As used in this chapter, the following terms shall have the meanings indicated:
CITY
The City of Brigantine.
DRIVER
Any person issued a taxicab driver's license pursuant to this chapter who operates a taxicab.
LIMOUSINE
Includes any automobile or motor car used in the business of carrying passengers for hire to provide prearranged passenger transportation at a premium fare on a dedicated, nonscheduled, charter basis that is not conducted on a regular route and with a seating capacity of more than 14 passengers in no event, not including the driver, provided that such a vehicle shall not have a seating capacity in excess of four passengers, not including the driver, beyond the maximum passenger seating capacity of the vehicle, not including the driver, at the time of manufacture. Nothing in this chapter contained shall be construed to include taxicabs, hotel buses, buses employed solely in transporting school children or teachers, vehicles owned and operated directly or indirectly by businesses engaged in the practice of mortuary science when those vehicles are used exclusively for providing transportation related to the provision of funeral services, autobuses which are subject to the jurisdiction of the Department of Transportation or interstate autobuses required by federal or state law or regulations of the Department of Transportation to carry insurance against loss from liability imposed by law on account of bodily injury or death. LIMOUSINE OR LIVERY SERVICE
Includes the business of carrying passengers for hire by limousines. (Note: This definition is from N.J.S.A. 48:16-13.)

OPERATION OF A TAXICAB
Transporting in a taxicab one or more persons for hire along any of the streets in this City, accepting a passenger to be transported for hire within the City limits or from a point within the City limits to a point outside of the City limits. The "operation of a taxicab," as above described, by one other than the owner of said cab shall be deemed operation by the owner thereof as well as by the person actually driving said cab.
OWNER
Any person who is the named titled holder of any taxicab registered with the New Jersey Division of Motor Vehicles or who is listed in an application for licensure as the owner of a taxicab in the City of Brigantine.
PERSON
Any individual, partnership, limited partnership, association, corporation, joint venture, lessee, trustee, assigns or receivers, or any other such entity.
STREET
Includes any street, avenue, park, highway or any other public roadway, whether or not the same is improved.
TAXICAB
Any motor vehicle or similar device commonly called a taxi or cab which is duly licensed by the City of Brigantine and engaged in the business of carrying passengers for hire, which is held out, announced or advertised to operate or run, or which is operated or run over any of the streets within the City of Brigantine and which accepts passengers for transportation from points or places within or without said City.
There are hereby established two types of taxicab licenses to be known as "taxicab owner's license" and "taxicab driver's license," which are described as follows:
A. 
Taxicab owner's license. A taxicab owner's license shall be issued to any person who can prove ownership of a vehicle which is intended to be used as a taxicab and whose application for a taxicab owner's license shall be approved pursuant to this chapter. A taxicab owner's license shall entitle the individual licensed motor vehicle equipped as a taxicab to pick up passengers within the City limits and to otherwise be lawfully operated within the City by any individual with a duly authorized taxicab driver's license until either of said licenses either expires or is surrendered, suspended or revoked. A taxicab owner's license shall be transferable to a successor owner by any person who holds said licenses. A separate owner's license is required for each vehicle. The City Council of the City of Brigantine may limit the total number of taxicab owner's licenses to be issued within the City of Brigantine. No such owner's license may be subleased, rented or otherwise used by anyone other than the designated owner. Only the actual owner of the vehicle which is to be used as a taxicab within the City of Brigantine may be the holder of the taxicab owner's license regarding said taxicab.

