For the purpose of this chapter, the following definitions shall apply:
FLEA MARKET
A sale of items of new or used tangible personal property, wherein on one location there are multiple outdoor vendors occupying a space allotted to each such vendor for the purpose of displaying and selling items of tangible personal property.
LICENSE
A license issued by the Monroe Township Clerk in the manner prescribed by this chapter for the operation of a flea market.
SELLING AREA
The total space area utilized outdoors for the purpose of displaying and selling items of tangible personal property, including aisles, common areas, rest room facilities, cooking facilities and parking areas.
A. 
No person, company, firm or corporation may conduct or operate a flea market, as hereinafter defined, without first obtaining a license and having paid the license fee hereinafter prescribed.
B. 
No license fee shall be paid by a bona fide charitable, religious or other nonprofit organization; subject, however, that said fee shall be waived for any such organization not more than three times during any calendar year.
A. 
An application for a license shall contain the following information:
(1) 
The name and address of the applicant.
(2) 
The street address and location of the flea market, together with a site plan or other drawing describing the licensed premises.
(3) 
A description of the type or types of articles and merchandise to be sold.
(4) 
The signature of the applicant or his or her duly authorized agent.
(5) 
A statement as to whether the license is for one day, one week, one month or one year.
(6) 
Such other information as the township may from time to time reasonably require.
B. 
The applicant shall file the aforementioned information with the Township Clerk.
A. 
The license fee which shall be charged by the Township Clerk for the issuance of a license hereunder shall be:

(1) 
Per year: as set forth in Chapter 74, Fees.
(2) 
Per month: as set forth in Chapter 74, Fees.
(3) 
Per week: as set forth in Chapter 74, Fees.
(4) 
Per day: as set forth in Chapter 74, Fees.
B. 
Any license referred to in Subsection A above may be extended for an additional term, provided that application is made no later than the day following expiration of said license, at a rate of 50% of the license fee set forth above for said term.
The Township Clerk shall issue the license requested upon receipt of the following:
A. 
A completed application as set forth above.
B. 
Payment of license fee as set forth above.
C. 
A letter from the Monroe Township Zoning Officer certifying that the applicant has complied with all requirements of Chapter 175 of the Monroe Township Code, entitled "Land Management," together with any other provisions of the Monroe Township Code regulating the business contemplated by the applicant. When necessary, the applicant will have received site plan approval or waiver of site plan approval from the Monroe Township Planning Board, which approval shall become part of the license to be issued and any conditions of the approval shall be incorporated by reference.
A. 
The enforcement of this chapter shall be the responsibility of the Zoning Officer of the Township of Monroe or his designee.
B. 
Any person, company, firm or corporation or agent thereof violating any of the provisions of this chapter shall be subject to a fine of not less than $250 nor more than $1,000.
C. 
Each and every day that any violation continues after notification that such violation exists shall constitute a separate offense. Such notice shall be issued by the Monroe Township Zoning Officer and shall be hand delivered or served by certified mail.
D. 
In addition to the aforementioned penalties and punishment, Monroe Township may also maintain an action or proceeding in any court of competent jurisdiction to compel compliance with or to restrain by injunction any violation of this chapter.
