[HISTORY: Adopted by the Board of Commissioners (now Council) of the Town (now Township) of Montclair 4-15-1980 by Ord. No. 80-12 as Ch. 55 of the 1979 Code. Amendments noted where applicable.]
A. 
It is hereby found and determined that the project is a blighted area and qualifies as an eligible project area under the provisions of Chapter 306 of the Laws of 1949 (N.J.S.A. 40:55C-1 et seq.).[2]

B. 
The urban renewal plan for the project, having been duly reviewed and considered, is hereby approved, and the Municipal Clerk is hereby directed to file said copy of the urban renewal plan with the minutes of this meeting.
C. 
It is hereby found and determined that the objectives of the urban renewal plan cannot be achieved through rehabilitation of the project area.
D. 
It is hereby found and determined that the urban renewal plan for the project area conforms to the general plan of the Township of Montclair.
E. 
It is hereby found and determined that the financial aid provided and to be provided pursuant to the contract for federal financial assistance pertaining to the project is necessary to enable the project to be undertaken in accordance with the urban renewal plan for the project area.
F. 
The redevelopment of the urban renewal area for predominantly nonresidential uses is necessary for the proper development of the community.
G. 
It is hereby found and determined that the urban renewal plan for the urban renewal area will afford maximum opportunity, consistent with the sound needs of the Township of Montclair as a whole, for the urban renewal of the area by private enterprise.
H. 
It is hereby found and determined that the urban renewal plan for the urban renewal area gives due consideration to the provision of adequate park and recreational areas and facilities, as may be desirable for neighborhood improvement, with special consideration for the health, safety and welfare of children residing in the general vicinity of the site covered by the plan.
I. 
It is hereby found and determined that the program for the proper relocation of individuals and families displaced in carrying out the project in decent, safe and sanitary dwellings in conformity with acceptable standards is feasible and can be reasonably and timely effected to permit the proper prosecution and completion of the project; and that such dwellings or dwelling units available or to be made available to such displaced individuals and families are at least equal in number to the number of displaced individuals and families, are not generally less desirable in regard to public utilities and public and commercial facilities than the dwellings of the displaced individuals and families in the project area, are available at rents or prices within the financial means of the displaced individuals and families and are reasonably accessible to their places of employment.
J. 
In order to implement and facilitate the effectuation of the urban renewal plan hereby approved, it is found and determined that certain official action must be taken by this body with reference, among other things, to change in zoning, the vacating and removal of streets, alleys and other public ways, the establishment of new street patterns, the location and relocation of sewer and water mains and other public facilities, and other public action, and, accordingly, this body hereby:
(1) 
Pledges its cooperation in helping to carry out the urban renewal plan.
(2) 
Requests the various officials, departments, boards and agencies of the Township of Montclair having administrative responsibilities in the premises likewise to cooperate to such end and to exercise their respective functions and powers in a manner consistent with the urban renewal plan.
(3) 
Stands ready to consider and take appropriate action upon proposals and measures designed to effectuate the urban renewal plan.
K. 
Additional financial assistance under the provisions of Title I of the Housing Act of 1949, as amended, is necessary to enable the land in the project area to be renewed in accordance with the urban renewal plan for the project area, and, accordingly, the filing by the local public agency of an application or applications for such financial assistance under Title I is hereby approved.
L. 
The revised urban renewal plan, as approved by HUD on May 20, 1976, and certified favorably by the Montclair Planning Board, is hereby approved by the Township Council. A copy of said revised plan is annexed hereto.

DESCRIPTION
BEGINNING at the point of intersection of the southwesterly right-of-way of Bloomfield Avenue and the Glen Ridge boundary and running thence northwesterly along the southwesterly right-of-way line of Bloomfield Avenue to its point of intersection with the extension of the western right-of-way line of Lackawanna Plaza; thence northerly along the western right-of-way line of Lackawanna Plaza to its point of intersection with the extension of the northern right-of-way line of Greenwood Avenue; thence northeasterly along the northern right-of-way line of Greenwood Avenue to its point of intersection with the northeasterly right-of-way line of Glenridge Avenue; thence southeasterly along the northeasterly right-of-way line of Glenridge Avenue to its point of intersection with the Glen Ridge boundary; thence southwesterly along the Glen Ridge boundary to the southwesterly right-of-way line of Bloomfield Avenue and the point of beginning.

Editor's Note: A lengthy preamble identifies the "project" as the "Lackawanna Plaza Urban Renewal Project, N.J.R. — 158." The area encompassed by the project is described in Exhibit A, which is attached at the end of the chapter.
The preamble also identifies the Montclair Redevelopment Agency as the "local public agency," the Township of Montclair as the "locality" and the Board of Commissioners (now Council) of the Township of Montclair as the "Township Commission."
The preamble recognizes the need for urban renewal in the project, that application has been made to the Secretary of Housing and Urban Development under the Housing Act of 1949, and that it is necessary for the urban renewal plan to be approved by the governing body of the locality.
