GENERAL REFERENCES

The elected officials of the Village shall be the Village President and six Trustees.
A. 
The President shall be elected in odd-numbered years for a two-year term.
B. 
The Trustees shall serve two-year terms with three elected each year.
Pursuant to §§ 61.195, 61.197 and 66.0101, Wis. Stats., the Village of Maple Bluff hereby elects not to be governed by those portions of §§ 61.29, 61.23 and 61.25(2), Wis. Stats., which relate to the selection and tenure of the Assessor, Clerk, Constable and Treasurer and which are in conflict with this section. After January 1, 1943, instead of being elected as provided in § 61.19, Wis. Stats., the Assessor, Clerk, Constable and Treasurer of the Village of Maple Bluff shall be appointed by vote of 2/3 of the members-elect of the Village Board. The Assessor, Clerk, Constable and Treasurer shall each hold office for indefinite term, subject to removal as provided by law. This section shall not in any way affect the right of any person holding any of the aforementioned offices, either at the time of the passage of this section or at the time it takes effect, to complete his term of office.

B. 
Pursuant to § 61.195, Wis. Stats., the Village may proceed pursuant to § 66.0101, Wis. Stats., to consolidate offices provided in this chapter and combine the duties thereof in one position. Any combined appointment shall be made by the Village President subject to approval of 2/3 of the Village Board of Trustees.
Elected and appointed officials shall take and file the official oath within five days after notice of their election or appointment as provided in § 61.21, Wis. Stats., and shall execute and file the official bond as required by state statutes and this Municipal Code.
A. 
Elected officials. Elected officials may be removed by the Village Board as provided in § 17.13(2), Wis. Stats., or by the Judge of the Circuit Court for cause pursuant to § 17.13(3), Wis. Stats., or as provided by § 17.16, Wis. Stats.
B. 
Appointed officials. Appointed officials may be removed as provided in §§ 17.13(1) and (3) and 17.16, Wis. Stats.
A. 
How occurring. Vacancies in elective and appointive positions are caused as provided in §§ 17.03 and 17.035, Wis. Stats.
B. 
How filled. Vacancies in elective and appointive offices shall be filled as provided in § 17.24, Wis. Stats.
The salaries of all elected and appointed officials, including members of boards and commissions, shall be as determined by the Village Board from time to time, provided that the salary of the President and members of the Board shall not be increased during their terms of office. A. 
Sections 19.42 and 19.59 of the Wisconsin Statutes, as may be amended, are hereby adopted and incorporated by reference in this Code.
B. 
Penalty. Violations of this section are contrary to the public policy of the Village and punishable as provided in § 1-4 of this Municipal Code.
A. 
Pursuant to § 40.01, Wis. Stats., the Village of Maple Bluff hereby elects to include eligible Village personnel under the provisions of the Wisconsin Municipal Retirement Fund in accordance with the terms thereof.
B. 
Election is hereby made to provide prior service credits at rates equal to two times the rates of municipality credits for current service, to be applicable to employees as defined by § 40.01, Wis. Stats., who are employed by the Village of Maple Bluff on the effective date of this section.
C. 
Upon the final enactment of this section, the Village Clerk-Treasurer shall submit a certified notice of the election made hereunder to the Board of Trustees of the Wisconsin Municipal Retirement Fund. Such notice of election shall be in writing, indicate the date and results of such election, include a certification of the prior service contribution rate selected as being applicable to the employees of the municipality, and be officially certified by the Clerk-Treasurer.
D. 
The effective date of participation shall be January 1, 1945.
E. 
This is a charter ordinance and shall take effect 60 days after its passage and publication unless within such 60 days a referendum petition shall be filed as provided by § 66.0101, Wis. Stats., in which event this ordinance shall not take effect until submitted to a referendum and approved by a majority of the electors voting thereon.
F. 
Pursuant to § 62.63(3), Wis. Stats., the Village shall include eligible Village personnel under the provisions of the Wisconsin Municipal Retirement Fund in accordance with the terms thereof. The Clerk-Treasurer shall submit such information as may be required relative to the Wisconsin Municipal Retirement Fund.[2]

Election and term. See § 47-1.
B. 
Powers and duties.
(1) 
Village President. The President shall be by virtue of his office a Trustee and preside at all meetings of the Board. He shall have a vote as Trustee and sign all ordinances, rules, bylaws, regulations, commissions, licenses and permits adopted or authorized by the Board and all orders drawn on the treasury except as otherwise provided by statute. He shall maintain peace and good order, see that Village ordinances are faithfully obeyed and, in case of disturbance, riot or other apparent necessity, appoint as many special marshals as he shall deem necessary who for the time being shall possess all the powers and rights of constables.
(2) 
As Village Board. The Village President and Trustees shall constitute the Village Board and shall have such duties and powers as are enumerated in Ch. 61, Wis. Stats., and elsewhere in the statutes.
(3) 
Police powers. See § 19-5 of this Municipal Code.
C. 
Authority. The Village Board shall have all powers of the Village not specifically given to some other body or officer. Except as otherwise provided by law, the Village Board shall have the management and control of the Village property, finances, highways, streets, utilities and the public service and may act for the government and good order of the Village, for its commercial benefit and for the health, safety, welfare and convenience of the public and may carry its powers into effect by license, regulation, suppression, borrowing, taxation, special assessment, appropriation, imposition of forfeitures and other necessary or convenient means. The Village Board may appoint such officials from time to time as may be deemed necessary for the benefit of the community. In addition, the Village Board shall have the powers enumerated in § 61.34, Wis. Stats. The powers hereby conferred shall be in addition to all other grants and shall be limited only by express language.

