A. 
Short title. This chapter shall be known as the "Parking Ordinance of the Town of Boonton."
B. 
Definitions. As used in this chapter, the following terms shall have the meanings indicated:

ANNUAL PARKING PERMIT
A permit issued by the Town which allows the purchaser to park in any long-term parking space for the maximum allowable time without further fees.
COIN-BOX-REGULATED PARKING SPACE
A regulated parking space, which is regulated by a multi-space coin box commonly referred to as an "honor box."
COMMERCIAL PERMIT
Prior ordinances provided for what was termed a "commercial permit." That term and permit are hereby abolished.
ESTABLISHED PARKING TIME LIMIT
The maximum time limit vehicles are allowed to use the regulated parking space during the days and times the regulations are in effect.
FEE
An amount of U.S. currency paid by the user to park in a regulated space.
FREE REGULATED PARKING SPACE
A parking space for which no fee is required, but which has an established parking time limit. Parking of vehicles beyond the established parking time is determined by marking said vehicle and returning when the time limit has expired.
LONG-TERM PARKING SPACE
A regulated parking space with an established parking time limit of 12 hours maximum.
METERED REGULATED PARKING SPACE
A regulated parking space which is regulated by a mechanical or electronic timing device.
MUNICIPAL PARKING LOT
An area operated and maintained by the Town consisting of regulated parking spaces in which a fee may or may not be required from the user.
PARKING METER
A timing device, whether mechanical or electronic, which, upon deposit of the appropriate amount of U.S. currency, or through a preregistered pay-by-mobile device account, provides for use of the regulated space.
PAY-BY-MOBILE DEVICE
A pre-registered account with a Town designated "pay-by-mobile device" provider, whereby user has authorized funds in advance in said account to pay for parking.
REGULATED PARKING SPACE
A designated parking space on a municipal street or in a municipal parking lot, for which a fee may or may not be required to use said regulated parking space and which has a defined maximum time limit for parking a vehicle in that space.
SHORT-TERM PARKING SPACE
A regulated parking space with a maximum established parking time limit of two hours maximum.
USER
A person who owns or operates a motor vehicle and uses a regulated parking space to park said motor vehicle for a period of time after the appropriate fee is paid.
The following parking lots are hereby designated as being within the jurisdiction and area of operation of the Town of Boonton. The parking spaces in these municipal parking lots shall be regulated by appropriate means to determine if the required fee has been paid and the length of time a vehicle has been parked in a regulated space.
A. 
Upper Plane Street Parking Lot: located behind the 800, 900 and 1000 blocks of Main Street.
B. 
Boonton Avenue Parking Lot: located on the 100 block of Boonton Avenue.
C. 
Boonton Avenue Fire House Lot: located on the 300 block of Boonton Avenue. (No fee required.)
D. 
American Legion Parking Lot: located behind the American Legion Building.
E. 
Division Street Parking Lot: located on the 100 block of Division Street. (Special agreement.)
F. 
Bider Parking Lot: located on the 100 block of Cornelia Street.
G. 
Kiwanis Parking Lot: located on the 100 block of Lathrop Avenue.
H. 
Town Hall Parking Lot: located behind the Town Hall. (No fee required.)
I. 
Pepe Field Parking Lot: located at the end of Hillside Avenue. (No fee required.)
The Town of Boonton regulates parking spaces on the following designated streets.
A. 
On the 100 block of Division Street, one side.
B. 
On the 100 block of Mechanic Street, both sides.
C. 
On the 100 block of William Street, both sides.
D. 
On the 100 block of Cornelia Street, both sides.
E. 
On the 100 block of Church Street, both sides.