B. 
Taxicab driver's license. A taxicab driver's license shall entitle the person named therein to operate within this City any taxicab which has been duly licensed hereunder and meets the requirements of this chapter and the provisions of New Jersey State Statute and the New Jersey Division of Motor Vehicles until either of said licenses expires or is surrendered, suspended or revoked. Taxicab driver's licenses shall not be transferable. There shall be no limit to the number of taxicab driver's licenses issued within the City of Brigantine.
A. 
All applications for taxicab owner's licenses shall be in writing, in a form established by the City Manager or his designee and shall contain at least the full name and address, date of birth, social security number and a photocopy of the driver's license of the owner, the serial number, type, color, year and make of the taxicab to be operated pursuant to said taxicab owner's license, the state vehicle registration card, proof of existence of insurance coverage and the number of doors on said vehicle. If the person applying for said taxicab owner's license is a partnership, all partners shall be listed thereon, or, if a corporation, all stockholders holding 10% or more of stock in said corporation shall be listed thereon, or, if a joint venture, all participants shall be listed thereon. All applications shall be filed with the City Manager or his designee who shall, prior to submitting the application to the City Council for approval, receive proof from the applicant that the applicant is at least 18 years of age and a citizen of the United States of America or a lawful resident of the United States. If the applicant is a corporation, such corporation must be organized and existing under the laws of the State of New Jersey and must present proof thereof or, if organized and existing under the laws of another state, be officially authorized to do business in the State of New Jersey and must supply the name and address of a New Jersey registered agent for said corporation. All applications for a taxicab owner's license shall contain a phone number where the applicant can be reached on a twenty-four-hour emergency basis. It is the burden of the applicant to continually inform the City of Brigantine as to any changes in said emergency telephone number.
B. 
Each applicant for a taxi driver's license shall, on a form provided by the City Manager as designated, provide proof that said individual is at least 18 years of age and a citizen of the United States or lawfully a resident of the United States. Each such applicant shall submit a certificate from a licensed doctor in the State of New Jersey, at the applicant's expense, certifying that the applicant has no physical or mental impairment or deficiency which might render the applicant unable to safely operate a taxicab. Said physician certificate shall be presented at the time of the initial application and at each renewal thereafter and shall include but not be limited to a certification that the applicant for a taxicab driver's license has the visual acuity to safely operate a motor vehicle. Any applicant for a taxicab driver's license shall consent to an abstract for said individual being obtained by the Police Department of the City of Brigantine as part of the application review process. The City Manager or his designee reserves the right to give a written test to any applicant, which said test is for the purpose of determining that said individuals are fluent in the English language so as to enable them to communicate with the passengers and to prove they have an adequate knowledge of all City streets and of City and state traffic regulations. There must be furnished with any such application three passport photographs not less than 60 days old which will be attached to the City-issued identification card as further set forth in this chapter. No person shall drive any taxicab in the City until the license to drive the same, as herein provided, is issued to such driver. Further, no owner of a taxicab owner's license shall let any individual operate a taxicab unless said individual has received a taxicab driver's license. It is the responsibility of the applicant for the taxicab driver's license to submit any changes in information contained on the initial registration to the City Manager's designee within 10 days of the date of said change. All applicants for a taxi driver's license must show proof of the intention of a taxi owner licensee to hire said individual at the time of licensure.
C. 
Filing; background investigations; renewal applications.

(1) 
All applications as stated herein shall be filed with the City of Brigantine, which shall assign the responsible entity within the City of Brigantine as the agent of the governing body and City Manager for the receipt of such applications.
(2) 
All applicants for a taxicab owner's license and a taxicab driver's license, and any other person requiring a background check for issuance of taxi or limousine license, shall submit to such background investigations as are designated by this Subsection C, including but not limited to the form of public background investigation established by the New Jersey State Police known as the "live scan" non-criminal-justice fingerprint, background and identification process. Applicants shall pay the fee of the vendor, known at the time of the adoption of this Code as Morpho Trak (Sagem Morpho), or its successor as so designated, for provision of the service. Such fee shall be in addition to the fee or fees specified in the fee schedule of the City of Brigantine.[1]

(3) 
Annual applications for renewal of licenses shall be on file and completed not later than 15 days prior to the commencement of the calendar year. (Temporary note: In the year of adoption of these changes, a later date may be specified due to the availability of the vendor services, giving all parties additional time without penalty to obtain the vendor service now required.) At the commencement of the first full annual year in which this Subsection C is effective, the City of Brigantine shall charge a penalty for late renewal applications in the amount of 25% of the license fee for processing a renewal application after the designated date.
D. 
Limousine licenses as required by N.J.S.A. 48:16-17 shall be issued in a form determined by the Mercantile Official of the City of Brigantine and pursuant to the requirements of such statute.

