In the Industrial Area, no building or premises shall be used or maintained for any except the following uses and purposes, and no building shall hereafter be erected, enlarged or altered if, as so erected or as a result of such enlargement or alteration, such building or any part thereof is arranged, designed or intended to be used for any except the following uses and purposes:
A. 
Any process of manufacturing, fabricating, converting, altering, finishing, assembling or warehousing, all of which shall be conducted solely within the confines of a building; provided, however, that no building or premises shall be used for any industry or purpose which is or may reasonably be expected to be noxious, obnoxious or offensive by reason of causing or emitting odor, smoke, vapor, gas, dust, refuse matter, noise or vibration or that is dangerous or harmful to the comfort, peace, health, general welfare or safety of the community or that involves any explosion menace or any serious fire hazard.
B. 
Accessory retail sales shall be a permitted use within the zone district, provided that the merchandise sold is manufactured, fabricated, converted, altered, finished or assembled by the occupant of the building wherein such accessory retail sales are conducted, and provided that said use is conducted solely within the confines of the building. In no case shall retail discount outlets be permitted. A certificate of occupancy shall be required before use of any premises for accessory retail sales, and no certificate of occupancy shall be issued for accessory retail sales without prior Planning Board site plan approval for said use.
C. 
A limousine or livery service licensed pursuant to the Borough of Closter Municipal Code.[1]

In the Industrial Area, the following uses may be granted as conditional uses by the Planning Board:
A. 
Any use permitted in District No. 4A, Office Area A, provided that the use complies with all the dimensional requirements of § 200-19, the buffer strip requirements of § 200-20, the required planting of § 200-21, the open space requirement of § 200-22 and the off-street parking requirements of § 200-23.
B. 
The uses permitted in District No. 4B, Office Area B, provided that the use complies with the dimensional requirements of § 200-28, the buffer strip requirement of § 200-29, the required planting of § 200-30, the open space requirement of § 200-31 and the off-street parking requirements of § 200-32.
C. 
Where a use is permitted in both District No. 4A, Office Area A, and District No. 4B, Office Area B, the use must comply with the requirements established for uses in District No. 4A, Office Area A.
No use permitted under Subsection B of § 200-34 and not permitted in any other district shall be a matter of right under this chapter but shall be granted only after due and proper application to the Planning Board of the Borough of Closter and after approval of the use applied for by said Board. No building permit or certificate of occupancy shall be issued by the Building Inspector or any other person authorized by law to issue building permits or certificates of occupancy except after such approval by the Planning Board. Before any building is erected, enlarged, altered or converted to such use, a copy of the complete and final plans and specifications for such erection, enlargement, alteration or conversion and a detailed description of the process of manufacture, fabrication, conversion, alteration, finish or assembly to be conducted on the premises shall be filed and approved by the Planning Board of the Borough of Closter. The Planning Board may deny or reject any proposed use, erection, enlargement, alteration or conversion which may violate or tend to violate the Master Plan of the Borough of Closter or which may violate or tend to violate either the spirit or the letter of this chapter or the ordinance entitled "An Ordinance to Limit and Restrict, to Specify Districts or Zones and to Regulate Therein Buildings and Structures According to Their Construction and the Nature of and Extent of Their Use in the Borough of Closter, New Jersey."

Operations and storage of goods and materials for approved uses must be conducted solely within fully enclosed buildings other than permitted accessory parking areas and landscape and buffer areas and sidewalks in Zone District No. 5, Industrial Area.

The minimum size of any lot in Zone District No. 5, Industrial Area, shall be 30,000 square feet.

The minimum mandatory open space requirements in Zone District No. 5, Industrial Area, shall be as follows:
A. 
Front yard: to 50 feet from the property line. Parking shall be prohibited in the front yard.
B. 
Rear yard: 50 feet.
C. 
Side yard: 25 feet for each side.
D. 
Buffer zone: five feet around the perimeter of the building.

