This chapter shall be known and may be cited
as the "Mobile Home Courts Law of the Town of Clay."
This chapter is enacted for the purpose of promoting
and maintaining a desirable residential environment within mobile
home courts in the Town of Clay and of promoting public health, safety
and welfare of the inhabitants of the Town of Clay. To these ends,
standards and prohibitions regarding the development and maintenance
of mobile home courts are hereinafter provided together with provisions
for original licensing and the annual renewal thereof, and penalties
for violations.
This chapter shall apply to all mobile home courts within the Town of Clay. As to mobile home courts in existence at the time this chapter become effective, however, any use which does not conform to the provisions hereof, but which is in compliance with any prior law or ordinance or which has been otherwise duly permitted, shall be permitted to continue under and subject to the provisions of Chapter 230, Zoning, of the Town of Clay and any conditions imposed when such permission was granted. However, the enactment of any amendments to this chapter does not legalize any conditions that fail to meet the requirements of the chapter as amended.
As used in this chapter, unless the context
or subject matter otherwise requires, the following terms shall have
the meanings indicated:
Forms for seeking permission or licensing hereunder, together
with all maps, data, exhibits, amendments and supplements to be furnished
therewith, which shall be supplied in blank or otherwise specified
by the Town Clerk.
The Commissioner of Planning and Development of the Town
of Clay and, where indicated, his staff.
Any area or space designed for joint use by the occupants
of mobile home courts.
The hard surfaced access from paved street to mobile home
stand.
A vested right to use land, other than as a tenant, for a
specific purpose; such right being held by someone other than the
owner who holds title to the land.
The area of the mobile home lot which lies between the street
line and the front line of the mobile home stand.
A moveable or portable unit designed and constructed to be
towed on its own chassis, comprised of frame and wheels, connected
to utilities, and designed and constructed without a permanent foundation
for year-round living. A unit may contain parts that may be folded,
collapsed or telescoped when being towed and expanded later to provide
additional cubic capacity as well as two or more separately towable
components designed to be joined into one integral unit capable of
being again separated into the components for repeated towing. "Mobile
home" shall mean units designed to be used exclusively for residential
purposes, excluding travel trailers.
A parcel of land which has been planned and improved for
placement of mobile homes for nontransient use.
A parcel of land set aside or designed for the exclusive
use of the occupants of a single mobile home.
That part of a mobile home lot which has been reserved for
the placement of a mobile home.
A hard surfaced outdoor living space designed to supplement
the mobile home living area.
A map, plan or chart of a subdivision or area indicating
the location and boundaries of mobile home lots.
A parcel of land consisting of two or more lots or portions
thereof which is described by reference to a recorded plat or by metes
and bounds.
A structure attached to a mobile home consisting of floor
and roof, the side of which may be screened but shall not be enclosed
by walls, windows, plastic sheeting or otherwise.
A private way which affords the principal means of access
to abutting individual mobile home lots and auxiliary buildings.
A recorded boundary of a plot.
A public way owned by a municipality.
A system which is owned and operated by the town or an improvement
district thereof or any other unit of government or an established
public utility company.
The area, public or private, over which a right of passage
exists.
Indicates that which is required or mandatory.
Indicates that which is recommended, not required.
The area of a mobile home lot between the lot lines and the
mobile home exclusive of an area meeting the definition of front yard,
driveway apron, patio, porch or similar improvement.
A parcel of land consisting of one or more lots or portions
thereof which is described by reference to a recorded plat or by metes
and bounds.
An enclosed space designed to provide auxiliary general storage
space for an individual mobile home.
