No person or corporation shall erect, place or maintain poles for the use of telephone, telegraph or any other purpose whatsoever upon the streets of said borough, except with the permission and under the direction of the Mayor and Council.
Any person, persons or corporation desiring a permit for any of the purposes specified in §§ 171-5 and 171-6 shall apply to the Mayor and Council of said borough, and upon the order of the Mayor, the Clerk of the Borough shall issue a permit to excavate according to the terms and rules hereinafter specified.
The Mayor shall, at every regular meeting of the Council, make a report on permits applied for, issued or rejected.

To insure the prompt restoration of the streets or sidewalks to their original condition where permits have been granted to dig up the same, the persons or corporations, before receiving such permits, shall deposit with the Borough Clerk a sum as set forth in Chapter A301, Fees and Deposits, for an excavation 50 feet or less in length and for a longer or larger excavation such sum as, in the judgment of said Mayor and Council, may be deemed necessary, said deposit to be held by the Borough Clerk as a guaranty that said streets or sidewalks shall be restored to a proper and satisfactory condition and also for compliance with all the terms and conditions specified in said permit.
All excavations made must be properly protected so as to allow safe passage along all streets in which the same are made and must be properly lighted during nighttime, and all surplus material must be properly removed.

If any person, persons or corporations to whom permits have been granted shall fail to protect or restore the streets so opened to the satisfaction of the Mayor and Council, then said Council shall, after 10 days' notice, proceed to protect or put said street or sidewalks in proper condition and shall reimburse themselves out of the money deposited on obtaining the permits, and any amount left over after paying for the protection or restoration of said street or sidewalk shall be paid back to the person, persons or corporations who deposited the same. The Borough Clerk shall receive a sum as set forth in Chapter A301, Fees and Deposits, for each permit issued, to be paid by the person or corporation to whom the permit is granted, for his or her services in connection with the same.
No person, persons or corporation shall be permitted to place signs, placards or advertisements of any description along the public highways or streets in the Borough of Closter or on the trees or telephone, telegraph or electric light poles on said streets.

The penalty for the violation of this article or any part thereof shall be as set forth in Chapter 1, General Provisions, Article II, Violations and Penalties, of this Code. All costs shall be paid.
