A.
Establishment of Municipal Court. The Municipal Court
for the Town of Boonton previously established pursuant to N.J.S.A.
2A:8-1 et seq. is hereby continued in accordance with the provisions
of N.J.S.A. 2B:12-1 et seq.

B.
Name of Court. The name of the Municipal Court shall
be the "Municipal Court of the Town of Boonton."
C.
Seal. The Municipal Court shall have a seal which
shall bear the impress of the name of the Court.
A.
Municipal Judge; appointment; qualifications; term
of office. There shall be a Municipal Judge of the Municipal Court
who shall be appointed, as provided by law, for a term of three years
from the date of appointment and until a successor is appointed and
qualified.
B.
Compensation of Municipal Judge. The salary of the
Municipal Judge shall be as set forth in the Salary Ordinance to be
paid in the same manner as the salaries of other municipal officers
are paid, and which shall be in lieu of all fees, costs, and any other
allowances whatsoever.[1]

Powers, duties and jurisdiction of Court. The Municipal
Court and the Municipal Judge thereof shall have, possess and exercise
all the functions, powers, duties and jurisdiction conferred by the
provisions of N.J.S.A. 2B:12-1 et seq. as amended and supplemented,
or by any other law.

Location
of Court. The Municipal Court shall be held in the Parsippany Court
House, 3333 Route 46 East, Parsippany, New Jersey 07054. The Municipal
Judge shall sit in accordance with the rules applicable to municipal
courts.

Creation of position of Administrator of the
Municipal Court. There is hereby created the position of Administrator
of the Municipal Court of the Town of Boonton pursuant to N.J.S.A.
2B:12-10. In addition, the Mayor and Board of Aldermen shall provide
for other necessary employees for the Municipal Court and for their
compensation. The Judge of the Municipal Court may designate, in writing,
an Acting Administrator or Deputy Administrator to serve temporarily
for an absent Administrator or Deputy Administrator until the absent
Administrator or Deputy Administrator returns or a new Administrator
or Deputy Administrator is appointed. The Acting Administrator or
Acting Deputy Administrator shall be paid at the rate established
by the Judge but not exceeding that established for the Administrator
or Deputy Administrator.

Creation of position of Municipal Public Defender.
The Mayor and Board of Aldermen may employ attorneys-at-law on a full-time,
part-time or per-case basis to provide for the representation of persons
entitled by law to appointment of counsel. Such person(s) shall be
designated as the Municipal Public Defender(s).
B.
Application
fee. A person applying for representation by the Municipal Public
Defender shall pay an application fee of up to $200. The Municipal
Court may waive the required application fee, in whole or in part,
if the Court determines, in its discretion, that the application fee
represents an unreasonable burden on the person seeking representation.
