A certain document, three (3) copies of which are on file in the offices of the Borough of South Waverly, being marked and designated as the "BOCA National Mechanical Code/1990, Seventh Edition," as amended, as published by the Building Officials and Code Administrators International, Inc., shall be and is hereby adopted as the Mechanical Code of the Borough of South Waverly in the Commonwealth of Pennsylvania; for the control of buildings and structures as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said BOCA National Mechanical Code are hereby referred to, adopted and made a part of hereof as if fully set out in this chapter, with the additions, insertions, deletions and changes, if any, prescribed in § 83-2 of this chapter.
Certain sections of the BOCA National Mechanical Code are hereby revised as follows:
In Section M-100.1, Title, insert "the Borough of South Waverly" in the space provided.
Section M-114.2, Periodic inspections, shall be amended to read as follows:
M-114.2 Periodic inspections: The fees for all periodic inspections shall be as set forth from time to time by resolution of the Borough Council.
Section M-114.3, Fee schedule, shall be amended to read as follows:
M-114.3 Fee schedule: The fees for all mechanical work shall be as set forth from time to time by resolution of the Borough Council.
Section M-117.4 shall be amended to read as follows:
M-117.4 Violations and penalties: Any person who shall violate a provision of this code or shall fail to comply with any of the requirements thereof or who shall erect, construct, alter or repair mechanical equipment or systems in violation of an approved plan or directive of the code official, or of a permit or certificate issued under the provisions of this code, shall, upon conviction thereof, be punishable by a fine of not more than one thousand dollars ($1,000.) and costs of prosecution and, in default of payment of such fine and costs, by imprisonment in the county jail for not more than thirty (30) days. Each day that a violation continues shall be deemed a separate offense.
Section M-118.2, Unlawful continuance, shall be amended to read as follows:
M-118.2 Unlawful continuance: Any person who shall continue any work in or about the structure after having been served with a stop-work order, except such work as that person is directed to perform to remove a violation or unsafe condition, shall be liable to a fine as specified in Section M-117.4.