The owners or operators of motor vehicles with Town of Boonton annual parking permits shall display a current and valid annual parking permit by suspending it from the vehicle's inside rearview mirror, so that the permit can be seen readily from outside the vehicle, when parking said motor vehicle in a long-term regular space only. It shall be presumptive evidence of unlawfully parking of a motor vehicle in a long-term regulated parking space if and when the annual parking permit is not displayed in the appropriate manner described above. However, if the permit holder fails to display the permit, the violation may be dismissed no more than two times per calendar year.
Town of Boonton annual parking permits that have been lost, stolen or mutilated must be reported by the purchaser to the police department in which the loss or theft took place. The purchaser must provide a copy of said police report to the Town of Boonton prior to a replacement permit being issued. Mutilated parking permits must be brought to the Boonton Town Clerk. A fee is required for the replacement of annual parking permits for any reason.
It shall be unlawful for the owner or operator of a motor vehicle to park said vehicle in any regulated parking space during the hours of operation as defined in § 201-46 without first paying the required fee. It shall be unlawful to allow or permit such motor vehicle to remain parked for a longer period than that covered by the fee paid or the free time allowed. It shall be unlawful and an offense for an owner or operator of a motor vehicle to remain in any parking space regulated by a parking meter while the parking meter adjacent thereto is displaying a signal showing that the time allotted for parking in such place has expired.
Upon the expiration of the legal parking time, it shall be the duty of the owner or operator of the motor vehicle to remove forthwith the motor vehicle from the regulated parking space, and it shall be unlawful for any person to cause, allow, permit or suffer any such motor vehicle to be parked or stand overtime or remain therein beyond the parking time limit prescribed by Town of Boonton ordinance or resolution.
It shall be unlawful and an offense for any person to deposit or cause to be deposited in a parking meter any coins for the purpose of extending the parking time beyond the total lawful parking period fixed by the ordinances of the Town of Boonton for the parking space alongside of next to which the parking meter is placed.
It shall be unlawful and an offense for any person to cause any vehicle owned or operated by him to be moved from one regulated parking space to another regulated parking space for the purpose of extending the parking time of said vehicle beyond the established parking time limit. It shall be presumptive evidence when a person moves any vehicle owned or operated by him from one regulated parking space to another regulated parking space which is in close proximity to or in the general area of the original parking space that it is for the purpose to avoid the established parking time limit. This provision is directed at preventing what is commonly termed "feeding the meter" at spaces which are regulated by meters or "car jockeying" at spaces regulated by other means and is enacted to provide for the convenience of legal turnover of regulated parking spaces.

A. 
Installation, control and operation. The Mayor and Board of Aldermen are hereby authorized to provide for the installation, regulation, control, operation and use of parking meters, and to maintain the meters in good workable condition, and is hereby further authorized and empowered to enter into contracts, after approval of the terms and conditions thereof, for the purchase and/or installation of meters, together with extra coin boxes, service kits, extra units, facilitation and maintenance or pay-by-mobile device accounts or other computer devices, and any other necessary accessories. The Mayor and Board of Aldermen are further authorized and empowered to enter into a contract or contracts for such protection and maintenance of such parking meters and systems as may be necessary to maintain the same in good operating condition.
B. 
Each poled parking meter shall be placed or set in such manner as to show or display by a signal facing the street that the parking space adjacent to such meter is or is not legally in use. Each poled parking meter installed shall indicate by proper legend the legal parking time established by the Town, and when activated, shall indicate the duration of the period of legal parking for each payment made and on the expiration of such period, shall indicate illegal or over parking.

It shall be unlawful for the owner or operator of any motor vehicle to park or permit a motor vehicle to remain parked in any regulated parking space longer than 24 consecutive hours.
It shall be unlawful for owners or operators of any motor vehicle to park said motor vehicle outside the painted lines which mark out the regulated parking space on designated streets and in all municipal parking lots. No owner or operator shall park or stand a motor vehicle so as to block or impede the progress of any other vehicle, or access by another vehicle to a vacant parking space, or exit from a parking space occupied by another motor vehicle.
It shall be unlawful for owners or operators to park any motor vehicle larger than a standard size (three-quarter-ton) pickup truck, a standard size van, or to park trailers of any kind, or to park any motor vehicle having dual wheels on any axle or having two or more rear axles, in all of the municipal parking lots or on any property owned by the Town.
It shall be unlawful and an offense for any person to wash, paint, repair or purposely disable a vehicle in any municipal parking lot. However, nothing herein shall be construed to prohibit necessary emergency repairs of a vehicle or prohibit business activities adjacent to the lot.
Vehicles owned by the Town of Boonton or by an officer, employee or person in the service of the Town and displaying appropriate Town identification may park in any space without time limitation, notwithstanding any contrary provisions of this chapter. Use of the parking space at the entrance of the Upper Plane Street lot as designated by a sign shall be restricted to vehicles on official Town business.
Beginning 14 days prior to Christmas Day and continuing through January 1 of the following year, the fees required for metered short-term regulated parking spaces shall be suspended to promote shopping in the retail district. However, during this time, these spaces will remain two-hour-maximum regulated parking spaces. They shall be subject to enforcement by marking of tires or other appropriate means to determine the length of time said vehicle is parked. It shall be unlawful for owners or operators to park any motor vehicle beyond the two-hour maximum in these spaces during this time period. All required fees at metered long-term regulated spaces, or spaces in all municipal parking lots, and time limitations at free regulated spaces shall remain in full force and effect during this time period.

