Township of Montclair, NJ Parking, Standing and Stopping

No person shall park a vehicle upon any dead-end street when the width of the roadway does not exceed 22 feet. A dead-end street is defined as a street that provides property access only, with only one means of access or egress, i.e., no through traffic.

§ 327-15 Overnight parking.

Overnight parking is prohibited except as provided in the schedule below. Where prohibited, no person shall park a vehicle on any street between the hours of 2:00 a.m. and 5:00 a.m. of any day, except physicians on emergency calls. Signs shall be posted at the Township limits.

Parking permits pursuant to this section shall be issued to an applicant who has certified in writing to the Township Clerk that he or she is a resident of a property which abuts a street designated in the schedule in Subsection A for overnight street parking, other than on South Fullerton Avenue, and that there is no place on such property for the overnight parking of his or her vehicle. A permit issued pursuant to this section shall entitle the holder thereof to park overnight only on the street which is abutted by his or her property, except in the case of Roosevelt Place residents who may apply for such permits and who shall utilize thereafter the overnight parking area provided for on South Fullerton Avenue and Roosevelt Place in accordance with the schedule in Subsection A. No more than one permit shall be issued to residents of the same household. The Municipal Clerk may revoke a permit upon proof that the certification made on issuance is no longer valid.

The fee for the permit shall be the same as that charged for a night permit issued in accordance with the Code of the Township of Montclair, Chapter 230, Parking Lots.

The permit issued pursuant to this section shall entitle the holder to park on the streets, except in prohibited areas, in the manner set forth in Subsection B above and in all Township of Montclair parking lots which permit overnight parking.

Any vehicle which is found by the Police Department to be parked without a valid permit in an area designated in the schedule in Subsection A hereof, contrary to the provisions of this section, may be towed and removed by the police and all costs of such towing, removal and storage shall be paid by the owner of the vehicle.

Notwithstanding the foregoing provisions of this section, Township residents may purchase from the Township overnight parking permits for the sum of $5 per night. Overnight parking permits shall be in the form of scratch-off hangtags, or such other form determined by the Township, and each permit shall allow the permit holder to park an automobile on any street in the Township during the hours of 2:00 a.m. through 5:00 a.m., except on those streets where parking is prohibited under § 327-16 or any other provision of the Township Code.

The Township Council may, by resolution, designate any street, or a portion of any street, to which the provisions of Subsection F, regarding overnight parking permits, shall not apply. Any such resolution shall take effect upon at least 10 days' advance notice to all property owners whose properties abut the street or section of the street which is the subject of the resolution.

Notwithstanding any other provision of this article, the minimum penalty for violation of Subsection A of this section is $35 for the first offense, $70 for the second offense, and $140 for the third and subsequent offenses. In determining whether an offense is a second, third or subsequent offense, only prior offenses that occurred within one year of the current offense shall be considered.

§ 327-15.1 Temporary overnight parking permits.

Upon written application by the owner or managing agent of property used for residential purposes, the Township may issue temporary overnight parking permits, for a period not to exceed 90 days, for use by the owners and/or occupants of said property when on-site parking shall be temporarily unavailable due to construction activities or emergency conditions occurring on or relating to the property.

Temporary parking permits may be issued by the Township pursuant to this section upon the filing by the owner or managing agent of a written application, in a form provided by the Township, which shall include the following information certified by the owner or managing agent:

(1)

The name and address of the property owner;

(2)

The address of the subject property;

(3)

The number of parking spaces located on the subject property;

(4)

The number of on-site parking spaces which will not be available to residents as a result of temporary construction activities on the property;

(5)

A description of the construction activities to be performed on the property and the time period during which said activities will occur, or a description of the emergency condition which causes on-site parking to be temporarily unavailable and the time period during which said condition is expected to exist;

(6)

The number of temporary parking permits requested;

(7)

A list of the requested permit holders by name and vehicle information (make/model and license plate number);

(8)

A certification by the owner or managing agent that there are no other areas to park vehicles on the property during construction or the emergency condition; and

(9)

Such other information as the Township may require to process said application.

Upon review of a completed application authorized in accordance with Subsection B, the Township may issue temporary overnight parking permits to the owner or managing agent, for use solely by occupants of the property for a period not to exceed 90 days, subject to the following conditions:

(1)

The number of permits issued shall not exceed the number of parking spaces on the property which will not be available due to construction activities or an emergency condition occurring on or relating to the property.

(2)

Parking permits shall not be issued if public parking is available within 500 feet of any boundary line of the subject property.