A. 
Each applicant for a taxicab owner's license shall be accompanied by proof of the issuance of a policy of insurance, with the premium prepaid thereon, written by an insurance company duly licensed to transact business under the insurance laws of the State of New Jersey, which shall be submitted to the City Manager or his designee. The proof of insurance shall name the City of Brigantine as an additional insured, with the provision that notice is to be given to the City in the event of cancellation of the policy for any reason at least 30 days in advance. Such insurance policy must be in the amount of at least $100,000 per each occurrence.
B. 
Such policy shall provide coverage for every driver of each vehicle listed in the policy as well as said vehicles. Issuance of the taxicab owner's license by the City of Brigantine shall constitute an agreement binding between the applicant and the City that the applicant agrees to indemnify and hold the City harmless from any and all claims or damages arising out of personal injury and/or property damage made by third parties as a result of or incidental to the issuance of said license and the operation of any such taxicab. An owner's license may be deemed to have been surrendered on receipt of notice of cancellation of the insurance policy and shall be deemed surrendered if the policy is not renewed or replaced with regard to a particular vehicle within 30 days thereof.
C. 
Insurance requirements for limousines shall be satisfied as required by N.J.S.A. 39:5G-1 and N.J.S.A. 48:16-16 by provision of proof of same to the designated officer prior to issuance of any mercantile license for limousines.

It shall be the responsibility of the holder of any taxicab owner's license and the holder of any taxicab driver's license to inspect each taxicab at the end of every eight-hour shift. At that time, if any articles are found in said vehicle, a report must be made within 24 hours to the Police Chief of the City of Brigantine or his designee that said articles have been lost or otherwise left in said taxicab, and any holder of a taxicab owner's license or a taxicab driver's license shall cooperate with and assist the Police Department of the City of Brigantine in all efforts to determine the true owner of said articles and to return the same to the rightful owner.

The City Council of the City of Brigantine may, in its discretion, refuse to issue or renew or may, after notice and hearing to license holder or applicant for a renewal, revoke or suspend any license issued under the provisions of this chapter if any of the following occur:
A. 
Any applicant has violated any sections of this chapter.
B. 
Any applicant has been convicted of any crime, disorderly persons offense or petty disorderly persons offense in this or any other state.
C. 
Any applicant has been convicted of a violation of Title 39, Motor Vehicles and Traffic Regulations, of the statutes of the State of New Jersey.
D. 
Any applicant has any judgment unsatisfied of record arising out of any automobile accident whether the same involved a taxicab or otherwise.
E. 
Any applicant submits any document which is false or contains misleading information, including any documents submitted as part of an application for an owner's license or as part of an application for a driver's license pursuant to this section or any renewal thereof.
F. 
Any applicant has otherwise not complied with the licensure requirements of this chapter.
G. 
Any applicant has, in any degree, contributed to any injury to a person or damaged property arising out of the negligent operation of any taxicab licensed to said individual pursuant to this chapter.
A. 
No taxicab shall be operated in the City unless and until there is prominently displayed in the interior thereof, within full view of any passengers therein, a complete list of fares, charges or tariff rates charged for the transportation of passengers, which fares, charges or tariff rates so displayed shall be those to be charged to any passengers so transported, and no other fares, rates or tariffs shall be charged. Each taxicab owner shall file a list of fares to be charged with the City Clerk, and no other fares, rates or tariffs shall be charged unless so filed.
B. 
No taxicab at any time shall carry more than five passengers at any time within the City of Brigantine. All proof of insurance as required by this chapter shall include proof that any motor vehicle used as a taxicab in the City of Brigantine is authorized to transport up to five passengers.
C. 
Every driver of a taxicab in the City of Brigantine shall have the right to demand payment of legal fare in advance and may refuse employment unless so prepaid. No driver of such vehicle shall otherwise refuse or neglect to convey any orderly person or persons, upon request, anywhere in the City unless previously engaged or unable to do so. No driver of any such taxicab shall carry any other person than the first passenger employing him, without the consent of said first passenger. Every holder of an owner's license shall require the driver of each taxicab to keep a trip sheet or trip log. The said trip sheet or trip log shall identify the taxicab number, owner's license under which said taxicab is being operated and the license plate number of said taxicab and shall include the time and place when and where a passenger was accepted as well as the time and place of discharge. Said records must be kept for at least a one-year period and shall be open at all times for inspection by any duly authorized law enforcement officer.
A. 
There shall be affixed in every taxicab, in such a manner that the same shall be conveniently read by any person in the taxicab, a card supplied by the City at the time of licensing, at least three inches in height by at least five inches in length, containing the name of the owner, the license number of the vehicle and the year of issuance.
B. 
Every taxicab so licensed shall have on the outside of the taxicab, on both sides thereof, the word "taxi," "cab" or "taxicab" in letters at least four inches in height, as well as a name under which the owner is operating the said vehicle.
C. 
Each driver of a taxicab shall have displayed, in a prominent place in the interior of the taxicab, the individual taxicab driver's license, with a photo of the driver affixed thereto so that the driver is clearly identifiable by the photo identification.
D. 
The holder of any taxicab owner's license shall apply for renewal on January first of each year. If said license renewal is approved, then the City of Brigantine will issue a medallion or insignia which must be placed for external identification on the taxicab for which the taxicab owner's license has been issued or renewed.
Drivers of taxicabs shall not receive or discharge passengers in the roadways, but shall pull up to the right-hand sidewalk as near as possible or, in the absence of a sidewalk, to the extreme right-hand side of the road and there receive or discharge passengers, except upon one-way streets, where passengers may be received or discharged on either the right- or left-hand sidewalk or side of the roadway.