The mandatory lot width and mandatory minimum street frontage requirements for any lot in Zone District No. 5, Industrial Area, shall be 100 feet.

The maximum total building coverage of any lot in Zone District No. 5, Industrial Area, shall be 35%.

The maximum coverage of any lot in Zone District No. 5, Industrial Area, by impervious surfaces shall be limited to not more than 75% of the total area of the lot.

A. 
The maximum height of any building in Zone District No. 5, Industrial Area, shall be limited to 25 feet.
B. 
The maximum number of stories in any building in Zone District No. 5, Industrial Area, shall be one story, except, however, that a building used exclusively and solely for office purposes may be not more than two stories. The maximum height limitation in Subsection A above shall apply to all buildings in Zone District No. 5, Industrial Area.

A. 
There shall be a buffer strip not less than 75 feet wide on any lot in Zone District 5, Industrial Area, on all portions of the perimeter of the lot that are contiguous to Zone District No. 1, Residence Area A, or District No. 2, Residence Area B. This planted buffer strip shall be planted with evergreens at least six feet in height throughout its entire length, and said plantings shall be maintained. The planting shall be so located with sufficient density as to screen from view any buildings located on the lot from any contiguous residential zone (Zone District No. 1, Residence Area A, or Zone District No. 2, Residence Area B). Such planting shall be subject to the approval of the Planning Board on site plan review. Any existing growth in such buffer strip shall be preserved, if such existing growth supplements the desired screening effect.

B. 
There shall be no loading areas, loading, parking areas or parking permitted in any buffer strip in Zone District No. 5, Industrial Area.
C. 
The number of square feet of lot area devoted to a planted buffer strip shall be counted in determining whether or not sufficient planted area is provided to meet the minimum planted area requirement set forth in § 200-45.

Each lot in Zone District No. 5, Industrial Area, shall have not less than 25% of its area devoted to planted and landscape area. The planting, grading, plant species and location of planted area shall be subject to the approval of the Planning Board of site plan review. The location and size of required buffer strips, however, shall be determined by the requirements of § 200-44.

Except as otherwise provided by this chapter, all provisions of the Subdivision of Land Site Plan Review Ordinance of the Borough of Closter, which constitutes Chapter 173 of the Code of the Borough of Closter, shall apply to Zone District No. 5, Industrial Area.

The following shall apply to Zone District No. 4, Commercial Area, and Zone District No. 5, Industrial Area:
A. 
All loading berths shall be located along the rear wall of a building. All loading berths shall be shielded by the erection of side walls directly adjacent to the outer perimeter of the loading berths to a height of not less than 10 feet and for the length of the loading berth as required by the Borough of Closter Code § 173-49B. No more than two side walls shall be necessary for any building so long as the two outermost loading berths each are shielded by at least one side wall.
B. 
If a side wall shielding a loading berth extends from the building, a landscaped area not less than five feet in width shall be provided along the outside of such side wall for the full length of the side wall, as extended from the building. Plantings shall be determined by the Shade Tree Commission.
C. 
In addition to the provisions of Borough of Closter Code § 173-46 governing the minimum number of loading berths, the maximum number of loading berths permitted in Zone District No. 4, Commercial Area, and Zone District No. 5, Industrial Area, shall be the following:

D. 
The interior area encompassed by the loading area required by § 200-47A shall not be included in determining the total building coverage pursuant to § 200-41.
E. 
The interior area encompassed by the loading area required by § 200-47A shall be included in determining the maximum lot coverages pursuant to § 200-42.
F. 
It is expressly understood that the provisions of § 200-47C are design standards and are not subject to the exception process of Borough of Closter Code § 173-8. Such provisions are intended to be substantive zoning regulations which may be modified only by variance, pursuant to law, by the Zoning Board of Adjustment and/or Planning Board of the Borough of Closter.

The outside of buildings hereafter erected in Zone District No. 5, Industrial Area, shall not consist of unfinished masonry block or painted unfinished masonry block.
