There is hereby created within the Town of Clay a separate department of town government to be known as the "Department of Planning and Development."
The Town Board of the Town of Clay enacts this article to create a new department to be known as the "Department of Planning and Development," to provide for the appointment of a Commissioner of Planning and Development, and to define his duties. The Department is created for the purpose of coordinating and efficiently administrating the activities of various town boards, agencies and employees engaged in the regulation, control, planning and processing of land development within the Town of Clay.
There is hereby created the office of Commissioner of Planning and Development who shall be the executive administrator of the Department of Planning and Development. The term of said office shall be for a term of two years and until a successor shall have qualified; provided, however, that the appointee to such office shall be removable at the pleasure of the Town Board.
The qualifications for the office of Commissioner of Planning and Development shall be a bachelor's degree from an accredited college or university in the discipline of municipal planning, engineering, architecture, or a related field, together with a minimum of three years' experience in municipal planning or land development or a bachelor's degree from an accredited college or university in an unrelated discipline together with a minimum of five years' experience in municipal planning and land development.
The Commissioner of Planning and Development shall be responsible to the Supervisor as the chief executive officer of the town pursuant to the Suburban Town Law and shall have the following duties:
A. 
Those powers and duties necessary for the general supervision of the Department of Planning and Development.
B. 
Plan, organize, direct and review administrative procedures necessary to the operation of the Department of Planning and Development.
C. 
Establish systems and procedures for a central record depository of all records currently maintained by the Planning Board, Zoning Board of Appeals, Commission for the Conservation of the Environment, Board of Industrial Development and the office of the Building Inspector and shall develop forms, procedures and systems to ensure the exchange of data and information between all boards, agencies or employees of the town who are concerned with planning and land development.

D. 
Supervise and review the work of departmental subordinates and report periodically to the Supervisor concerning the operations of his Department and have the power to employ such officers and/or employees as he deems necessary for the proper operation of the Department of Planning and Development, within budgetary limitations established by the Town Board of the Town of Clay.
E. 
Have and exercise, in addition, those powers and duties heretofore granted to the Building Inspector and/or the Superintendent of Buildings by the laws of the State of New York and by resolutions of the Town Board of the Town of Clay.
F. 
Coordinate and aid the activities of the Town of Clay Planning Board, Zoning Board of Appeals, Commission for the Conservation of the Environment, Industrial Development Board and other boards or agencies concerned with planning and land development and their ecological effects.

G. 
Establish and effect a procedure for all referrals required by general and local statutes to be made in connection with applications before the Planning Board, or Zoning Board of Appeals.
H. 
Be responsible, after consultation with attorneys for the town, for the preparation and publication of all legal notices in connection with applications before the Planning Board and Zoning Board of Appeals.
I. 
Make provision for stenographic services to, and prepare and maintain official minutes of, the Planning Board, Zoning Board of Appeals, Commission for the Conservation of the Environment and the Industrial Development Board.

J. 
Establish and maintain a system for the central registration and deposit of all security agreements, construction agreements, developers' agreements and other agreements or instruments required in connection with planning and land development in the Town of Clay.

There is hereby created within the Department of Planning and Development a Bureau of Permit Inspection which shall be responsible for the conduct of all preconstruction and construction stage inspections for administering and enforcing the State Uniform Fire Prevention and Building Code, duly accepted by the Town Board of the Town of Clay on October 15, 1954.