(3)

Parking permits may only be issued to the owner or managing agent of the property upon payment by said owner or managing agent of the following fee: $72 per permit for each ninety-day period or part thereof.

(4)

Permits shall not be issued for any time period longer than the anticipated period of construction on the property or the existence of the emergency condition, as determined by the Township.

A permit issued pursuant to this section shall entitle the permit holder to park overnight only on the designated street or streets abutting the subject property.

The Township may revoke any permit issued pursuant to this section upon proof that:

(1)

Any information provided in the written application was materially false or misleading or is no longer valid;

(2)

A certificate of occupancy or certificate of approval has been issued by the Construction Code Official on the construction project has otherwise been completed or abandoned; or

(3)

The emergency condition which was the basis for issuance of the permit no longer exists.

Permits issued pursuant to this section may be renewed for an additional period, not to exceed 90 days, upon the filing of a renewal application by the owner or managing agent which shall contain the same information required in the original application. In no event shall permits be issued for more than a total of 180 days.

All permits shall be in the form of decalcomania stickers and shall contain all essential information, including, without limitation, the type of permit, the period for which the permit is issued and the license plate number of the motor vehicle for which it is issued. Each permit shall be affixed as a decalcomania to the motor vehicle for which issued upon the inside of the rear passenger side window.

Parking permits issued pursuant to this section shall be nontransferable.

Any person who knowingly files an application for a temporary parking permit pursuant to this section which contains information which is false or misleading in any material respect shall, upon conviction thereof, be subject to a fine not exceeding $1,250 or imprisonment for a term not exceeding 15 days.

§ 327-15.2 Overnight parking of commercial vehicles.

Notwithstanding any other provision of the Township Code, no person shall park a tractor-trailer or a commercial vehicle with a gross weight in excess of 10,000 pounds on any street in the Township of Montclair between the hours of 9:00 p.m. and 6:00 a.m. No overnight parking permit shall be issued pursuant to §§ 327-15, 327-15.1 or any other provision of the Township Code for a tractor-trailer or any commercial vehicle with a gross weight in excess of 10,000 pounds. "Tractor-trailer" shall mean a tractor or trailer, or a connected tractor and trailer, regardless of gross weight.

Violations and penalties. Any person who violates this section shall, upon conviction thereof, be punished by a fine not exceeding $2,000. The court shall impose a minimum fine of $100 for a first violation of this section and a minimum fine of $500 for any subsequent violation.

§ 327-16.1 Emergency vehicle parking on Walnut Crescent.

Notwithstanding the provisions of § 327-16, temporary parking shall be permitted on the westerly side of Walnut Crescent between the intersection of Bay Avenue and the Glen Ridge municipal boundary line for ambulances and other marked emergency vehicles utilizing the services of Mountainside Hospital.

§ 327-16.2 Spaces reserved for mobile vendors.

Notwithstanding any other provision of this code, no person shall park in a parking space reserved for a mobile vendor pursuant to Chapter 337 during the time period indicated therein, other than a mobile vendor holding a valid permit to occupy said parking space.

At all times when the parking space is not reserved for a mobile vendor, the parking regulations applicable to the block and side where the space is located shall apply.

§ 327-18.1 On-street permit parking for Board of Education employees.

Notwithstanding the provisions of § 327-18, any vehicle displaying a valid Board of Education parking permit issued in accordance with this section shall be entitled to park on those streets designated with an asterisk(*)[1] and during the times listed above on any weekday when the Montclair public schools are open.

The Township is hereby authorized to issue parking permits to employees of the Montclair Board of Education in accordance with regulations to be adopted and administered by the Township. Any vehicle displaying a valid parking permit shall be allowed to park on those streets designated with an asterisk(*)[2] and during the times listed above. Such parking shall be subject to all general restrictions and regulations of the Township of Montclair and the State of New Jersey.

Any unoccupied vehicle parked or standing in violation of this chapter in a zone identified below is deemed a nuisance and a menace to the safe and proper regulation of traffic, and any police or parking enforcement officer may provide for the removal of such vehicles. The owner shall pay the reasonable costs of the removal and storage which may result from such removal before regaining possession of the vehicle.

Towaway zones:

(1)

Public parking lot bounded by Walnut Street and Depot Square adjacent to the Walnut Street railroad station.

(2)

Every designated on-street or off-street handicap parking space pursuant to § 327-24.

(3)

Parking spaces reserved for mobile vendors pursuant to § 337-4D.

(4)

Any portions of streets designated in Section 327-19.1 on the days and during the times when parking is prohibited.

