It shall be lawful for individuals to use kayaks on the beachfront of the Borough of Bradley Beach, provided that the operators comply with the following rules and regulations:
A. 
Any person entering the beach for the purpose of using a kayak shall have a proper beach badge and must display same on their person.
B. 
No person may operate a kayak when in the judgment of the lifeguards the water is too rough, and the lifeguards must be obeyed in all instructions issued and commands given.
C. 
An individual will be permitted to launch the kayak from any beach along the Borough but must do so in a safe manner so as not to endanger any bathers. The kayaks cannot be launched in designated bathing area.
D. 
Once an individual has launched his or her kayak, he or she must immediately proceed away from the bathing area and operate his or her kayaks in the area east of the designated bathing areas. He or she may exit the bathing area away from all bathers and must do so in a safe manner.
E. 
In the event an individual who is operating a kayak wishes to do so in the bathing area closer to the shore, he or she may do so only at the Third Avenue surfing beach, but cannot interfere with surfers.
The penalty for violation of any of the terms of this article shall be a fine not to exceed $500 or incarceration not to exceed 90 days, or both.
