A.
Legislative authority. This article is adopted pursuant
to the provisions of § 10 of the Municipal Home Rule Law of the
State of New York, which grants to local governments the authority to enact
local laws which are not inconsistent with the constitution and general state
laws.
B.
This article shall supersede § 3 of the Public
Officers Law of the State of New York and § 23, Subdivision 1, of
the Town Law of the State of New York, in their application to the Town of
Pawling for the positions of Code Enforcement Officer, Deputy Code Enforcement
Officers, Building Inspector, Deputy Building Inspectors and Constables.
C.
The Town of Pawling Code Enforcement Officer, Deputy
Code Enforcement Officers, Building Inspector, Deputy Building Inspectors
and Constables are not required to be residents of the Town of Pawling, provided
that such person holding any said office resides in the County of Dutchess
or an adjoining county within the State of New York, and provided such person
has all other qualifications for holding the particular office as provided
in § 3 of the Public Officers Law and any other applicable law.
D.
This article shall take effect immediately upon filing
with the Secretary of State of the State of New York.
