[Adopted 7-14-1981; amended in its entirety 3-27-1984 (Sec. 8-11 of the 1974 Code); amended in its entirety at time of adoption of Code (see Ch. 1, General Provisions, Art. III)]
The area extending 400 feet north from the Third Avenue Jetty and only this area shall be used exclusively for the purpose of surfing; this area shall be referred to as the "Third Avenue Surfing Beach." Surfing shall be allowed in the designated area during daylight hours only.
Surfing shall be conducted under the following rules and regulations:
A. 
No person shall be permitted to surf alone.
B. 
No bathers or swimmers, except those who are swimming to retrieve surfboards, shall be permitted to surf alone.
C. 
No person shall be permitted to paddle out through the potential path of an incoming surfer.
D. 
No surfer shall be permitted in water considered too rough by the lifeguards.
E. 
No surfboards shall be carried on the boardwalk. Surfers shall place their boards over the fence and onto the beach directly south of the Third Avenue Badge Booth Building. Surfers without surfboards may then use any publicly designated entrance to the beach.
All surfers shall surf at their own risk without any liability to the Borough of Bradley Beach or its employees, agents, servants or representatives, and the surfer shall agree to save the Borough, its employees, agents, servants and representatives harmless by reason of any and all claims, the result of any personal injuries or property damage as the result of any surfing activities.
All individuals entering the beach for the purpose of surfing must have a proper beach badge and must display same on their person.
