The Construction Official of the Township of Lebanon shall have the authority to give notice to the owner of any building or structure, which may be dangerous to human life or the public welfare or may constitute a fire hazard, and a hearing shall be held before said Construction Official to determine whether or not said building or structure is dangerous to human life or the public welfare or constitutes a fire hazard.
A. 
Said notice shall fix a place and date for hearing, which notice shall provide that the hearing shall be not less than 14 days from the mailing of said notice by certified mail to the owner and not more than 30 days from the mailing of said notice by certified mail to the owner.
B. 
Said notice shall inform the owner that the Construction Official may order the owner to demolish and remove said building or structure and remove the debris therefrom at the owner's expense.
At said hearing, the Construction Official shall determine whether or not said building or structure is dangerous to human life or the public welfare or whether or not said building or structure constitutes a fire hazard, and if the Construction Official so finds, the Construction Official may order the owner to demolish said building or structure and remove the debris therefrom, within a time fixed by the Construction Official which shall not exceed 30 days from his determination.
If the owner fails to comply with said order for the removal or demolition of said building or structure, the Lebanon Township Committee may, pursuant to N.J.S.A. 40:48-1.1 and other authority, undertake the removal or demolition of said building or structure.
In such event, the Township of Lebanon may assess the costs of such removal or demolition as a municipal lien against the premises and, furthermore, enforce the payment of such assessment, together with interest, as a debt of the owner. The Lebanon Township Committee may authorize the institution of an action at law for the collection thereof in the New Jersey Superior Court.
In the event the Township of Lebanon seeks to impose a lien, the Township Committee shall file with the Tax Assessor of Lebanon Township a statement reciting the costs of such removal or demolition. Reference shall be made to the block and lot of the premises involved, which block and lot shall also be stated in the notice described in § 147-2 of this chapter.
The passage of this chapter shall not constitute a waiver of any other rights the Township of Lebanon may have involving the demolition or removal of buildings or structures above mentioned.
