[HISTORY: Adopted by the Town Board of the
Town of Holland 7-9-1997 by L.L. No. 5-1997. Amendments noted where
applicable.]
As used in this chapter, the following terms
shall have the meanings indicated:
A basement shall be required for all manufactured homes,
which construction shall include either a block wall of ten-inch-minimum
blocks or an equivalent strength for a poured wall with a minimum
height clearance of seven feet.[1]
A dwelling unit fabricated on or after June 15, 1976, in
an off-site manufacturing facility for installation or assembly at
the building site, bearing a seal certifying that it is built in compliance
with the federal Manufactured Housing Construction and Safety Standard
Code. It is not intended to define a modular home which is built in
compliance with the New York State Uniform Fire Prevention and Building
Code pursuant to Article 18 of the Executive Law.
Title IV of the 1974 Housing and Community Development Act
(42 U.S.C. § 5401 et seq) as amended (previously known as
the federal "Mobile Home Construction and Safety Act"), rules and
regulations adopted thereunder, which include Department of Housing
and Urban Development (HUD) approved information supplied by the home
manufacturer and regulations and interpretations of said Code.
A transportable structure built prior to June 15, 1976, the
effective date for the federal Mobile Home Construction and Safety
Act of 1974, larger than 320 square feet, and designed to be used
as a year-round residential dwelling.
A.
Permitted placement. The establishment, location and
use of manufactured homes as scattered-site residences shall be permitted
in any district permitting installation of a dwelling unit subject
to requirements and limitations applying generally to such residential
use in the district, and provided that such homes shall meet the following
requirements and limitations:
(1)
The home shall meet all requirements applicable to
single-family dwellings and possess all necessary improvement location,
building and occupancy permits and other certifications required by
the Code.
(2)
The home shall be at least 960 square feet of occupied
space.

(3)
The home shall be installed upon an approved basement.
(4)
The home shall be covered with an exterior material
customarily used on site-built residential buildings.
(5)
The home shall have a roof composed of a material
customarily used on site-built residential dwellings, such as fiberglass,
shake, asphalt or tile, which shall be installed onto a surface appropriately
pitched for the materials used.
B.
Structural alteration. Due to its integral design,
any structural alteration or modification of a manufactured home after
it is placed on the site must be approved by the Building Safety Inspector/Zoning
Enforcement Officer of the Town of Holland.
A.
Manufactured home permit.
(1)
No person, firm or corporation being the owner or
occupants of any land or premises within the Town of Holland shall
use or permit the use of said land for placement thereon of a single
manufactured home dwelling without obtaining a permit issued by the
Holland Building Safety Inspector/Zoning Enforcement Officer.
(2)
Applications for a manufactured home permit shall
be available from the Building Safety Inspector/Zoning Enforcement
Officer.
(3)
Applications for a manufactured home permit shall
contain all of the required information and shall be accompanied by
proof of land ownership or ownership in progress.
(4)
No manufactured home permit shall be approved until
the Erie County Health Department provides written approval of the
proposed method and location of the plans for water supply and sewage
disposal.
B.
Certificate of compliance.
(1)
A certificate of occupancy issued by the Building
Safety Inspector/Zoning Enforcement Officer shall be obtained before
any manufactured home may be occupied.
(2)
Prior to the issuance of a certificate of occupancy
the Building Safety Inspector/Zoning Enforcement Officer shall determine
that the manufactured home placed on a lot meets all of the applicable
requirements of this chapter and that the Erie County Health Department
has certified that the sewage disposal and water systems have been
properly installed and meet the minimum operating standards of the
Sanitary Code and pertaining to a manufactured home.
C.
Area and yard size and other requirements.
(1)
Placement of individual manufactured homes must comply
with the minimum area requirements for a single-family dwelling as
established by the codes of the Town of Holland.
(2)
All manufactured homes shall be placed directly upon
a full basement as approved by the Building Safety Inspector/Zoning
Enforcement Officer and complying with all applicable codes of the
Town of Holland.
(3)
No addition shall be made to a manufactured home except
that which meets the requirements of the New York State Building Code
and is approved by the Holland Building Safety Inspector/Zoning Enforcement
Officer.
The construction and occupation of a manufactured home is subject to Chapter 120 of the codes of the Town of Holland.
The following specifications are required of
manufactured homes constructed and occupied within the Town of Holland:
A.
Have at least 960 square feet of space in a double
or multiple-section unit. The exterior measurement as confirmed by
the manufacturer of the home shall not be less than 24 feet in width.
The entire design must be submitted in full as per the manufacturer's
plans, and the square footage may not be created with site built additions.

B.
Be placed on a full basement.
C.
Have utilities connected in accordance with manufacturer's
specifications or the ANSI/NFPA 501 A Installation Standards and New
York Fire Underwriters and Building Codes.
E.
Have roofing materials of a type customarily used
on a site-constructed residence as follows:
