Where the Planning Board finds that extraordinary
hardships may result from strict compliance with these regulations
because of unusual circumstances of shape, topography or other physical
features of the subdivision tract or because of the nature of adjacent
developments, variations may be granted, provided that they will not
have the effect of nullifying the intent and purpose of the Master
Plan, the Erie County Sanitary Code or these regulations.

The Planning Board has the power to permit a change
in the dimensions from the specifications in that zone without rezoning
if the total density within the subdivision is not to exceed the density
of that zone.

The standards and requirements of these regulations
may be modified by the Planning Board in case of a plan and program
for a complete community or a neighboring unit which in the judgment
of the Planning Board provides adequate public spaces and improvements
for the circulation, recreation, light, air and service needs of the
tract when fully developed and populated and which also provides such
covenants or other legal provisions as will assure conformity to and
achievement of the plan.
