WHEREAS, the Board of Commissioners of the Town of West New York deems it necessary for the official conduct of the affairs of the Town of West New York that the Town has a property maintenance ordinance;
WHEREAS, the Board of Commissioners of the Town of West New York deems that in order to be in compliance with the affairs of the Town an amendment to the ordinance is beneficial to the public welfare; and
WHEREAS, the Board of Commissioners of the Town of West New York has determined that vesting supervision of sidewalks abutting private property upon the property owner is in the best interest of the community and will advance the safety of our residents and benefit the public welfare;
WHEREAS, the Board of Commissioners of the Town of West New York has determined that vesting supervision of construction debris upon the Construction Official and the Department of Public Works is in the best interest of the community and will advance the safety of our residents and benefit the public welfare;
A. 
The owners and managers of all property in West New York, including all residential single and multifamily, commercial and vacant land, shall take care of their respective properties by keeping the properties and the abutting sidewalks in good state of repair and free of dirt, debris, any obstruction or accumulation of material in the sidewalk, yards, driveways, alleyways and any other open areas of the property.
B. 
Whenever a contractor or owner of any property in West New York, including all property described in § 299-1A of this chapter, shall be engaged in any construction on the property, the construction shall be performed in accordance with the instructions and permits granted by the Construction Official. The contractor and the owner both shall take all necessary steps to prevent dislodging of construction materials from its site or onto the sidewalks, streets or adjacent property in the Town of West New York or into any public sanitary or storm sewer or catch basins in the Town of West New York.
C. 
The debris from construction shall not be mixed with the regular solid waste or recyclable waste. The contractor and owner shall both be responsible for making an appointment with the Department of Public Works and deliver such debris and materials to be weighed and a fee charged per pound, with the proper administrative procedures to be formulated by the Department of Public Works pursuant to this article, but in no event, unless the Board of Commissioners shall approve, by resolution, shall the fee per pound for removal of construction debris be more than $0.75 per pound.
A. 
All owners and managers of property described in § 299-1A of this chapter are required to keep same clear and clean, to repair all deteriorated or dilapidated portions of the property or its abutting sidewalk, and to remove all litter, refuse, junk, unreasonable growth of weeds and brush, and all trash, rubbish, debris and waste on the property or its abutting sidewalk.
B. 
All owners and managers of property described in § 299-1A of this chapter shall keep the abutting sidewalks in good repair, free from any structural dangerous condition that can cause injury to pedestrians and others, and shall keep the abutting sidewalks clean and prevent debris, any other obstruction and prevent conditions that can cause pedestrians to trip or slip or suffer resulting from any hazard or hazardous condition.
C. 
All owners and managers of such property shall use all reasonable means to prevent defacement of their properties, and/or the marring of the property by graffiti, and shall promptly clean up and remove all such defacement and marring.
D. 
Property Owner Assistance Program. The Board of Commissioners, pursuant to guidelines created by resolution, may allow homeowner assistance by the Department of Public Works for repairing sidewalks, including but not limited to concrete, decorative pavers, trees, and other appurtenances to the sidewalk abutting the owner's property.
A. 
Failure to comply with § 299-1A, B and C above shall subject the owner or contractor to a fine not to exceed $1,000.
B. 
Any owner or manager that fails to comply with § 299-3A, B or C shall be subject to a fine not to exceed $1,000.
C. 
Any establishment found to be in violation of § 299-2A and B shall be subject to a fine of $5,000 where permitted by law.

There is hereby adopted in its entirety by the Mayor and Board of Commissioners of the Town of West New York the International Property Maintenance Code 2015, to be used for the maintenance of all buildings and structures of the Town of West New York. Said International Property Maintenance Code 2015 is to be administered by the Building Department of the Town of West New York.
