No street which has heretofore or which may hereafter be dedicated to public use, and which is not an accepted street, shall be improved unless a permit shall have been previously obtained from the Mayor and Board of Aldermen authorizing such improvement.
Before any such street is improved, the owner or developer shall make application, in writing, for a permit, specifying the nature and location of the improvement which is to be made; and shall furnish the Mayor and Board of Aldermen with a letter or other satisfactory evidence showing that the subdivision in which the street is located has been approved by the Planning Board, and six copies of a set of construction plans, drawn by a professional engineer, licensed to practice in the State of New Jersey. The plans shall show the alignment of the streets, center-line profiles of existing ground and proposed finished grades, bench marks, monument to be set when the streets are graded, the proposed location of pavement, sewer, sewer connections, water mains and connections, storm drains, manholes, inlets, curbs at street intersections and at inlets, gas mains and an itemized list on the plans of the quantity of each item to be constructed. The requirement to show sewers and for gas mains on the construction plans may be waived by the Board of Aldermen if one or both of these facilities are not existing in streets, rights-of-way, or other public lands adjacent to the proposed development. Such application shall be accompanied by a surety bond to the Town in form and amount and with surety satisfactory to the Town, conditioned for the improvements of such street in accordance with the requirements of this article.
No street in the Town shall hereafter be accepted as a public street, nor shall any extension of a municipally owned water main or any connection with such water main, or any streetlight, be made or placed therein until the same shall have been improved in accordance with the requirements set forth in the following sections.
All such streets shall be at least 50 feet in width and shall consist of a center portion to be known as the roadway having a width of not less than 34 feet and a sidewalk area on each side of the roadway having a width of eight feet.
The owner or developer shall grade and pave the street in the following manner:
A. 
The grading shall be for an area measured 17 feet at right angles from the center line of the street plus additional grading required for sidewalks and slopes and in accordance with the typical section on file with the Town Clerk and made a part of this article.
B. 
The roadway shall be paved for a width of 34 feet, 17 feet on each side of the center line with a bituminous penetration macadam pavement, three inches thick, on a macadam base course, four inches thick, in accordance with the current specifications of the New Jersey State Highway Department.
C. 
At street intersections, the roadway shall be paved full width within the area of the limits of curb returns.
D. 
Concrete or fieldstone curbs shall be constructed at street intersections for the full length of the arc of the curb returns and in accordance with the specifications of the New Jersey State Highway Department.
E. 
The crown of the roadway and the dimension of the curb shall be as shown on the typical section and details on file with the Town Clerk.
F. 
The location of utilities shall be as shown on the typical section on file with the Town Clerk.
G. 
The size of the storm drains shall be determined by the Town Engineer.
A. 
Prior to improving the roadway, the owner or developer shall lay water mains of the size and class specified by the Town Engineer. The pipe shall be laid at a depth to provide a cover of four feet above the top of the pipe below finished grade. The requirements of the American Water Works Association Tentative Standard Specifications for Installation of Cast-iron Water Mains, and current additions and amendments thereto, shall govern the materials and construction of cast-iron water mains, and such other requirements and specifications as may be determined by the Water Department Engineer and Water Committee for other types of pipe which may be permitted.
B. 
Gate valves shall be as manufactured by R.D. Wood Company or Darling Valve and Manufacturing Company or an approved equal.
C. 
Fire hydrants shall be "Mathews Modernized" Boonton Specifications as manufactured by R.D. Wood Company and shall be painted the prevailing color of other hydrants in the Town.
D. 
All workmanship and materials shall be subject to inspection by a representative appointed by the Board of Aldermen and all inspection fees for either full- or part-time service shall be at the developer's expense.
E. 
The laying of water mains shall constitute a dedication thereof to public use.
Monuments of bluestone, limestone, granite or precast of concrete, four inches by four inches dressed on top, and three feet in length, shall be set in Class C concrete as specified above for a depth of 12 inches. Monuments shall be placed at all corners, angle points, points of curvature and points of tangency, on one side of the street, on the property line and set in such a manner as to make it unnecessary to reset the same in completing the improvements in the street.
The developer shall engage a responsible engineer licensed under the laws of the State of New Jersey as such to set monuments and to set all stakes for grade and lines as shown on the plans submitted for the subdivision of the tract.
Permanent street signs shall be erected at all street intersections in accordance with the approved specifications therefor on file in the office of the Town Clerk at Town Hall.
A. 
All construction work shall be subject to the inspection of the Town Engineer and to such inspectors as the Mayor and Board of Aldermen may appoint for the purpose. The developer shall be required to pay to the Town such amounts as the Town may expend for inspection fees at prevailing rates per diem.
B. 
Any and all materials found to be unsatisfactory or showing faults when tested in a reputable engineering laboratory to be designated by the Mayor and Board of Aldermen shall be removed and not used in such construction.
The requirements hereof shall be considered as minimum requirements for street improvements in the Town, and any action taken by the Mayor and Board of Aldermen under this article shall give first consideration to the welfare of the entire community. However, if the owner or developer can clearly demonstrate by reason of exceptional conditions of his land on account of narrowness, shape or topographical conditions thereof, or because of any other extraordinary situation not of his own making, the strict application of any requirements of this article would result in a peculiar hardship to him, an exception may be granted so as to relieve such difficulty or hardship, provided that the same may be done without substantial detriment to the public good and will not impair the general aims and purposes of this article.
Any person violating any of the provisions of this article shall be liable to the penalty stated in Chapter 1, General Provisions, Article III, General Penalty.