A. 
Parking shall be prohibited in the Boonton Avenue Firehouse parking lot between the hours of 2:00 a.m. and 6:00 a.m., except by on-duty firefighters.
B. 
Boonton Avenue Firehouse parking lot spaces designated for use by Fire Department members shall be used only by on-duty members.
C. 
Parking shall be prohibited in the Pepe field parking lot between the hours of 2:00 a.m. and 6:00 a.m.

Town Hall parking area restrictions. As authorized by N.J.S.A. 39:4-197, the following provisions regulate the parking of vehicles in the parking lot behind Town Hall.
A. 
No person shall park any vehicle which is not an official police vehicle in the following described parking spaces in the Town Hall parking lot: the three parking spaces at the southwest corner of Town Hall adjacent to the police driveway, as designated by pavement markings and signs on the rear of the building.
B. 
No person except those designated officers, employees and officials of the Town of Boonton shall park any vehicle in the following spaces, which are appropriately marked: Trolley (aka Seniors Bus), Town Administrator; the remaining five parking spaces along the north side of the lot as designated by pavement markings and signs.
C. 
Between the hours of 7:00 a.m. and 5:00 p.m., prevailing time, Monday through Friday, no person shall park a vehicle in the Town Hall parking lot unless the operator of such vehicle is conducting official business at Town Hall. Vehicles parking in the Town Hall lot between 5:00 p.m. and 7:00 a.m. must be removed by 7:00 a.m. prevailing time, Sunday through Saturday.
D. 
Town employees on official duty are exempt from the requirements of this section.
Where entrances or exits to municipal parking lots are designated by appropriate pavement markings or signs, no vehicle shall enter or exit the parking area except by using the properly designated entrance or exit and, while in the municipal parking lot, shall take only such course around the parking area as indicated by directional signs.
A. 
In addition to the penalties for violations of this chapter or any other penalty that may be imposed by law for violation of the provisions of this chapter, the Town may remove or have removed any vehicle which is allowed to stand or which is parked in violation of this chapter. In addition, the Police Department shall have the right to remove from any regulated parking space, whether on a street or in a municipal parking lot, any vehicle remaining on any portion of the street or parking lot designated as a parking space after a snow or ice storm, or similar emergency, when the owner or operator of the vehicle has refused or failed to remove the vehicle upon notice by the Police Department, or the owner or operator is unavailable to receive the notice.
B. 
Recovery of vehicle. When a vehicle is so removed from a street or municipal parking lot, the owner of the vehicle, before being entitled to the recovery or possession of the vehicle, shall pay all reasonable charges for towing, storage, and any other expenses incurred in the removal and storage of the vehicle.
Fees for the use of all regulated parking spaces shall not be necessary on the following holidays: New Year's Day, Martin Luther King Day, Presidents' Day, Good Friday, Memorial Day, Independence Day, Labor Day, Columbus Day, Veteran's Day, Thanksgiving Day, Thanksgiving Friday, Christmas Eve and, Christmas Day observed.
It shall be unlawful to tamper with or to deposit therein anything other than U.S. currency or to deface, injure, tamper with, willfully break, destroy or impair the usefulness of, or to open without lawful authority, or to deposit or cause to be deposited any slug, device or substitute for a coin of the United States of America into any parking meter or other currency-accepting equipment owned or operated by the Town of Boonton.
No parking meter authorized herein shall be so installed or a parking meter space so established that it will obstruct the convenient ingress and egress to or from any property abutting on any street.
Various types of currency-collection equipment are utilized to allow users of regulated parking spaces to pay the required fee to park. Police Department shall ensure the collection of the currency received and deposited, pursuant to the provision thereof. The Police Department shall assign or cause to be assigned a competent person to collect the currency received and deposited in the various collection equipment. The person making such collections shall then promptly turn over the contents thereof directly to a banking institution or person authorized by resolution of the governing body to receive the same.
The currency required to be deposited in the regulated parking spaces operated by the Town of Boonton public parking enterprise, as set forth in this chapter, are levied to provide for the cost of regulation and control of traffic on public streets, to provide for the acquisition of proper and adequate parking spaces and facilities so as to relieve congestion or traffic and to cover the cost of purchase, supervision, protection, inspection, installation, operation, maintenance, control and use of parking meters, other equipment and other facilities deemed necessary for the improvement of traffic conditions within the Town of Boonton for the convenience and protection of the public.
A. 
As used in this section, the following terms shall have the meanings indicated:
CAMPING TRAILER, CAMPING CAR and MOTOR HOMES
Any vehicle, whether self-propelled or otherwise, used or intended for use as a conveyance upon the public streets, and so designed, constructed or reconstructed or added to by means of accessories in such manner as to permit the occupancy thereof as a dwelling or sleeping place for one or more persons and having no foundation other than wheels, jacks or skirtings so arranged as to be integral with or portable by the trailer or camp car or actual motor homes.
B. 
Restrictions and prohibitions:
(1) 
It shall be unlawful for any person to park any camping trailer, camp car or motor home on any street in the Town of Boonton for any period longer than two hours.
(2) 
Parking on any premises within Town of Boonton or use as dwelling place: It shall be unlawful for any person to park any camping trailer, camp car or motor home on any public or private premises within the limits of the Town of Boonton, except for the purpose of repair, storage or sale. Any such camping trailer, camp car or motor home shall not, during such period of repairs, storage or holding for sale, be used by any person as a dwelling or sleeping place.
A. 
As used in this section, the following terms shall have the meanings indicated:
TRAILER(S)
A vehicle used to transport any material which is connected to and pulled by a motorized vehicle without which said trailer would be unable to transport itself or the materials contained within.
B. 
It shall be unlawful for any person to park any trailer which is not connected to a motorized vehicle on any street in the Town of Boonton for any period longer than two hours.
C. 
Exemptions: As authorized by the Chief of Police or designee of the Town of Boonton Police Department, and only for a specific purpose and time period.

