Pursuant to the provisions of the N.J.S.A. 40:55D-23, a Planning Board consisting of nine regular members is hereby established and created. Pursuant to N.J.S.A. 40:55D-23.1, said Planning Board shall have two alternate members, who shall be designated at the time of appointment by the Mayor as "Alternate No. 1" and "Alternate No. 2."
The membership shall consist of four classes and alternates pursuant to N.J.S.A. 40:55D-23 and N.J.S.A. 40:55D-23.1.
No member of the Planning Board shall be permitted to act on any matter in which he has, either directly or indirectly, any personal or financial interest. Any member other than a Class I member, after a public hearing if he requests one, may be removed by the governing body for cause.
The Planning Board shall be organized in accordance with and pursuant to N.J.S.A. 40:55D-24.
The Planning Board shall have such powers and referral powers as are enumerated in N.J.S.A. 40:55D-25 and N.J.S.A. 40:55D-26.
All procedural matters shall be handled pursuant to and in accordance with N.J.S.A. 40:55D-1 et seq., the Land Development Ordinance and such rules and regulations adopted by this Board not inconsistent with state law, the Land Development Ordinance and the Code of Old Bridge.
Meetings of the Board shall be held at regular intervals and on such dates determined by the Board at its annual meeting and at the call of the Chairman. The Board may also fix, by rule, the manner in which the Chairman may issue any such call for a meeting and the amount of notice required of any such call, as well as the manner, including the amount of notice, in which meetings other than those at the call of the Chairman may be held.
The Board may adopt and enforce rules and regulations governing its internal operation, the conduct of its members, appellants, attorneys and citizens necessary to carry into effect the provisions and purposes of the Zoning Ordinance and not inconsistent with law or the Code.[1]
