A. 
All commercial establishments and multifamily dwellings or other users of trash containers commonly called "dumpsters," whether or not the units are dumped into a vehicle that comes to the site or are removed to a disposal area on a vehicle used for that purpose, shall be subject to the requirements of this chapter.
B. 
"Commercial user" shall be defined pursuant to § 175-11, and "multifamily user" shall be any apartment complexes, townhouses, condominiums or similar areas where large trash containers are used.
All trash containers in use in commercial or multifamily areas shall be watertight containers that can be covered to prevent access to the refuse by rodents, birds, animals or insects.
All trash containers shall be surrounded on three sides by a fence or wall which shall be designed to prevent the scattering of debris outside of the enclosure by natural conditions (wind, water, etc.) and by rodents, animals, birds and insects. The fence or wall shall be not less than five nor more than eight feet in height and maintained in good condition. A wall of an adjoining building may serve as one side. The opening in the wall or fence shall be located so as to prevent the visual display of refuse from any adjacent parking area or street and shall be equipped with a gate which can be closed when the container is not being loaded or unloaded. All such areas shall be screened, where appropriate, by vegetation or other method to make it visually pleasing.
The area created by the fencing and wall shall be kept free of debris, and no accumulation of garbage and refuse shall be permitted outside of the container.
Any person who shall violate any provision of this chapter shall, upon conviction, be subject to a penalty of not less than $100 and not more than $500 for each violation. Every twenty-four-hour period of said violation, after notice thereof from the Monroe Township Board of Health or its authorized representative, shall be deemed to be a separate offense and punishable as aforesaid by said fine.