Each taxicab operating within the City of Brigantine shall be inspected as set forth herein by the City Manager or his designee. Said inspection shall insure that each taxicab has a valid, current New Jersey inspection sticker, a current New Jersey registration and current insurance policy which is in effect. The exterior and interior of the taxicab must also be in a clean and neat condition, and the trunk must be capable of securing a passenger’s baggage. Further, all exterior and interior modes of identification and other numbering and lettering required by this chapter must be visible and in place. The inspection of the taxicab shall occur at the time of application for a taxicab owner’s license and at each renewal thereof. In addition, all taxicabs must be free of visible dents, rust and other defects.
A. 
No holder of a taxicab owner's license shall dispatch a taxicab for hire that is not currently licensed or that otherwise does not comply with this chapter.
B. 
No person who does not hold a valid taxicab owner's license shall advertise or otherwise indicate that he is doing business as a taxi company within the City of Brigantine.
C. 
No owner shall dispatch a taxicab unless the driver thereof has a current taxicab driver's license issued by the City of Brigantine and a valid unrevoked driver's license issued by the State of New Jersey.
D. 
No holder of a taxicab owner's license, while performing his duties and responsibilities as a taxicab owner, shall commit or attempt to commit, alone or in concert with others, any act of fraud, misrepresentation, larceny or other criminal violation or otherwise perform any willful act which is against the best interest of the public, even though not specifically prescribed in this chapter.
E. 
No holder of a taxicab owner's license shall knowingly use or permit another to use his taxicab, garage or office of record for any unlawful purpose.
F. 
No holder of a taxicab owner's license or taxicab driver's license shall knowingly conceal any evidence of crime connected with any taxicab, garage or office of record.
G. 
Any holder of a taxicab owner's license or taxicab driver's license issued by the City of Brigantine shall immediately report to the police any attempt to use any taxicab to commit a crime or escape from a scene of a crime.
H. 
Any person holding a taxicab owner's license in the City of Brigantine shall comply with all provisions of this chapter as well as all other laws, rules or regulations governing taxicab owners.
I. 
Any person holding a taxicab owner's license or taxicab driver's license shall inspect the interior of each taxicab immediately after the termination of a shift to ensure that the interior and exterior are in a clean and neat condition.
J. 
No holder of a taxicab owner's license or taxicab driver's license issued by the City of Brigantine shall induce any person to employ him by knowingly misinforming or misleading any such person as to the time and place of the arrival or departure of any taxicab.
K. 
Each holder of a taxicab owner's license and taxicab driver's license issued by the City of Brigantine shall bear the responsibility that all passengers are carried in a safe and responsible manner and shall use the most reasonable and direct route from point of origin to point of destination.
L. 
No holder of a taxicab owner's license or taxicab driver's license issued by the City of Brigantine shall allow the operation of any taxicab unless the same has been equipped to adequately provide for the safety of children under the age of five years who are passengers in any such taxicab. When applying for a taxicab owner's license, each applicant shall provide evidence that he is adequately equipped to provide for said child safety by showing proof of possession of at least one federally approved child safety seat for each taxicab owner's license to be issued. No driver shall operate a taxicab in which a child five years of age or younger is a passenger unless any child 18 months of age or younger is in a car seat, regardless of whether such child is in the front or rear of the vehicle, and any child over 18 months of age and less than five years is in a car seat or is in a lap and shoulder harness in the rear of the vehicle.
M. 
No applicant for a taxicab driver's or taxicab owner's license shall submit any documentation with said application which is fraudulent, misleading or untrue nor shall any such applicant complete the application in a manner which is fraudulent, misleading or untrue.