It shall be unlawful for any person or persons to park any motor vehicle or other vehicle on any public street in the Town of Boonton between the hours of 10:00 p.m. and 6:00 a.m., prevailing time, which during such period there shall be a covering of streets of at least three inches of snow as measured by the Shift Commander of the Boonton Police Department on the walkway in front of the flagpole at Town Hall on the Washington Street side. This parking prohibition shall remain in force during the eight-hour period following the cessation of such precipitation, except as defined below:
A. 
This section shall not apply to duly licensed physicians or visiting nurses of the Town of Boonton making professional calls.
B. 
This section shall not apply to any of the following roads, streets, and highways under the jurisdiction of the county, state, or federal government: Main Street, West Main Street, Myrtle Avenue, Washington Street, Boonton Avenue.
It shall be unlawful for the owner or operator of any motor vehicle or other vehicle to allow said vehicle to remain parked on any street in the Town of Boonton beyond 24 hours after the street has been plowed of snow by snow removal crews. The Police Department is authorized to have vehicles removed upon expiration of the 24 hours and the owner's or operator's failure to remove said vehicle in that time. It shall be presumptive evidence that the vehicle has not moved if it is covered by snow and/or plowed-in with no indication that the vehicle's tires have run through the plowed snow around the vehicle.
Nothing herein contained shall be construed as prohibiting the Town from providing bus stops, taxicab stands, no parking areas, and for matters of similar nature, including the loading or unloading of trucks, vans and other commercial vehicles, by ordinance.

The Town of Boonton Police Department shall be empowered to remove any vehicle parking in violation of this section when the owner or operator of said motor vehicle or other vehicle has refused or failed to remove said vehicle upon notice by the Police Department, or its said owner or operator is unavailable to receive said notice. When a vehicle is so removed from the streets of the Town of Boonton, the owner of said vehicle, before being entitled to the recovery of possession of said vehicle, shall pay all reasonable charges for towing, storage and any other expense incurred in the removal of said vehicle. In addition to the other charges established within Chapter 276, Towing, § 276-4, Fees, the owner of the vehicle shall be liable for the additional fee as provided in Chapter 130, Fees, Article III, General Penalty, if, in the event of an order for the vehicle to be towed or removed, snow must be removed from around the vehicle in order to get access to it.
In shall be unlawful for the owner or operator of any motor vehicle or other vehicle to park in a space designated for the parking of a vehicle with a valid handicap parking permit. Permits can be permanent in the form of hangtags or license plates as well as temporary permits. The Town will honor out-of-state permits as long as said permits are valid in the state of issue. Handicapped parking zones: In accordance with the provisions of N.J.S.A. 39:4-138(o) and N.J.S.A. 39:4-197.5, those parking spaces described in this section shall be designated and established as handicapped parking zones subject to the provisions of N.J.S.A. 39:4-204 et seq., and the applicable regulations:

The Police Department is hereby authorized to issue contractor parking permits for use at regulated parking spaces. Such daily contractor permits shall be valid for one day only; multiple-day permits can be authorized by the Chief of Police or his designee, depending on circumstances. The permit shall be valid for dates noted on the permit by the issuing person. The fee for this parking permit shall be as provided in Chapter 130, Fees, Article III, Fee Schedule. This permit must be placed on the dashboard of the vehicle so that it can be clearly seen by the parking enforcement personnel.
No person shall park a truck, tractor, trailer, semitrailer or omnibus having registered gross weight in excess of five tons or park any motor vehicle equipped with dual wheels on any axle upon any street between the hours of 9:00 p.m. to 6:00 a.m.

