An appeal to the Zoning Board of Adjustment may be taken by any interested party affected by any decision of the Administrative Officer, Construction Official, or Zoning Officer of the municipality based on or made in the enforcement of the Zoning Ordinance[1] or Official Map. Such appeal shall be taken within 20 days by filing a notice of appeal in the manner set forth in Article II, § 35-21A, of this chapter, and in accordance with the provisions of Article 9 of the Municipal Land Use Law of 1975.[2] In addition, notice of such appeal shall be provided to all properties within 200 feet of the subject property and in accordance with § 35-34 of the Borough Code.

An appeal from any decision of the Zoning Board of Adjustment granting a use variance pursuant to the provisions of N.J.S.A. 40:55D-17d may be taken to the governing body, provided that such appeal shall be made within 10 days of the date of publication of such final decision of the Zoning Board of Adjustment.
An appeal from any final decision of the Zoning Board of Adjustment, other than an appeal of the type described in § 35-42 hereof, and an appeal from any final decision of the Planning Board may be taken to the governing body, provided that such appeal shall be taken in accordance with N.J.S.A. 40:55D-17.
