A.
Any person desiring to move any building or part of a
building along, through or across any street or highway shall make written
application for a permit to the Village Board, describing the building proposed
to be moved, whether the same is to be moved as a whole or in separate parts,
the location of the premises from which and of the premises to which and along
and across what streets and highways it is proposed to move the same.
B.
Said application shall be signed and acknowledged and,
if made by a partnership, shall specify the names of the general partners
thereof and, if a corporation, the names and residence addresses of its president
and secretary and the name of the state under the laws of which the same is
organized. The application shall be accompanied by:
(1)
Acknowledgments from the electric, telephone, telegraph,
television cable or other public utility and service companies maintaining
wires, cables or structures in the path of the proposed route and whose cooperation
or permission is required in order to expedite passage of such building; and
(2)
A certificate of insurance in the name of the building
owner or in the name of the person, partnership or corporation performing
the move on behalf of the building owner. Such certificate shall evidence
commercial general liability and commercial auto liability coverages or their
equivalent with limits of liability of no less than $1,000,000 combined for
bodily injury and property damage and shall name the Village of Springville
as an additional insured with respect to any and all damages, loss, costs
and expenses which it may be compelled to pay by reason of injury or alleged
injury to persons or property arising from the moving of the building and
shall further evidence an agreement to waive any right of recovery which the
company providing said coverage may have against the Village of Springville
by reason of any alleged or actual negligence on the part of the village arising
from the move and shall further evidence workers' compensation insurance
meeting all statutory requirements. Such certificate shall be approved by
the Village Board as to form, manner of execution and sufficiency of the insurer,
and it may reject the same and require a new or additional insurer or change
in the manner of execution if, in its sole judgment, the insurer is not sufficient
or said certificate does not comply with the provisions of this chapter.
