GENERAL REFERENCES
Occupancy and vacancy permits — See Ch. 200.
As used in this chapter, the following terms shall have the meanings
indicated, unless a different meaning clearly appears from the context:
A parcel of real estate, with or without improvements located thereon,
utilized by any person or persons for any commercial activity or purpose.
One or more rooms used for living and sleeping purposes arranged
for occupancy by one family or by one or more persons.
Any person who owns or holds legal or equitable title to any parcel
of real estate located in the Borough of Dravosburg, or any person who acts
as agent for another person who owns or holds legal or equitable title to
any parcel of real estate located in the Borough of Dravosburg, which is occupied
by a person or persons other than the individual owner or his immediate family.
Any individual, partnership, association, firm or corporation.
Within 30 days from the effective date of this chapter, each owner shall
submit to the Secretary of the Borough of Dravosburg a report on a form supplied
by the Borough Secretary, which includes the following information:
A.
List of the dwelling units and business units located
in the Borough of Dravosburg, whether occupied or not, in which the owner
has an interest, whether the interest be legal title, equitable title, or
ownership;
B.
Address of each dwelling unit and business unit;
C.
Brief description of each dwelling unit or business unit;
D.
Whether or not said dwelling unit or business unit is
occupied;
E.
Names of the occupants utilizing the aforementioned dwelling
unit or business unit, if any.
After the effective date of this chapter, any person who becomes an owner of any parcel of real estate or any improvement on real estate or building located in the Borough of Dravosburg by agreement of sale, by deed, or by any other means, shall, within 30 days thereafter, report to the Secretary of the Borough of Dravosburg the information and data set forth in § 223-2 above, and on forms to be provided by the Secretary of the Borough of Dravosburg.
After the effective date of this chapter, each and every owner of property
within the Borough of Dravosburg shall report to the Borough Secretary, on
a report form to be supplied by the Borough Secretary, any change in the use
or occupancy of any dwelling unit or business unit owned by such owner. The
reported change shall include the name or names of new occupants of such dwelling
unit or business unit, the date when such change was effected, and the forwarding
address of the old occupant or occupants, if known. An owner of a hotel, inn
or boardinghouse shall not be required to report a person as an "occupant"
until that person has resided in such owner's establishment for a period exceeding
30 days. In the event that a dwelling unit or business unit was used or utilized
by an occupant and then becomes vacant, this change shall also be reported
to the Borough Secretary. All reports required by this section shall be made
within 10 days after an owner has knowledge that such a unit has had a change
in occupancy or has become vacant.
The Secretary of the Borough of Dravosburg, under authority of this
chapter, shall:
A.
Maintain on file at the Borough Office the names of the
owners of dwelling units and business units in the Borough of Dravosburg,
said list to include the names of the current occupants of said dwelling units
and business units;
C.
Notify the Chief of Police and the Fire Chief of the
Borough of Dravosburg of the address and description of any dwelling unit
or business unit that is vacant, unoccupied and not in use;
Any person who shall violate any provision of this chapter shall, upon
summary conviction thereof, be sentenced to pay a
fine of not more than $600, plus costs of prosecution, and, in default of
payment of such fine and costs, to imprisonment for a term not to exceed 30
days. Each day during which any violation of any provisions of this chapter
occurs shall constitute a separate offense. In addition to said penalties,
the Borough of Dravosburg shall reserve unto itself all other available legal
remedies to effect compliance with this chapter, including an action in equity
for the proper enforcement of this chapter. The imposition of a fine or penalty
for any violation of, or noncompliance with, this chapter shall not excuse
the violation or noncompliance or permit same to continue.