A. 
Position of the Village Administrator. In order to provide the Village of Maple Bluff with a more efficient, effective and responsible government under a system of part-time Trustees operating as a Village Board (hereinafter referred to as "Board") at a time when Village government is becoming increasingly complex, there is hereby created the position of Village Administrator for the Village of Maple Bluff (hereinafter referred to as "Administrator").
B. 
Appointment, term of office and removal. The Administrator shall be appointed as provided by § 47-3 of this chapter on the basis of merit, with due regard to training, experience, administrative ability and general fitness for the office. The Administrator shall hold office for an indefinite term, subject to removal at any time by a majority vote of the Board. This section, however, shall not preclude the Board from establishing other employment terms and conditions not inconsistent with the provisions of this section or the Code of the Village of Maple Bluff.
C. 
Functions and duties of the Administrator. The Administrator, subject to the limitations defined in resolutions and ordinances of the Village of Maple Bluff and Wisconsin State Statutes, shall be the chief administrative officer of the Village, responsible only to the Village President and the Board for the proper administration of the business affairs of the Village, pursuant to the Statutes of the State of Wisconsin, the ordinances of the Village of Maple Bluff, and the resolutions and directives of the Board, with powers and duties as follows. The Administrator shall:
(1) 
Carry out directives of the Board which require administrative implementation, reporting promptly to the Board any difficulties encountered herein.
(2) 
Be responsible for the administration of all day-to-day operations of the Village government, including the monitoring of all Village ordinances, resolutions, Board meeting minutes and state statutes.
(3) 
Establish when necessary administrative procedures to increase the effectiveness and efficiency of Village government according to current practices in local government, not inconsistent with directives of the Board.
(4) 
Serve as an ex officio nonvoting member of all boards, commissions and committees of the Village, except as specified by the Board or Wisconsin State Statutes.
(5) 
Represent the Village in matters involving legislative and intergovernmental affairs, including the coordination of services with surrounding municipalities, as authorized and directed.
(6) 
Act as public information officer for the Village with the responsibility of assuring that all open meeting rules and regulations are followed.
(7) 
Serve as Personnel Officer with responsibility for the administrative oversight, direction, supervision and coordination of all employment-related issues of the Village according to the established organization procedures.
(8) 
Recommend to the Board the appointment, promotion and, when necessary for the good of the Village, the suspension or termination of department heads.
(9) 
Be responsible for the preparation of the annual Village budget, in accordance with guidelines as may be provided by the Village Board and in coordination with department heads and pursuant to state statutes, for the review and approval by the Village President and the Village Board.
(10) 
Administer the budget as adopted by the Village Board.
D. 
Cooperation. All officials and employees of the Village shall cooperate with and assist the Administrator so that the Village government shall function effectively and efficiently.

Pursuant to §§ 61.25, 61.197 and 66.0101, Wis. Stats., the Village of Maple Bluff elects not to be governed by those portions of §§ 61.19, 61.23 and 61.25(2), Wis. Stats., which relate to the selection and tenure of the Village Clerk and Village Treasurer to the extent that the same is in conflict with this section.
B. 
The offices of Clerk and Treasurer are hereby combined and hereafter the office of Village Clerk-Treasurer shall be filled by appointment by vote of 2/3 of the members of the Village Board.
C. 
The Village Clerk-Treasurer shall hold office for an indefinite term subject to removal as provided by law for officers appointed by the Village Board.
D. 
The compensation of the office of Village Clerk-Treasurer shall be fixed by the Village Board.
E. 
This is a charter ordinance and shall take effect 60 days after its passage and publication unless within 60 days after passage and publication a petition shall be filed as provided by § 66.0101, Wis. Stats., demanding that such ordinance be submitted to the vote of the electors, in which event this ordinance shall not take effect until submitted to a referendum and approved by a majority of the electors voting thereon.

Appointment. The office of the Village Clerk-Treasurer shall be filled by appointment as provided in § 47-3.
B. 
Duties. The Village Clerk-Treasurer shall perform the statutory duties of Village Clerk and Treasurer and such other duties as required by the Village Board.

Powers and duties. The Deputy Village Clerk-Treasurer shall perform the functions of the Clerk-Treasurer under the direction of the Village Clerk-Treasurer. During the temporary absence or disability of the Clerk-Treasurer, the Deputy shall serve as the Acting Clerk-Treasurer. The acts of such Deputy shall be covered by official bond.

Other duties prescribed by law. The Assessor shall perform such other duties as shall be prescribed by state law, supervisory personnel of the State Department of Revenue and the Village Board, including attendance at all meetings of the Board of Review.
D. 
Confidentiality of income and expense information provided to Assessor. Whenever the Assessor, in the performance of the Assessor's duties, requests or obtains income and expense information pursuant to § 70.47(7)(af), Wis. Stats., or any successor statute thereto, then such income and expense information that is provided to the Assessor shall be held by the Assessor on a confidential basis, except, however, that the information may be revealed to and used by persons in the discharge of duties imposed by law; in the discharge of duties imposed by office (including but not limited to use by the Assessor in performance of official duties of the Assessor's office and use by the Board of Review in performance of its official duties); or pursuant to order of a court. Income and expense information provided to the Assessor under § 70.47(7)(af), unless a court determines that it is inaccurate, is, per § 70.47(7)(af), not subject to the right of inspection and copying under § 19.35(1), Wis. Stats.

General duties. The Health Officer, under the supervision of the District State Health Officer, shall perform the duties required under this Code and shall have such power as shall be required in connection therewith. The Health Officer shall keep and deliver to his successor a record of all his official acts. The Health Officer shall make reports to the State Department of Health and Family Services and to the Village Board as required or as requested.
B. 
Materials and supplies. The Health Officer may procure, at the expense of the Village, all record books, quarantine cards and other materials needed by the Board of Health, except those furnished by the State Department of Health and Family Services.