This section does not limit the authority to remove vehicles pursuant to any other provision of this chapter, or any ordinance or statute.

Designated commercial loading zones shall be utilized solely for the active delivery and receipt of goods and merchandise to or from retail merchants, personal service establishments or other business establishments, or for other personal services by the occupant of the building abutting the loading zone, between the hours of 7:00 a.m. and 6:00 p.m., Monday through Saturday (excluding legal holidays), unless otherwise specifically authorized. No other person shall park a vehicle in a designated loading zone between the hours of 7:00 a.m. and 6:00 p.m., Monday through Saturday (excluding legal holidays). Parking shall be permitted in loading zones at all other times, including Sundays and legal holidays, unless otherwise prohibited under Chapter 327 of the Township Code.

Designated other school loading and unloading zones shall be utilized solely for the active dropoff or pickup of children or delivery of goods to the school facility, between the hours designated in § 327-22C, unless otherwise specifically authorized. Parking shall be permitted in school loading zones at all other times, including Sundays and legal holidays, unless otherwise prohibited under Chapter 327 of the Township Code.

Authorized vehicles may park in a designated loading zone for no longer than 30 minutes, and such vehicles shall display red flashing warning lights while lawfully utilizing a loading zone. The Township shall install appropriate signs for all designated loading zones which shall include the hours during which said zones may be utilized only for the loading and unloading of persons, goods and merchandise as set forth herein.

Off-street handicapped parking spaces

(1)

It is the policy of the Township that all municipal parking lots and parking decks shall contain parking spaces designated as restricted parking spaces for use by persons who have been issued special vehicle identification cards by the New Jersey Motor Vehicle Commission. No other person shall be permitted to park in the spaces so reserved. The specific locations of these spaces shall be in areas of the parking lot or facility most accessible and approximate to the building or buildings or area served by the lot or facility. The number of reserved spaces and their specific location shall be determined by the Township in accordance with all applicable legal requirements, including the requirements of N.J.S.A. 52:32-12. The Township shall erect or install, in all municipal parking lots and parking decks, proper signs calling attention to the provisions of this section.

(2)

Without limiting the scope of Subsection B(1) above, the following off-street parking spaces are designated as handicap spaces. No person shall park a vehicle in the parking spaces described below unless said person has been issued a special vehicle identification card by the Division of Motor Vehicles:

Regulations for situating an on-street handicapped parking space adjacent to a residence. The following criteria and procedures shall govern the establishment of a handicapped parking space on a residential street:

(1)

The handicapped parking space (HPS) must be requested by or on behalf of a person residing on the subject property who has been issued a currently valid handicapped parking permit.

(2)

The residential property adjacent to where the HPS is located must be without a driveway or available off-street parking.

(3)

No other HPS's can be located within 200 feet of the proposed HPS.

(4)

The HPS will be removed if and when the person for whom the permit has been issued no longer resides on the property.

(5)

The requestor must submit an application for the HPS, and an annual renewal statement attesting that the requirements for an HPS continue to be met.

(6)

The HPS cannot be situated where parking is prohibited.

(7)

The HPS must comply and be established in accordance with N.J.S.A. 39:4-197.6.

§ 327-24.1 Parking allowed in accordance with regulations.

Lawful parking on the streets of the Township of Montclair shall be allowed in accordance with the regulations prescribed herein.

General regulations; parking near driveways; marking of spaces and parking stalls. Parking is prohibited within two feet of the edges of all driveways in the Township. The Department of Community Services shall have the authority to extend this distance to a maximum of four feet from the edge of a driveway. In such case, the Department of Community Services shall have lines or markings placed on the curb and/or on the street or such other identification as it shall deem appropriate, indicating no parking. When marking is installed, no person shall park any vehicle across any such line or marking or space or park any vehicle in such position that it shall not be entirely within the area so designated by such lines or markings. The governing body may in particular cases, by resolution, authorize the Department of Community Services to prohibit parking at a distance greater than four feet from the edge of a driveway.

Violations.

(1)

It shall be unlawful and a violation of the provisions of this section for any person to:

(a)

Park any vehicle across any line or marking of a parking space or park in such position that the vehicle shall not be entirely within the area designated by such lines or markings.

(b)

Deface, injure, tamper with, or willfully destroy or impair the usefulness of any marking installed under the provisions of this article.

(2)

Any person violating the provisions of this section shall, upon conviction thereof, be punished by a fine not to exceed $500 or by imprisonment in the Essex County jail for a period not to exceed 90 days, or by both such fine and imprisonment.
