The operation of the sewage collection system shall be conducted by the Borough of Clementon, Public Works Department, Division of Sewer.
Any person or persons, firm or firms, corporation or corporations utilizing the sewage collection system shall be subject to the rules and regulations hereinafter adopted from time to time.
A. 
The owner of every house, building and structure now erected and the owner of every house, building and structure hereinafter erected or acquired, which may be occupied or used by human beings and is located on a street, road, avenue or other public thoroughfare along the line of any sanitary sewer, now constructed or hereafter constructed in the Borough of Clementon, or to which sanitary sewer service is available, shall install a toilet or toilets in such house, building or structure (unless a toilet or toilets are already installed therein) and connect and hook up said sewerage facilities emanating from such house, building or structure to the sewage collection system of the Borough of Clementon
B. 
Every owner shall connect the house or buildings on said property to the municipal sewer system within 60 days of notice from the Borough. The notice shall be served upon the owner of said property personally or by mailing it to the address listed in the tax records of the Borough.
If any such house, building or structure referred to in the preceding section shall be used for industrial or commercial purposes, the owner thereof shall, if the services of such sanitary sewer are available to such house, building or structure, or prior to occupancy or use of such house, building or structure, whichever date shall be later, install such facilities as are necessary to treat and convert the industrial or commercial wastes emanating therefrom into a form that can be transported without hazard, public nuisance or ill effect to the Borough's sewage collection system, employees or the public, and connect such facilities with said sewage collection system, all pursuant to rules and regulations of the Camden County Municipal Utilities Authority (CCMUA) and in accordance with the standards established by this Part 1 and the laws, rules and regulations of the CCMUA, the New Jersey Department of Environmental Protection (NJDEP), and the United States Environmental Protection Agency (USEPA) for industrial or commercial waste disposal and any other governmental entities having jurisdiction thereof.
If the owner of any house, building or structure referred to in this Part 1 shall fail to make any installation or connection required herein within the time required, the Borough may proceed to make such installation or connection and assess the cost thereof as a lien against said house, building or structure in accordance with the relevant New Jersey statutes.
A. 
Every person, firm, corporation or other entity, prior to making any connection with the sanitary sewer system of the Borough of Clementon, shall make application to the Borough of Clementon and obtain a permit therefor.
B. 
The fee for connection to the sanitary sewer system shall be $1,500 for each equivalent domestic unit (EDU), or fraction thereof, or a sum as amended from time to time by the governing body of the Borough of Clementon. Said fee shall be paid in advance and in full to the Borough of Clementon at the time application is made and before any permit shall be issued. In addition to the connection fee, the applicant shall pay an inspection fee of $50 for each single-family dwelling and additional equivalent to ensure that the connection meets the requirements of the Borough of Clementon, Public Works Department, Division of Sewer. The actual cost of opening and repairing municipal, county or state roads shall be the sole responsibility of the applicant. [Amended 4-8-2008 by Ord. No. 2008-04]
A. 
Fixtures subject to backflow. Drainage piping serving fixtures that are located below the elevation of the curb at the point where the building sewer crosses under the curb or property line and above the crown level of the main sewer may drain by gravity into the main sewer and shall be protected from backflow of sewage by installing a backflow valve approved by the Borough of Clementon.
B. 
Fixture branches subject to backflow. Backflow valves shall be installed only in that branch or section of the drainage system which receives the discharge from fixtures located as stated in Subsection A above.
C. 
Materials for backflow valves. Backflow valves shall have all bearing parts of corrosion-resistant material.
D. 
Construction of backflow valves. Backflow valves shall be constructed so a mechanical seal against backflow will be provided.
E. 
Diameter of backflow valves. Backflow valves, when fully opened, shall have a capacity not less than that of the pipes in which they are installed.
F. 
Location of backflow valves. Backflow valves shall be installed so their working parts will be accessible for service and repairs.
G. 
In the event that a fixture is found to be installed at any point lower than heretofore specified, the Borough of Clementon may revoke the sewer connection permit or discontinue service until the fixture is removed or positive control measures are instituted to eliminate any potential backflow.
A. 
For any proposed sewer line or lateral construction, major maintenance involving open excavation or related work within state highway rights-of-way or property, a NJDOT utility opening permit shall be obtained from the appropriate NJDOT office.
B. 
It shall be the responsibility of the property owner or sewage collection system user proposing a connection, major maintenance or related work to prepare a complete NJDOT utility opening permit application, including all required sketches, maps and plans of the proposed installation and to make any revisions or additions to the application required by the Borough or by the NJDOT and to pay all application, permit and inspection fees of the Borough and the NJDOT. Application, permit and inspection fees are not refundable.
C. 
A property owner or sewage collection system user proposing a new connection must first obtain connection permits and pay all connection fees of the Borough and the CCMUA before a utility opening application will be filed with the NJDOT.
D. 
After review of the complete NJDOT utility opening application by the Borough of Clementon, Department of Public Works, Division of Sewer, and after the property owner or system user provides all application, permit and inspection fees, the NJDOT utility opening application may be signed by the appropriate Borough official and the application filed by the Borough with the appropriate NJDOT office. No work may proceed in the right-of-way or on state highway property until the utility opening permit is issued to the Borough by the NJDOT.
E. 
The cost and the work, including all labor, materials and equipment for connection, major maintenance or related work on a sewer line or lateral shall be the sole responsibility of the property owner or collection system user. The work must be performed by a licensed and insured contractor acceptable to the Borough.
F. 
In the event that the utility opening for a sewer line or lateral connection, major maintenance or related work involves more than 20 square feet of surface areas, a performance bond for the amount of the work and a one-year maintenance guarantee must be provided to the Borough by the property owner, collection system user or their contractor.
A. 
Property owners are required to keep clear, maintain, and repair sewer lines or laterals from the Borough's sewage collection system to their facility, building or home, including, but not limited to, all valves, pipes, cleanouts, vents, and all other appurtenances thereto.
B. 
In an effort to determine the location of a sewer blockage and to clear the sewer main, the Department of Public Works, Division of Sewer, will respond to a call and clean the sewer main and, if necessary to clear the main, clean the sewer lateral between the sewer main and the curb cleanout in an effort to remove a blockage in the main.
There is hereby imposed an annual sewer service charge for the use of the sewage collection system of the Borough of Clementon upon the owners and/or occupiers of the properties served thereby and to which sanitary sewer service is available at the rates hereinafter set forth, or as amended from time to time by the governing body of the Borough of Clementon.
The minimum annual sewer service charge hereby imposed shall be as follows:
A. 
For each single-family dwelling, the fee shall be $220 per year.

