No private residential swimming pool shall be
permitted where it shall create a nuisance, hazard or otherwise result
in a substantial adverse effect on the surrounding property values
or on the enjoyment of such property or be in any way detrimental
to the public health, morals, safety, comfort or general welfare.
Every reasonable effort shall be made to prevent such effect through
control of lighting, attractive design, use of planting screens or
attractive fences, careful placement on the site and sensible regulation
of use.
As used in this article, the following terms
shall have the meanings indicated:
Any pool of water used or intended to be used for wading,
swimming or diving, or for therapeutic or other special purposes,
constructed, installed or maintained either above or below the ground.
Temporary pools with a water depth of two feet or less shall not come
within the provisions of this article.
A.
Reasonable precautions shall be taken to ensure the
safety of the pool and to prevent it from becoming an attractive nuisance.
Pools shall comply with one of the following so as to prevent unregulated
entrance to the pool:

(1)
The
pool shall be completely enclosed by a fence of sufficient strength
to prevent access to the pool. Such fence shall not be less than four
feet nor more than six feet in height, and shall be constructed so
as not to have voids, holes or openings larger than four inches in
one dimension. The fence shall be located no closer than three feet
to the pool water. Pool fences shall be equipped with self-closing,
lockable gates or doors, which shall be kept locked when the pool
is not in actual use; or
(2)
The
pool shall have a mechanical cover over the swimming pool of such
a design and material that the cover can be securely fastened in place,
and when in place shall be capable of sustaining a person weighing
250 pounds. Such cover shall be securely fastened in place at all
times when the swimming pool is not in actual use for swimming or
bathing purposes.
B.
Any portion of a pool visible above the surface of
the ground shall be adequately screened from the view of abutting
properties by means of combined fence and landscape screening.
A.
Pools used or intended to be used at night shall be
adequately illuminated. Pool lighting installations shall be so located
and shielded that no objectionable glare or excessive illumination
is cast upon adjoining property.
B.
All electrical wiring in connection with requirements
for pool lighting or power shall conform to the Electrical Code of
the Village.
C.
All pool water heating equipment shall be installed
in conformance with the Plumbing and Heating Code of the Village.
All pools shall have:
A.
A filtration system capable of providing one complete
turnover of water every 18 hours.
B.
A smooth interior finish to protect against skin abrasions.
C.
Adequate side wall and bottom structural strength.
D.
A pool vacuum to keep the bottom clean and dirt free.
E.
An automatic skimmer or overflow gutters which carry
off surface scum, mucus and other foreign matter.
F.
Adequate steps or ladders which are made of impervious
material, easily cleaned, which do not collect or retain water.
Pools shall be adequately treated with chemicals
to protect swimmers from infectious diseases and there shall be available
and used to test such pools a pH and residual determination outfit.