N. 
Only taxicab vehicles, marked and inspected as such pursuant to this Code, may be utilized in the provision of taxicab service. It shall be a specific violation of this chapter to substitute any other vehicle, whether licensed as a limousine or not, in the provision of taxicab service.

A. 
The annual taxicab owner's license fee shall be as set forth in Chapter 210, Mercantile Businesses, Article II, Fees Schedule, per taxicab. The license shall be effective for a one-year period beginning January 1 and ending December 31 of each year.
B. 
There shall be an administrative transfer fee as set forth in Chapter 210, Mercantile Businesses, Article II, Fees Schedule, for transfer of any taxicab owner's license.
C. 
There shall be an administrative fee as set forth in Chapter 210, Mercantile Businesses, Article II, Fees Schedule, for the issuance of a taxicab owner's license for a vehicle replacing that originally licensed. In addition, the actual cost of replacement of any medallion or insignia issued by the City of Brigantine shall be charged.
D. 
The annual taxicab driver's license shall be as set forth in Chapter 210, Mercantile Businesses, Article II, Fees Schedule.
A. 
Every person or persons, firm or corporation found guilty in a municipal court of competent jurisdiction of violating any of the provisions of this chapter shall be liable to pay a fine of not less than $50 nor more than $1,000 or be imprisoned for a period not to exceed 90 days, or both. Each succeeding day of violation may be construed as a new violation.
B. 
One violation of this chapter in a period of one year may entitle the City Council of the City of Brigantine to hold a hearing to determine whether any taxicab owner's license should be suspended, revoked or forfeited.

Nothing in this chapter shall be construed to exempt any person, firm or corporation owning or operating a taxicab from complying with the laws relating to the ownership, regulation and operation of automobiles in the State of New Jersey.
No application for a taxicab owner's license or a taxicab driver's license shall be submitted to the City Council for approval until such time as the applicant has completed all application materials and has executed a form of consent and release so as to permit the Chief of Police or any designated member of the City of Brigantine Police Department to conduct such investigation of criminal and driving records as may be required in order to determine that the applicant substantially complies with the meaning, intent and purpose of this chapter.

In the event that a taxicab is being operated by a person who does not have a taxicab driver's license as required by this chapter, both the driver and the owner of the taxicab shall be subject to the penalty provisions as set forth in this chapter. In the event that any vehicle is operated as if it is a taxicab or is used in violation of the terms and conditions of this chapter, both the driver and the owner of the vehicle shall be subject to the penalty provisions as set forth in this chapter. If any driver of a taxicab is convicted of driving while intoxicated while driving a taxicab, in addition to the penalties as set forth in this chapter, the individual so charged shall lose his right to obtain a taxicab driver's license in the City of Brigantine for a period of 10 years, and the taxicab owner's license for said vehicle shall be revoked and/or suspended by the City Council of the City of Brigantine.

The City of Brigantine will issue no more than six taxicab owner's licenses pursuant to this chapter. No more than 50% of said owner's licenses may be owned and operated by any one person. For the purpose of this section, an applicant will be considered the same person as a holder of an existing owner's license if said applicant is the same person, or the applicant is a corporation or other business entity that has, as an officer, agent stockholder, director or partner, a person who already holds a valid and existing taxicab owner's license, or the applicant is a corporation or other business entity that has any of the same officers, agents, stockholders, directors or partners as a corporation or other business entity that has been issued a valid existing taxicab owner's license.

A. 
Where any surrendered, revoked or suspended taxicab owner's licenses is offered for resale by the City, the applicant shall pay the taxicab owner's license fee then in effect. No deduction shall be given for any portion of any year which may have expired at the time of the application for said taxicab owner's license. The City Council of the City of Brigantine shall either approve or deny all sales, transfers and renewals of taxicab owner's licenses. Whenever a license is surrendered or revoked so that the City Council of the City of Brigantine comes into possession of the same, the City Council shall have the option of retiring said license so that the same may not be used in the future or holding an auction for said license and awarding the same to the highest bidder after the receipt of sealed bids at a regularly scheduled and announced bid opening. The minimum bid for such license shall be established by the City Council but in no event shall be less then the than existing taxicab owner's fee.
B. 
If any taxicab owner's license is inactive for a period of 60 days after its issuance, it shall be deemed to have been surrendered to the City Council. An inactive license is one which is issued but for which no cab is operating within the City of Brigantine or for which no vehicle is licensed or for which no vehicle is insured or for which no vehicle otherwise complies with this chapter for a period of 60 days.

