§ 74-37 Well drilling restrictions.

Any drilling, by persons, businesses, corporations, groups or organizations, of a well in any area of the Village of Hempstead is prohibited unless a permit is granted in advance by the Director of Public Works.

§ 74-38 Applications for well drilling.

Any persons, businesses, corporations, groups or organizations who wish to obtain a permit for drilling a well may do so by filling out an application available at the Office of Public Works and paying the required fees. Each permit is good for the one-time drilling of the single well described in the application. Granting of such permits is completely within the discretion of the Director of Public Works.

§ 74-39 Time limits and other limitations for actions under drilling permits.

A. The drilling of a well for which a permit has been granted shall commence within 30 days of issuance and shall be completed within 70 days of issuance of such permits. A drilling permit shalt be automatically cancelled if work does not commence or is not completed pursuant to the foregoing time limitations.

B. Permits that are granted to any persons, businesses, corporations, groups or organizations are nontransferable.

§ 74-40 Fees for well drilling.

A. All fees are refundable if the sought after permit is not granted to the person, business, corporation, group or organization seeking it, save a $5 processing fee.

B. Fees for obtaining well drilling permits are as followed:

(1) For persons drilling on their own property for personal use, the application fee shall be $25.

(2) For businesses, corporations, groups or organizations drilling on their own property, whether it be for personal or commercial use, the application fee shall be $35.

C. For all persons, businesses, corporations, groups or organizations who have, maintain, create, use, or in any way derive water from a private well granted under § 74-38, there shall be an additional charge for the use of the public sewer system in accordance with § 74-41.

§ 74-41 Fees for use of sewers by private well owners.

A. The sewer fee set forth herein shall be based on water usage at the following rates: $5 for the first 5,000 gallons of water used plus $1.20 per 1,000 in excess of 5,000 gallons of water used.

B. For the purpose of establishing the monthly water usage, the water usage shall be the one estimated by the Village of Hempstead Department of Public Works (VOH-DPW). Estimated quantity can be replaced by actual water meter readings if the well owner selects to install, at his/her own expense, a VOH-DPW approved water meter on his/her supply line. Readings of water monthly consumption shall be by VOH water plant employees.
