings,
as aforesaid, the owner of the property shall be responsible for the
continued maintenance of the same. Such maintenance shall include,
but not be limited to: replacement of missing signs; repainting of
pavement or curb markings, as ordered by the Fire Prevention Bureau;
and correction or replacement of vandalized signs. Such maintenance
shall be effected as needed or within 20 calendar days after receipt
of official notice from the Fire Prevention Bureau that such maintenance
or replacement is necessary. In the event of a failure or refusal
to comply with such official notice within said 20 calendar days of
receipt, the Town of Yorktown may perform the required work, and the
Town Board of the Town of Yorktown may provide for the assessment
of all costs and expenses so incurred by the Town, in connection with
any such action, to become a lien against the land on which such signs
and markings are located.

The parking, placing, stopping or standing of any motor vehicle or any other object or material within any area designated as a fire lane shall be a violation of this Part 3. It shall be the duty of the Police Department of the Town of Yorktown and the Town's duly appointed Fire Marshals to inspect and enforce fire lanes and to see that the lanes are maintained free from obstruction. In addition to the penalties set forth in § 275-18, the Police Department shall have the authority to have any motor vehicle, object or material in violation of this law towed or otherwise removed at the owner's expense.