Any motor vehicle operating in the City of Brigantine which has a livery tag must contain within said vehicle at all times a trip sheet or trip log indicating the time and place where passengers have been picked up and dropped off. Any such livery vehicle may only transport passengers which have previously made arrangements, which are prearranged as opposed to immediate hire (as if for taxi service), from a designated place to another designated place for a prearranged set fee. Any livery vehicle providing services in violation of this section or otherwise operating in the ordinary course of business as a taxicab shall be in violation of this chapter.
Each holder of a taxicab owner's license must have all the taxicabs owned and operated by said person one uniform color. All the taxicabs owned by any person and operated in the City of Brigantine must be the same color as all other cabs owned by said person and operated in the City of Brigantine.

Each person or entity that operates taxicabs in the City of Brigantine may not have its dispatching operations located at or otherwise operate out of a residential property. Any dispatching operations located in the City of Brigantine must be in a permissible commercial district within the City of Brigantine. Any and all taxicabs which are operated in the City of Brigantine and which shall be parked in the City of Brigantine must be parked in an adequate off-street parking area located within a permissible commercial zone within the City of Brigantine. Nothing in this chapter shall prohibit a taxicab validly licensed in the City of Brigantine from being dispatched within the City of Brigantine but being parked and/or stored in another municipality.
Any vehicle operating under the designation "medical livery" within the City of Brigantine may only transport patients who have any type of illness or disease, and then may only transport said patients from one medical facility to another or from said individual's place of residence to a medical facility, and may in no way act as a taxicab or delivery service.

No taxicab of any nature, whether licensed by the City of Brigantine or otherwise, shall be parked on or in any street, boulevard, avenue, road, highway, cul-de-sac, alley or other area of public travel within the City of Brigantine except for the purpose of picking up or dropping off passengers. This section is specifically intended to prevent the parking of taxicabs in the City of Brigantine in any district, whether it be residential or commercial, except for the stated purpose of picking up or dropping off passengers.

Temporary licenses for taxicabs shall be issued during the New Year's holiday under the following conditions:
A. 
Said temporary taxicab licenses shall only be issued to taxicab companies located in the City of Brigantine and actively conducting business within the City of Brigantine in compliance with the City of Brigantine Code § 270-1 et seq.
B. 
There shall be no more than three such temporary licenses issued to each such taxicab business which is licensed and actively conducting business within the City of Brigantine.
C. 
Said temporary licenses shall be valid ONLY from 12:00 noon on December 31 of the year said licenses were issued until 12:00 noon of the following day.

D. 
Any taxicab company seeking to receive a temporary license for the time period as set forth above must make an application to the Brigantine Police Department in a form designed by said Police Department and approved by the City Manager of the City of Brigantine no later than December 15 of the year for which said licenses are applied.
E. 
There shall be an administrative cost for the issuance of said licenses and the processing of said applications of $25 per each temporary license sought.
F. 
In order to be eligible to receive a temporary license for a taxicab, proof must be presented satisfactory to the Brigantine Police Department that such taxicab vehicle is covered under the insurance policy maintained by said taxicab company pursuant to § 270-4 of the Code of the City of Brigantine.
G. 
Prior to the Police Department issuing any temporary license for a taxicab, said taxicab must complete and pass the inspection required by § 270-10 of the Code of the City of Brigantine.
H. 
Said taxicabs operated pursuant to a temporary license for the New Year's holiday shall only be operated by individuals who hold a valid, current taxicab driver's license issued by the City of Brigantine.
I. 
All requirements contained in the Code of the City of Brigantine, as set forth in § 270-1 et seq., shall be applicable to all drivers and taxicab vehicles operated pursuant to any temporary license issued by the City of Brigantine.
J. 
Any taxicab company operating a taxicab pursuant to a temporary license other than on the dates and times as set forth above shall be subject to the penalty requirements of § 270-13 of the Code of the City of Brigantine, and said taxicab company shall further forfeit the right to ever receive a temporary license in the future.
K. 
To the extent that an actual physical temporary license is issued, the same must be returned to the Brigantine Police Department no later than January 3.
