The Township is hereby authorized and directed to establish and operate the Lloyd Road Parking Lot as a municipal parking lot in conjunction with the Montclair Kimberley Academy pursuant to an easement agreement between the Township and the Montclair Kimberley Academy.

A. 
The Lloyd Road Parking Lot shall consist of 57 spaces.
B. 
Subject to any limitations contained in the easement agreement referred to in § 230-37, the Township shall be entitled to issue permits for, and develop other regulations governing the use of, the five northernmost spaces in the Lloyd Road Parking Lot, on such terms and conditions established by the Township.
C. 
From 7:30 a.m. to 5:30 p.m. on weekdays, the remaining 52 spaces shall be for the exclusive use of vehicles with valid decals issued by the Montclair Kimberley Academy. From 2:00 a.m. to 5:00 a.m., these spaces may only be used by vehicles with valid night permits issued by the Township pursuant to § 230-5I. The Montclair Police Department may be contacted for any overnight exceptions. At all other times, these 52 spaces will be available on a first-come-first-serve basis. A night permit shall be issued annually or semiannually to any person who completes and files with the Township the required application and fee.

It shall be unlawful for any person to cause, allow or permit any vehicle registered in his or her name or operated by such person to park in the Lloyd Road Parking Lot between the hours of 2:00 a.m. and 5:00 a.m. of any day, or during any other time periods established by the Township, without a valid permit properly affixed to said vehicle.

It shall be unlawful for any person to cause, allow or permit any vehicle registered in his or her name or operated by such person to park in the Lloyd Road Parking Lot between the hours of 7:30 a.m. and 5:30 p.m. of any day without a valid parking permit issued by the Montclair Kimberley Academy, except in the five northernmost parking spaces regulated by the Township pursuant to § 230-38B. This limited exclusive use is being granted in consideration of the Montclair Kimberly Academy granting an easement to the Township of Montclair of sufficient land owned by it to create the Lloyd Road Parking Lot and its expenditure of money to pave, maintain and provide insurance for the lot as set forth in the easement agreement.

Any person who violates any provision of this article shall, upon conviction thereof, be punished by a fine not exceeding $2,000, imprisonment in the county/municipal jail for a term not exceeding 90 days, or a period of community service not exceeding 90 days, or any combination thereof as determined by the Municipal Court Judge. Each day on which a violation of an ordinance exists shall be considered a separate and distinct violation and shall be subject to imposition of a separate penalty for each day of the violation as the Municipal Court Judge may determine.
