The following definitions shall have the following meanings as used in this chapter:
HANDHELD LASER POINTER, LASER POINTER, LASER DEVICE OR LASER POINTER DEVICE
Any device that emits light amplified by the simulated emission of radiation that is visible to the human eye.
PUBLIC PLACE
Any street, alley, avenue, boulevard, roadway, highway, cul-de-sac, beach, bay, sidewalk or playground, or public building.
It is unlawful for any person under the age of 18 years old to possess a laser pointer within the City of Brigantine.
It is unlawful for any person in the City of Brigantine to focus, point or shine a laser beam directly or indirectly onto another person in such a manner as to harass, annoy or injure said person.
It shall be unlawful for any person to use a laser pointer in such a manner that the laser beam illuminates a uniformed law enforcement officer, firefighter or emergency services personnel within the City of Brigantine.
It shall be unlawful for any person to use a laser pointer in such a manner that the laser beam illuminates the operator of a motor vehicle within the City of Brigantine.
It shall be unlawful for any person to use a laser pointer in any public place within the City of Brigantine.
It shall be unlawful for any person or business entity to sell or give away as a prize, gift or bonus a laser device to any person under the age of 18 years of age in the City of Brigantine.
If any state law is adopted which is contrary to any provisions of this chapter to the extent of any inconsistency, the state law shall govern and take precedence.
Nothing in this chapter shall make the use of laser devices illegal if used as part of a lawful business, profession or other lawful employment.
Any person guilty of a violation of this chapter may be subject up to a $1,000 fine, 90 days community service or up to 90 days in jail, all as determined in the discretion of the Municipal Court Judge.
