As used in this article, the following terms shall have the meanings indicated:
STREET
Refers to and includes and is applicable to any and all highways as listed in § 199-7.
VEHICLE
Shall refer to and include every device in, upon or by which any person or property is or may be transported or drawn upon a highway, except devices moved by human power.

No vehicles shall be left parking or standing on the following streets. Such parking restrictions shall apply at all hours of the day and night.

Notwithstanding any ordinance, traffic regulation or traffic law to the contrary, no automobile, truck, bus, trailer, vehicle or other obstruction shall be parked, left standing or shall remain on any public highway or street in the Town of Pawling from November 15 through April 15 between the hours of 7:00 p.m. and 7:00 a.m. or at any other such time when the presence on the public highway or street of such automobile, truck, bus, trailer, vehicle or other obstruction does or may interfere with, hinder or hamper snow plowing or snow removal operations.

Any automobile, truck, bus, trailer or other obstruction parked, left standing or remaining on any public highway or street in the Town of Pawling in violation of § 199-7.1 of this article may be removed and impounded by the Town Highway Department and held impounded until all costs, penalties and expenses of such removal shall have been paid and a release executed relieving the Town of Pawling, its employees and agents from all claims arising from such removal.
The Town shall erect signs giving notice of these restrictions on parking and standing on these streets. There shall be an interval of not less than 500 feet between each such sign.
It shall be the duty of the Constable of the Town of Pawling, any member of the Dutchess County Sheriff's Department, any member of the New York State Police or any other peace officer to report to the Town Court of the Town of Pawling the year, make and license number of the vehicle that is parked or standing in violation of this article and the time during which such vehicle is parked or standing in violation of this article and the approximate location thereof.

Each such Constable or other peace officer shall attach to such vehicle in violation of this article a notice to the owner or operator thereof that such owner or operator is in violation of this article and instructing such owner or operator to report to the Town Court of the Town of Pawling. Each such owner or operator may, within 48 hours, exclusive of Sunday, of the time when such notice was attached to the vehicle, pay to the Town Court of the Town of Pawling as a penalty and in full satisfaction the sum as provided in § 199-11. Such payment may also be made by depositing a check or money order made payable to the Town of Pawling Justice Court in the amount as provided in § 199-11 and the notice attached to the vehicle in a postpaid envelope properly addressed, and securely closed, to Town Court of the Town of Pawling, Town Hall, 160 Charles Coleman Boulevard, Pawling, New York, 12564. Said payment must be mailed in a post box or post office of the United States Postal Service within 48 hours, exclusive of Sunday, of the time when such notice was attached to the vehicle. The failure of such owner or operator to make such payment to the Town Court within 48 hours shall require such owner or operator to pay the additional sum of $5, and, if said penalties are not paid thereafter within seven days from the date when such notice was attached to the vehicle, such failure shall render the owner or operator subject to the further penalties provided for violations of this article as set forth hereinafter.
A. 
Any person violating the provisions of this article may, upon conviction, be punished for the first offense by a fine not exceeding $15 and for a subsequent offense by a fine not less than $15 nor more than $25.
B. 
In the event that any penalties due are not paid within the aforesaid 48 hours and still remain due thereafter for a period exceeding seven days, exclusive of Sunday, the owner or operator shall be subject to an additional penalty of $10 over and above the original penalty.