Senior Citizen, disabled, and veteran discounts.

The minimum annual sewer service charge for each single-family dwelling for senior citizens, disabled persons, and veterans is $184.

(2) 
Eligibility criteria are based upon submission and approval of required documentation for property tax relief programs in the Borough of Clementon. Applicants must meet one of the following requirements:
(a) 
Senior citizens, age 65 or older, with an annual income less than $10,000, not including social security benefits.
(b) 
Permanently disabled persons of any age, with an annual income less than $10,000, not including social security benefits.
(c) 
Veterans of any age having served during the specific wars referenced on the claim form for property tax exemption on dwelling house of disabled veteran or surviving spouse/surviving civil union partner/surviving domestic partner of disabled or service person.
(d) 
Veterans permanently disabled due to a war injury.
C. 
For all other uses within the Borough of Clementon, the annual sewer service charge shall be $220 per year for each EDU or fraction thereof, as set forth in the Schedule of Equivalent Domestic Units.

D. 
Said sewer service charges and Schedule of Equivalent Domestic Units shall be established and amended from time to time by the governing body of the Borough of Clementon, and said schedule of Equivalent Domestic Units and the sewer service charges will be kept on file and may be examined in the office of the Borough Water/Sewer Clerk.

A. 
In cases where the character of the sewage or industrial wastes discharged from any building or premises is such that it imposes an additional burden upon the sewage collection system different from that imposed by the average sewage entering said sewage collection system, the additional cost necessitated thereby shall be an additional charge over the rates hereinabove set forth. The Borough may, if it deems advisable, compel such building or premises to pretreat such sewage or industrial wastes in such manner as shall be specified by the Borough before discharging the same into the Borough's sewage collection system.
B. 
The Borough shall at all reasonable times have the right to enter upon premises connected to said sewage collection system for the purposes of making tests of the quantity and quality of the sewage or industrial wastes discharged from said property into said sewage collection system. The owner of such property shall, at his own cost and expense, install approved facilities for obtaining samples of said sewage or industrial waste.
C. 
The Borough shall have the right to refuse to permit any person, firm, corporation or entity to connect to or require the disconnection from said sewage collection system if, in the opinion of the Borough Council, the sewage or industrial waste to be discharged into said sewage collection system is detrimental to the health, safety and welfare of the Borough and/or its inhabitants.
A. 
The sewer service charge established herein shall be an annual charge for each calendar year and shall be billed and payable quarterly, in advance.
B. 
All charges for services not specifying a due date shall be due and payable when presented.
C. 
If the sewer rentals or service charges imposed by this Part 1 are not paid within 10 days from the date due, the same shall be and become delinquent and shall thereupon bear interest from the due date to the date of payment at the rate charged by the Borough of Clementon for delinquent taxes. All sewer rentals and service charges shall be and constitute a lien against the property affected, and the Borough of Clementon shall have the same remedies for the collection thereof as in the case of municipal taxes and other charges and liens.
If sewerage service is disconnected for any reason, a fee of $200 shall be paid to the Borough of Clementon to reconnect said unit to the sewerage system. Any disconnection, however, shall not suspend or alter the sewer rentals or service charge imposed by this Part 1, which shall continue to be due and payable as herein provided during such period of such disconnection by reason of the availability of service.