A. 
No owner or operator shall park a motor vehicle designed and/or registered for the transportation of any amount of passengers on any street, in any municipal parking lot or on any property owned by the Town of Boonton between the hours of 9:00 p.m. to 6:00 a.m. Examples of vehicles registered for such use include but are not limited to: limousines with OL plates, taxi with taxi plates, vehicles with Livery and T & LC Plates, vehicles with school vehicle plates.
B. 
Vehicles displaying municipal (MG), county (CG) or state (SG) plates or (NF) no-fee plates are exempt from the requirements of this chapter.
Upon the declaration of an emergency, there shall be no parking upon streets or sections of streets or parking lots where temporary emergency no parking signs are displayed. The Chief of Police or the ranking police officer is authorized to declare an emergency and to direct the posting of said emergency "no parking" signs when weather conditions, accidents, fires or public celebrations dictate or require the avoidance of hazards or other conditions which interfere with the free flow of traffic. Timely posting of the emergency "no parking" signs shall serve as notification that the emergency no parking regulations are going into effect. The owner or operator of any motor vehicle or any other vehicle shall comply with the regulation and remove his motor vehicle.

Any unoccupied vehicle parked or standing in violation of this chapter shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any peace officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage which may result from such removal before regaining possession of the vehicle. An additional cost, as provided in Chapter 130, Fees, Article III, General Penalty, shall be imposed where, in the course of removing a vehicle, it is necessary to excavate the snow surrounding a vehicle in order for same to be towed.

In accordance with the provisions of N.J.S.A. 40:60-25.1, there is hereby established and constituted a single publicly owned and operated enterprise called the "Public Parking Enterprise of the Town of Boonton." This enterprise regulates parking spaces within the municipal boundaries on designated streets and in municipal parking lots. The Mayor and Board of Aldermen shall have the exclusive authority to establish daily fees, annual fees, meter rates and penalties as well as the methods used to regulate parking spaces.

The Town of Boonton public parking enterprise shall be in operation between the hours of 8:00 a.m. and 6:00 p.m., Monday through Saturday, except on legal holidays. During these days and times, a fee may or may not be required to park vehicles in designated regulated spaces.
The regulations contained in this chapter shall be enforced by sworn members or specifically trained civilian employees, known as Parking Enforcement Officers, of the Police Department.

A. 
The daily fee for use of a regulated parking space in the municipal lots shall be a deposit of $1 in U.S. currency into the appropriate number slot of the coin box.
B. 
The fee to purchase an annual parking permit shall be $195 through January 31, and thereafter shall be prorated on a monthly basis.
C. 
Meter rates for use of a short-term regulated parking space shall be $0.25 for each 30 minutes to a maximum of two hours, U.S. currency, quarters only.
D. 
Meter rates for use of a long-term regulated parking space shall be $0.25 for each three hours to a maximum of 12 hours, U.S. currency, quarters only.
E. 
Daily permits; contractor permits. The fee for this parking permit shall be $12 per day per vehicle.
F. 
There shall be a replacement fee of $25 for annual parking permits that are lost, stolen or mutilated.

Unless another penalty is expressly provided by New Jersey statute, every person convicted of a violation of § 201-6, overtime parking, or any supplement thereto shall be liable to a penalty of: $35.
A. 
Any person or persons who shall violate any provisions of § 201-29 shall be punished in accordance with the following schedule of fines:
(1) 
For the first offense, to a fine of not less than $35 nor more than $50.
(2) 
For the second offense, to a fine of not less than $75 nor more than $100.
(3) 
For the third and subsequent offense(s), a fine of not less than $100 nor more than $200.
B. 
Only those offenses occurring during a particular winter period (i.e., November through April) shall be counted for the purpose of calculating the number of offenses in order to determine the appropriate fine.
Unless another penalty is expressly provided by New Jersey statute or contained in this chapter, every person convicted of a violation of any provisions of this chapter except §§ 201-6 and 201-29 shall be liable to a penalty of not less than $50 or more than $500 and imprisonment for a term not exceeding 15 days, or both.
This chapter shall take effect on January 1, 2007.
