The general location and areal extent of the
following shall be shown on site plan and preliminary plats for land
subdivision in the Queen Anne's critical area:
A.
The location of the critical area boundary and the
critical area designation;
B.
The mean high water line;
C.
The landward edge of tidal wetlands and their areal
extent;
D.
Location of open space, the critical area Buffer,
other Buffer areas, Buffer exemption areas and forested areas;
E.
Slopes of 10% to 15% and slopes of 15% or greater
(show both);
F.
Location and areal extent of all soils exhibiting
the following characteristics as shown in the Queen Anne's County
soil survey:
G.
The location of all contiguous forested areas adjacent
to the site which are linked to forested areas on the site (i.e.,
hedgerows, forest patches or other wildlife corridors);
H.
Location of all habitat protection areas, as designated
in the Queen Anne's County Critical Area Program, on the site;
I.
Location of eroding shoreline reaches, the rates of
erosion, areas where shore erosion measures are in place, areas to
be protected by installation of shore erosion structures and other
proposed erosion abatement approaches;
J.
Areas to be retained in agricultural uses;
K.
Areas proposed for reforestation and afforestation;
L.
Location of all existing or proposed site improvements,
including storm drains, culverts, retaining walls, fences and stormwater
management facilities as well as any sediment and erosion control
structures; and
M.
Total area of the site that will be temporarily disturbed
during development and area that will be permanently disturbed. (“Disturbed”
is defined as any activity occurring on an area which may result in
the loss of or damage to existing natural vegetation.)
In addition to the information required in §§ 14:1-31 and 14:1-32 of this Chapter 14:1 and as appropriate, site plans or preliminary plats shall be accompanied by the following when in the critical area:
A.
A planting and forest management plan for reforested
and afforested areas with the comments of the Maryland Forest Service
(MFS);
B.
A habitat protection plan, including the comments
of the Maryland Fish, Heritage and Wildlife Administration (MFHWA);
C.
An executed cooperators agreement with the Queen Anne's
County Soil Conservation District or farm plan;
D.
A shore erosion protection plan that contains complete
specification for proposed shore erosion work, including information
on design storm, calculated wave runup, required stone weight and/or
data as required by the Department of Planning and Zoning;
E.
A natural park management plan;
F.
Ten-percent pollution reduction calculations; and
G.
An environmental assessment report which provides
a coherent statement of how the proposed development addresses the
goals and objectives of the County Chesapeake Bay Critical Area Program.
At a minimum, the environmental assessment shall include:
(1)
A statement of existing conditions, e.g., amount and
types of forest cover, amount and types of wetlands, discussion of
existing agriculture activities on the site, soil types, topography,
etc.;
(2)
Discussion of proposed development project, including
number and type of residential units, amount of impervious surface,
proposed sewer treatment and water supply, acreage devoted to development,
proposed open space and habitat protection areas; and
(3)
Documentation of all correspondence and findings.
Applications for site plan approval for all
marinas shall also include the following information:
A.
Water depth contours shown at two-foot intervals at
mean low water taken by sounding (unless otherwise specified by the
Office of Planning and Zoning);
B.
Existing and proposed regraded surface of the land;
C.
Location of natural features;
D.
Location of all existing and proposed water-dependent
structures;
E.
Location of all existing or proposed site improvements,
including storm drains, culverts, retaining walls and fences;
F.
Description, method and location of water supply and
sewage disposal facilities;
G.
Mean high and mean low water line;
H.
All existing and proposed piers, buoys, launching
ramps and shore-protection structures;
I.
Location and dimensions of all areas to be dredged,
including present and proposed depths;
J.
Volume of dredged spoil to be removed, type of material
and location and dimensions of disposal area(s), including dikes;
K.
Location of all existing and proposed land-based building
and structures on the site and a description of uses and activities
to be conducted in each;
L.
Location and dimensions of all boat launching ramps;
M.
Location and dimensions of all boat slips and mooring
buoys;
N.
Location of fuel dock and gasoline storage tanks;
O.
Location of all required buffer yards and building
restriction lines; and
P.
An environmental assessment report which indicates
how the proposed project achieves the following criteria:
(1)
That the activities will not significantly alter existing
water circulation patterns or salinity regimes;
(2)
That the water body upon which these activities are
proposed has adequate flushing characteristics at the site;
(3)
That disturbance to wetlands, submerged aquatic plant
beds or other areas of important aquatic habitats will be minimized;
(4)
That adverse impacts to water quality that may occur
as a result of these activities, such as non-point source runoff,
sewage discharge from land activities or vessels or from boat cleaning
and maintenance operations are minimized;
(5)
That shellfish beds will not be disturbed or be made
subject to discharge that will render them unsuitable for harvesting;
(6)
That dredging shall be conducted in a manner, and
using a method, which causes the least disturbance to water quality
and aquatic and terrestrial habitats in the area immediately surrounding
the dredging operation or within the critical area;
(7)
That dredged spoil, except for clean sand for beach
nourishment, will not be placed within the Buffer or elsewhere in
that portion of the critical area which has been designated as a habitat
protection area;
(8)
That interference with the natural transport of sand
will be minimized; and
(9)
That disturbances to aquatic areas of historic waterfowl
staging and concentration areas are prohibited.
