GENERAL REFERENCES
Vehicles and traffic — See Ch. 327.
As used in this chapter, the following terms shall have the meanings
indicated:
Any device upon which a person may ride propelled wholly or in part
by human muscular power and having two tandem wheels, either of which is 20
inches or more in diameter.
A.
No person residing in the Township shall operate a bicycle
upon any public street or other public place within the Township unless such
bicycle has been registered with the Police Department, as evidenced by a
registration certificate, and a license tag is attached to such bicycle, as
provided in this chapter.
B.
No person engaged in the business of renting bicycles
for hire in the Towship shall rent or offer for rent any bicycle which has
not been registered and which does not have attached thereto a valid license
tag pursuant to this chapter.

A fee of $1 shall be paid for each registration. No registration certificate and license tag shall be issued unless the registration fee shall have been paid, except as otherwise provided in § 93-10.

Applications for bicycle registration certificates and license tags
or for transfers thereof shall be made to the Police Department on a form
approved by the Chief of Police and shall be accompanied by the prescribed
registration fee. Such application shall set forth the name and address of
the owner, a description of the bicycle, the name of the manufacturer and
the serial number appearing on the frame of the bicycle.
The Chief of Police shall cause an inspection to be made of each bicycle for which an application is made under § 93-4. If the Chief finds that the application states correctly the required information and that the bicycle is in a safe mechanical condition, he or she shall issue to the owner of the bicycle a registration certificate and a license tag.
A.
Every registration certificate shall be numbered in sequence
and shall set forth the name and address of the owner of the bicycle and the
serial number appearing on the frame of the bicycle.
B.
Each license tag shall bear the legend "Montclair, N.J.
Police Department," the phrase "Bicycle License" and the date of expiration
of the registration certificate. License tags shall be numbered in sequence,
and the number thereon shall correspond to the number on the registration
certificate issued for such bicycle.
The license tag shall be firmly attached to the rear mudguard or frame
of the bicycle in such position as to be plainly visible from the rear.
All registration certificates and license tags shall expire on May 31 of each year. They shall not be transferable except as provided in § 93-10.
Each person who sells, transfers ownership of or permanently dismantles
any bicycle registered pursuant to the provisions of this chapter shall make
a report thereof and shall surrender the registration certificate and license
tag to the Police Department within 10 days thereafter. Where the bicycle
has been sold or ownership transferred, the report shall include the name
of the person to whom such sale or transfer was made.
Where the owner of a registered bicycle surrenders the registration certificate and license tag pursuant to the provisions of § 93-9, he or she may, upon application, obtain the transfer of said certificate and tag to another bicycle owned by him or her for the balance of the unexpired term without the payment of any additional fee, provided the application for transfer and the substituted bicycle comply with the provisions of § 93-5.
Each person engaged in the business of selling new or secondhand bicycles
shall make a report to the Police Department of every bicycle purchased or
sold by him or her within 10 days after such purchase or sale, giving the
name and address of the person from whom purchased or to whom sold, a description
of said bicycle by name or make, the serial number appearing on the frame
thereof and the number of the license tag, if any, attached thereto.
The Police Department shall keep a record of the registration of all
bicycles, including the number of each registration certificate and license
tag issued, the date of issuance, the name and address of the person to whom
issued and the name or make and the serial number on the frame of the bicycle
for which issued.
A.
No person shall remove, destroy, mutilate or alter any license tag during the period for which it was issued, except that a license tag may be so removed for the purpose of surrendering the same to the Police Department in the event of sale or transfer of ownership or dismantling as provided in § 93-9.
B.
No person shall willfully or maliciously remove, destroy,
mutilate or alter the serial number on the frame of any bicycle registered
pursuant to this chapter.

Any person who violates any provision of this chapter shall, upon conviction
thereof, be punished by a fine not exceeding $2,000, imprisonment in the county/municipal
jail for a term not exceeding 90 days, or a period of community service not
exceeding 90 days, or any combination thereof as determined by the Municipal
Court Judge. Each day on which a violation of an ordinance exists shall be
considered a separate and distinct violation and shall be subject to imposition
of a separate penalty for each day of the violation as the Municipal Court
Judge may determine.
